X Subject: BOUNDARY AGREEMENT BETWEEN THE CITIES OF FORT WORTH AND ROANOKE

The City Council continued, until July 17, 1990, consideration of a resolution
clarifying the ETJ boundary between the cities of Fort Worth and Roanoke pending
additional information. The staff has reviewed the status and history of the
property under consideration.
BACKGROUND
On March 3, 1982, a letter was sent to the respective City Secretarys of Fort
Worth and Keller. This letter was sent by the then Roanoke Mayor Ed Moore, ad-
vising the cities of the intended annexation. A notice was published on March 5,
1982, advising interested parties of a public hearing scheduled for March 16,
1982, to consider the annexation. The Roanoke City Council held the required
hearing and adopted ordinance #82-107 on March 16, 1982.
There is no record of either Fort Worth or Keller filing any protest, objection
or response to Roanoke's action. The City Attorney's Office has performed a
brief review of validation statutes in an effort to ascertain any unique circum-
stances regarding Roanoke's action. There appears to be nothing extraordinary
which would invalidate this action.
SUMMARY
The recommendation continues to be the approval of the resolution as presented in
order to clarify the status of the property in favor of the Roanoke 1982 action.
This is based on the following considerations:
1. Roanoke complied with the applicable notice requirements in
March, 1982 and neither Fort Worth nor Keller filed an objection.
2. Ultimate settlement of the ETJ dispute will include an appor-
tionment of property. This parcel could be included in the over-
all settlement.
3. The economic growth projected for north Fort Worth will impact
other jurisdictions and maintaining a positive working relation-
ship is in Fort Worth's best interest.
This information is presented for the council 's consideration relating to M&C
G-8725. further information is needed, please let me know.
