AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE TPW GAS WELL REVENUES FUND IN THE AMOUNT
OF $122.830.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF THE
ACQUISITION OF LAND FOR RJGHT-OF-WAY FOR THE OLD DECATUR ROAD
PROJECT PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2012-2013 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the TPW
Gas Well Revenues Fund in the amount of $122,830.00, from available funds, for the purpose of the
acquisition of land for right-of-way for the Old Decatur Road project.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in fill force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 20411-09-2012 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions
of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Authorize Acquisition of a Fee Simple Interest in a Total of 0.353 Acres of Land for Right-of-Way, a
Permanent Easement Interest in a Total of .021 Acres of Land for Drainage and a Temporary Easement
Interest in a Total of 0.331 Acres of Land for Construction from Various Landowners for the Old Decatur
Road Improvement Project No. 01749, Located from WJ Boaz Road to McLeroy Boulevard in the Amount
of$108,830.00, Pay Estimated Closing Costs in the Amount of$14,000.00 for a Total Amount of
$122,830.00 and Adopt Appropriation Ordinance (ETJ NEAR COUNCIL DISTRICT 7)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations
in the TPW Gas Well Revenues Fund in the amount of$122,830.00 from available funds for
acquisition of right-of-way and easements and construction of the improvements for the
Old Decatur Road Improvement Project No. 01749;
2. Authorize the acquisition of a fee simple interest in a total of 0.353 acres of land for
right-of-way, a permanent easement interest in a total of 0.021 acres of land for drainage
and a temporary easement interest in a total of 0.331 acres of land for construction from
various landowners, as set forth in the Discussion below, for the Old Decatur Road
Improvement Project No. 01749, located from WJ Boaz Road to McLeroy Boulevard for
a total purchase price in the amount of$108,830.00;
3. Find that the total purchase price in the amount of$108,830.00 is just compensation; and
4. Authorize the acceptance of the conveyances, the recording of the appropriate
instruments and payment of the estimated closing costs in the amount up to $14,000.00.
DISCUSSION:
The City requires fee simple, permanent and temporary easement interests in land for right-of-way
for the Old Decatur Road Improvement Project No. 01749 to construct a road widening from WJ Boaz
Road to McLeroy Boulevard. Old Decatur Road will be expanded from a three-lane undivided roadway
to a four-lane divided arterial from WJ Boaz Road to McLeroy Boulevard in accordance with the City's
Master Thoroughfare Plan. The 2008 Bond Program included funds for project design. On April 22, 2008,
(M&C G-16117) City Council established a Special Projects Fund for Street Improvements and authorized
the use of Gas Well Revenues in the amount of$15 million for arterial streets. Old Decatur Road is one
of the roadways included in this funding. Gas Well funds will be used for right-of-way, and easement
acquisitions.

An independent appraisal was acquired for each parcel and each property owner has agreed to the
appraised or negotiated amounts for the needed interest(s) in each parcel of land. The real estate taxes
will be pro-rated with the sellers being responsible for taxes due up to the closing date. The City will pay
the closing costs for the property interest acquired up to the amount of$14,000.00. Upon City Council
approval, Staff will proceed with acquiring the fee simple and easement interests except for the
mineral estate for each property listed below. The deeds to the City will contain surface waivers for
the exploration of the mineral estate.
