HomeMy WebLinkAboutOrdinance 27033-08-2024Ordinance No. 27033-08-2024 AN ORDINANCE REALLOCATING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE DEVELOPMENT SERVICES DEPARTMENT OF THE GENERAL FUND BY DECREASING APPROPRIATIONS IN THE GENERAL OPERATING AND MAINTENANCE CATEGORY IN THE AMOUNT OF $40,000,00, AND INCREASING APPROPRIATIONS IN THE TRANSFER OUT CATEGORY BY THE SAME AMOUNT FOR THE PURPOSE OF FUNDING THE REQUIRED LOCAL MATCH FOR THE TEXAS HISTORICAL COMMISSION GRANT TO SUPPORT THE CITY OF FORT WORTH'S HISTORIC RESOURCES SURVEY; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION I. That the budget of the City of Fort Worth for Fiscal Year 2023-2024, as enacted by Ordinance 26453-09- 2023, as amended, is hereby further amended to make the following reallocations to amounts allocated to various City departments for Fiscal Year 2023-2024 in the Budget of the City Manager, there shall also be reallocated appropriations in the Development Services Department of the General Fund decreasing appropriations in the General Operating and Maintenance category in the amount of $40,000,00, and increasing appropriations in the Transfer Out Category by the same amount for the purpose of funding the required local match for the Texas Historical Commission Grant to support the City of Fort Worth's Historic Resources Survey. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. O ��!%. v a o =XJ 0 Q °a o 4L d 0 0 .a` .Icy City of Fort Worth, Texas Mayor and Council Communication DATE: 08/13/24 M&C FILE NUMBER: M&C 24-0619 LOG NAME: 06TEXAS HISTORICAL COMMISSION GRANT -PHASE VII SU_ BJEC (ALL) Reallocate Appropriations in the Development Services Department's General Fund by Decreasing the General Operating and Maintenance Accounts in the Amount of $40,000.00 and Increasing the Transfer Out Category by the Same Amount, for the Purpose of Funding the Required Local Match forthe Texas Historical Commission Grant to Support the City of Fort Worth's Historic Resources Survey, and Adopt Appropriation Ordinance RECOMMENDATION:_ It is recommended that the City Council adopt the attached appropriation ordinance reallocating appropriations in the Development Services Department's General Fund by decreasing the General Operating and Maintenance Category in the amount of $40,000.00 and increasing the Transfer Out Category by the same amount for -the purpose of funding the required local match for the Texas Historical Commission Grant to support the City of Fort Worth's Historic Resources Survey (City Project No. 102742). DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to authorize necessary formal steps regarding the allocation of funds that were previously approved for reallocation regarding the local match for a grant. The City was awarded $47,500 for Phases V and VI in 2022, and $36,770 for Phase VII in 2024. As part of the Texas Historical Commission's (THC) four-year evaluation of the City of Fort Worth's Certified Local Government (CLG) program under Section 101 (a)(7)(C) of the National Historic Preservation Act of 1966, it was noted that the City as a CLG was required to maintain a system for the survey and inventory of local historic properties that is coordinated with the statewide cultural resources survey process. Development and implementation of such as system is done with technical assistance provided by the National Register Program office of the THC's History Programs Division. In order to resolve this outstanding issue, a proposal was developed that outlined the City's plan to undertake a multi -year, multi -phase survey update. The M&C's authorizing the allocation of $20,000.00 each were approved in June 2022 (M&C 22-0481) and in June 2023 (M&C 23-0535). In February 2024, Preservation and Design staff were informed that the transfers did not formally take place. This M&C is to correct that oversight. Approval of this M&C and adoption of the attached ordinance will formalize and document the reallocation of General Fund appropriations. In addition, approval of this M&C will comply with City Charter requirements and formally authorize both transfers that support the match and Grants Fund appropriation. Funding is budgeted in the General Operating & Maintenance Category within the General Fund for the Development Services Department. This is a citywide project in all Council Districts. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION 1 CERTIFICATION: The Director of Finance certifies that upon approval of the recommendations, funds are available in the current operating budget, as previously appropriated, in the General Fund. Prior to an expenditure being incurred, the Development Services Department has the responsibility to validate the availability of funds. This is a reimbursement grant.
