HomeMy WebLinkAboutOrdinance 20916-09-2013 Ordinance No. 20916-09-2013 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE PUBLIC IMPROVEMENT DISTRICT 11 FISCAL YEAR 2013-2014 PROJECT ACCOUNT OF THE SPECIAL ASSESSMENT DISTRICT FUND IN THE AMOUNT OF $67,471.00, FROM AVAILABLE FUNDS, CONTINGENT UPON THE ADOPTION OF THE ORDINANCE LEVYING SPECIAL ASSESSMENTS FOR THE 2013 TAX YEAR, FOR THE PURPOSE OF PROVIDING MANAGEMENT AND IMPROVEMENT SERVICES FOR THE STOCKYARDS PID DURING FISCAL YEAR 2013-2014; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMITLATIVE OF PRIOR ORDINANCES,- REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2013-2014 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Public Improvement District 11 Fiscal Year 2013-2014 Project Account of the Special Assessment District Fund in the amount of$67,471.00, from available funds, contingent upon the adoption of the ordinance levying special assessments for the 2013 Tax Year, for the purpose of providing management and improvement services for the Stockyards PII)during Fiscal Year 2013-2014. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision,opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be incorporated into the ordinance effecting the budget of the municipal government of the City of Fort Worth for the ensuing Fiscal Year beginning October 1, 2013, and ending September 30, 2014, and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon-adoption. Conduct a public benefit hearing concerning the proposed special assessments on the property located in Public Improvement District 11, the Stockyards Public Improvement District for the 2013 tax year; 2. Approve the attached Stockyards Public Improvement District budget and Five-Year Service Plan for Fiscal Year 2013-2014; 3. Adopt the attached ordinance levying special assessments on the property located in the Stockyards Public Improvement District subject to assessment for the 2013 tax year; 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Public Improvement District 11 Fiscal Year 2013-2014 Project Account of the Special Assessment District Fund in the amount of$67,471.00 from available funds; 5. Authorize a transfer in the amount of $2,000.00 for administrative fees from the Special Assessment District Fund, Public Improvement District 11 Fiscal Year 2013-2014 Project Account to the Special Trust Fund contingent upon the adoption of the proposed 2013 assessment roll; 6. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Special Trust Fund in the amount of$2,000.00 from available funds; and 7. Authorize the execution of an Agreement with the Fort Worth Stockyards Preservation Foundation, Inc., to provide management and improvement services for the Stockyards Public Improvement District during Fiscal Year 2013-2014 for the sum in the amount of$13,494.00. Notice of this benefit hearing was published in the newspaper and mailed to all record owners of property in the Stockyards PID jn accordance with state law. Of this amount, $67,471.00 will be funded by assessments collected on privately owned parcels located in the district by applying a rate of$0.12 cents to each $100.00 of property value for commercial property. The remainder ofthe costs in the amount of $22,200.00 will be funded by other revenue including: the amount of $7.200.00 from web site advertising and the amount of $15.000.00 from prior year's assessments carried forward h} Fiscal Year 2013-2D14.
