To the Mayor and Members of the Char Council x*� Subject: Pr�ivate Industry Council Agri When i!!&C C-12402 was presented to the City Council on July 12, 1990 recommending renewal of the Private Industry Council (PIC), Agreement a request was made for additional information. The information that follows will provide more details on the PIC, the method of appointment and some provisions of contract administration for job training programs. BACKGROUND The City of Fort north has been involved in administering federal job training programs since the early 1970s. During the period between 1970 and 1982 most programs provided resources for public service job/employment opportunities in the governmental and public sectors. During this period, special financial incentives were made available to local governments and other administrative entities. In response to these initiatives, the City of Fort north elected to join a Consortium (partnership) with several other neighboring Tarrant County cities. Presently, the Fort north Consortium for Employment and Training Programs consist of the cities of Arlington, Euless, Fort Worth, Haltom City, and White Settlement, with the City of Fort Worth serving as the grant recipient and administrative entity for the partnership. Consortium arrangements are not mandated, but are encouraged to reduce administrative expenses and duplication of services. PRIVATE INDUSTRY COUNCILS In October 1982 the Job Training Partnership Act (JTPA), was enacted and the focus of federal job training program was redirected. JTPA placed emphasis on private sector involvements and public service job programs were discontinued. To ensure that the goals of JTPA were achieved, Congress mandated the creation of Private Industry Councils (PICs) for each service area. In accordance with the goals of JTPA, at least 51% of the PIC's membership must be representatives of the private sector. In addition to private sector representation, PIC's must also have representatives from the following sectors: 1. Educational Agencies 2. Organized Labor 3. Rehabilitation Agencies 4. Community Based Organizations 5. Economic Development Agencies 6. Employment Service (Texas Employment Commission) 7. State Department of Human Services GENERAL POWERS AND DUTIES: In accordance with the JTPA Law, the PIC is responsible for 1 establishing policy, guidance, and exercising oversight with respect to Job Training Activities administered under JTPA in partnership with the Consortium, (2) determining procedures for the development of the Consortium's Job Training Plan; (3) approving the Consortium's Job Training ISSUED BY THE CITY MANAGER FORT WORTH, TEXAS ---- INFORMAL REPORT TO CITY COUNCIL MEMBERS No. 7478 �.•,•.. July 24, 1990 ` 100?'a To the Maim and Members of the City Council *ArxFg: .., Subject: Private Industry Council Agreewnt Plan and presenting it to the Fort Worth City Council; (4) establishing policy to provide for effective programs monitoring and evaluation; (5) seeking ways to increase the participation of the Private Sector in programs offered by the Consortium; (6) providing information to the Consortium in regard to projected employment opportunities; and (7) performing such other duties as may be required by the Act. METHOD OF APPOINTMENT: The Fort Worth PIC consists of the following representation: A. Fifteen members are appointed from the business sector: 5 Appointments from the Fort Worth Chambers of Commerce. - 3 from the Fort Worth Chamber - I from the Metropolitan Black Chamber - 1 from the Hispanic Chamber 2 Appointments from the Arlington Chamber of Commerce 1 Appointment from the White Settlement Chamber of Commerce i Appointment from the Euless Chamber of Commerce 1 Appointment from the Haltom City Chamber of Commerce 5 At-large appointments from any Consortium City Chamber B. Eight members are appointed from the following sectors: 2 Appointments from Educational Institutions - Fort Worth ISD - Tarrant County Junior College 1 Appointment from Organized Labor - Central Labor Council 1 Appointment from the State Employment Service - Texas Employment Commission I Appointment from Rehabilitation Service Delivery Agency - Fort Worth State School 2 Appointments from Community Organizations - United Way of Tarrant County - Fort Worth Economic Development Corp 1 Appointment from the State Dept. of Human Service Presently there are two vacancies, (2 of the 5 at-large seats) on the PIC. All nominations for appointment are submitted to the City Council because the City of Fort Worth serves as the Administrative Entity for the Consortium. As required by JTPA, the Governor of each State must certify local PICs as d meeting federal requirements. The Fort Worth PIC has been certified as meeting these requirements. In the past, members of the Fort Worth City Council have served on the PIC as representatives of one of the above nominating organizations. Subject: Private Industry Council Agreement CONTRACT ADMINISTRATION The question of possible conflicts of interest related to those agencies/organizations that hold mandated seats on the PIC was addressed in the early stages of JTPA. This questions was reviewed by the City's Department of Law, and, in general, it has been determined that PIC members should not participate in deliberations and must abstain from voting on matters and/or contracts concerning their respective organizations. Like other City of Fort north Board and Commissions, members of the PIC must adhere to the local Ethics Code and State laws governing conflict of interest. The local JTPA program is frequently reviewed by State and Federal officials to ensure adherence to provisions of the law. JTPA is somewhat unique with respects to mandated PIC representation and service provider selection requirements. It is difficult to administer an effective jab training program without the involvement of the local education system, community organizations, or the employment service (TEC). The PIC has constantly expressed their desire to expand The Working Connection's Contractor base. With this goal in mind, members of the PIC and staff have put forth a concerted effort to identify new service providers. As a result of these efforts, several new bidders have responded to requests for proposals in the last two years, some of which were awarded contracts. To assist potential contractors, The Working Connection staff host meetings and provides technical assistance regarding the Job Training Partnership Act requirements. As proposals are requested from potential contractors, special bidders conferences are held to explain to proposers the program design of JTPA services that can be provided by contractors. Once a potential service provider becomes a contractor, in-service training sessions are conducted by staff to provide technical assistance on the details of daily program operations including specific forms required and programmatic requirements. The PIC Agreement attached to M&C C-12402 is the same basic Agreement that has been in place since 1983, with the exception of increasing the number of seats in 1987.
