PATE SAFE ROUTES TO SCHOOL PROJECT (CITY PROJECT NO. 104798) IN THE AMOUNT OF $1,300,000.00, AND DECREASING APPROPRIATIONS IN THE NEIGHBORHOOD/SCHOOL SAFETY PROGRAMMABLE PROJECT (CITY PROJECT NO. PB0007 ) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the budget of the City of Fort Worth for Fiscal Year 2024-2025, as enacted by Ordinance 27107-09- 2024, as amended, is hereby further amended to make the following adjustments to appropriations in the 2022 Bond Program Fund, by increasing appropriations in the A.M. Pate Safe Routes to School project (City Project No.104798) in the amount of $1,300,000.00, and decreasing appropriations in the Neighborhood/School Safety programmable project (City Project No. PB0007) by the same amount. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27107-09-2024 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. PATE SAFE ROUTES TO SCHOOL SUBJECT (CD 11) Authorize Execution of Amendment No. 1 in an Amount Not to Exceed $283,785.00 to an Engineering Services Agreement with Burns & McDonnell Engineering Company, Inc., for the A.M. Pate Safe Routes to School Project for a Revised Contract Amount of $683,424.00, Adopt Appropriation Ordinance and Amend the Fiscal Years 2025-2029 Capital Improvement Program (2022 Bond Program) RECOMMENDATION: It is recommended that the City Council: 1. Authorize execution of Amendment No.1, in the amount of $283,785.00, to City Secretary Contract Number 60104 with Bums & McDonnell Engineering Company, Inc., thereby increasing the contract amount to $683,424.00 for the A.M. Pate Safe Routes to School (City Project No. 104798); 2. Adopt the attached appropriation ordinance adjusting appropriations in the 2022 Bond Program Fund in the amount of $1,300,000.00 by increasing appropriations in the A.M. Pate Safe Routes to School project (City Project No. 104798) and decreasing appropriations in the Neighborhood/School Safety programmable project (City Project No. 13130007) by the same amount, for additional project costs; and 3. Amend the Fiscal Years 2025-2029 Capital Improvement Program. DISCUSSION: The A.M. Pate Safe Routes to School project funds were approved as part of the 2022 Bond Program and with an Advance Funding Agreement (AFA) with Texas Department of Transportation (TxDOT) (M&C 23-0874, City Secretary Contract No. 60485). In 2023, an Engineering Services Agreement with Bums & McDonnell Engineering Company, Inc., City Secretary Contract No. 60104, was authorized for the design of the project with Mayor and Council Communication (M&C) 23-0635. The project scope includes installing sidewalks and Americans with Disabilities Act (ADA) ramps near A.M. Pate Elementary School. This Amendment No.1 is required to increase the project limit to match the City's application to the North Central Texas Council of Government (NCTCOG) call for projects and the project limits. The most updated TPBE, estimated at schematic design in 2024, has increased by 50%. The additional funds are being appropriated to amend the engineering agreement for additional scope, to increase the funding available for construction, and to make right-of-way and easement acquisitions. The table below summarizes past appropriations, sources, additional funding, and the project's estimated total cost at completion. The City's Extendable Commercial Paper (ECP) (M&C 22-0607; Ordinance 25765-08-2022) provides liquidity to support the appropriation. Available resources will be used to make interim progress payments until the debt is issued. Once debt associated with a project is sold, debt proceeds will reimburse the interim financing source by the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance 25515-05-2022). Funding for this project was not included in the FY2025-2029 Capital Improvement Program because the amount of additional funding needed was unknown at the time of CIP development. The action in this M&C will amend the FY2025-2029 Capital Improvement Program as approved in connection with Ordinance 27107-09-2024. Funding is budgeted in the 2022 Bond Program Fund for the TPW Dept Highway & Streets Department for the purpose of funding the A M PATE SRTS project. MWBE Office: Bums & McDonnell Engineering Company, Inc. agrees to maintain its initial MA BE commitment of 12% on the original agreement and extend and maintain that same MA BE commitment of 12% to this first amendment. Therefore, Bums & McDonnell Engineering Company, Inc. remains in compliance with the City's MN BE Ordinance and attests to its commitment by its signature an the Acceptance of Previous MANBE Commitment form executed by an authorized representative of its company. The project is located in COUNCIL DISTRICT 11. FISCAL. INFORMATION ! CERTIFICATION: The Director of Finance certifies that funds are currently available in the Neighborhood/School Safety project within the 2022 Bond Program Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance funds will be available in the 2022 Bond Program Fund for the AM PATE SRTS project to support the above recommendations and execution of the amendment.
