Some items in this change order are TxDOT bid items. The price proposed by the contractor is compared to the average pricing compiled from similar items from the Texas Department of Transportation Average Low Bid Unit Prices. TxDOT's bid quantity for its projects is typically higher than the City's. The bid price proposed by the contractor is directly proportional to the bid quantity. It is typically normal for the bid price to be higher for smaller quantities if compared with the same items with higher quantities. The difference in pricing can be justified by the current market pricing, which fluctuates every month due to price escalations and inflation. The City finds that the contractor's proposed prices are fair and reasonable. It is understood and agreed that the acceptance of this Change Order by the contractor constitutes an accord and satisfaction and represents payment in full (both time and money) for all costs arising out of, or incidental to, the above Change Order.
