HomeMy WebLinkAboutOrdinance 20926-09-2013Ordinance No. 20926 -09 -2013 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL TRUST FUND IN THE AMOUNT OF 52, 000.00, CONTINGENT UPON THE ADOPTION OF THE PROPOSED ORDINANCE LEVYING ASSESSMENTS, FOR THE PURPOSE OF ADMINISTRATIVE FEES FOR THE MANAGEMENT AND IMPROVEMENT SERVICES FOR THE FORT WORTH PUBLIC DISTRICT IMPROVEMENT DISTRICT 1.5 (SUN VALLEY) DURING FISCAL YEAR 2013 -2014; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PRO VIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2013 -2014 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Trust Fund in the amount of $2,000.00, contingent upon the adoption of the proposed ordinance levying assessments, for the purpose of administrative fees for the management and improvement services for the Fort Worth Public Improvement District 15 (Sun Valley) during Fiscal Year 2013 -2014. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be incorporated into the ordinance effecting the budget of the municipal government of the City of Fort Worth for the ensuing Fiscal Year beginning October 1, 2013, and ending September 30, 2014, and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4, This ordinance shall take effect upon adoption. ... Following the public hearing. it is recommended that the City Council approve the attached budget and Five-Year Service Plan of the P|D. adopt the attached ordinance levying the proposed oeoaaSnnentS and to adopt the attached appropriation ordinances oUoCahnQ estimated receipts to the Sun Valley PID's fund. On August 20, 2013. (M&C BH-299) the City Council conducted o public hearing to receive comments on the proposed Sun Valley P|[) and the 2013-2014 Fiscal Year budget and Five-Year Service Plan for the proposed P|D. Notice of this benefit hearing was published in the newspaper and nn8Ued to all rao0nj owners of property in the Sun Valley PID in accordance with state law. The improvements and aonvimas to be provided in the P|D during the 2013'2014 FlSma| Year and the costs thereof are as follows: The total budgeted costs of the improvements are in the amount of $78.185.00. Of this amount, $69,415.00 will be funded bv assessments collected on privately owned parcels located in the district by CERTIFICATION: levying special assessments at a rate of $0.27 to each $100.00 of property value. The Sun Valley PID is located in COUNCIL DISTRICT 5. FISCAL INFORMATION / The Financial Management Services Director certifies that upon approval of the above recommendations and adoption nf the Fiscal Year 2O13-2014budget by the City Council, funds will be available in the Fiscal Year 2014 operating budget, as appropriated, of the Special Assessment District Fund and the Special Trust Fund.
