HomeMy WebLinkAboutResolution 6028-12-2024A Resolution NO.6028-12-2024 A RESOLUTION ESTABLISHING A PAY RATE ADJUSTMENT FOR HEARING OFFICERS MARIE ORNELAS AND KAREN WILLIAMS; PROVIDING THAT THIS RESOLUTION SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE WHEREAS, Chapter 7 of the Code of the City of Fort Worth (2015), as Amended, (City Code) provides for ahearing officer to hear appeals from decisions of the Director of Code Compliance regarding the probationary status, suspension or revocation of the registration of multi -family complexes; WHEREAS, Chapter 10 of the City Code provides for the appointment of one or more hearing officers who serve two-year terms and adjudicate cases involving parking, stopping, or standing of vehicles and conduct boot hearings; WHEREAS, Chapter 12.5 of the City Code provides for a hearing officer to hear formal appeals regarding solid waste and recycling decisions; WHEREAS, Chapter 22 of the City Code provides that the hearing officer oversees the Parking Violations Bureau and has original jurisdiction over cases involving violation of City ordinances governing the parking, stopping, or standing of vehicles and that the hearing officer conducts hearings involving violation of City ordinances governing abandoned and junked vehicles; and WHEREAS, M&C: 19-0365 and CSC —No. 53431 provides for ahearing officer to conduct hearings for the denial, suspension, and revocation of County permits within City limits, as set forth in Section 2.2 through 2.5 of the Tarrant County Game Room Regulations; WHEREAS, it is recommended that the City Council approve Hearing Officer Marie Ornelas pay rate adjustment of 1.5% for Fiscal Year 2025, with the new pay rate of $28.84 and Karen Williams pay rate adjustment of 4% for Fiscal Year 2025, with the new pay rate of $28.84, both effective October 1, 2024. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: That the City Council hereby approve Hearing Officer Marie Ornelas pay rate adjustment of 1.5% for Fiscal Year 2025, with the new pay rate of $28.84 and Karen Williams pay rate adjustment of 4% for Fiscal Year 2025, with the new pay rate of $28.84, both effective October 1, 2024. Goodall, City Secretary City of Fort Worth, Texas Mayor and Council Communication DATE: 12/10/24 M&C FILE NUMBER: M&C 24-1120 LOG NAME: 38SUBSTITUTE HEARING OFFICER PAYADJUSTMENTS FY25 SUBJECT (ALL) Ratify Pay Rate Adjustments for Hearing Officers Marie Omelas and Karen Williams to be Effective October 1, 2024 and Adopt Resolution RECOMMENDATION: It is recommended that the City Council ratify pay rate adjustments for Hearing Officer Marie Ornelas and Karen Williams to be effective October 1, 2024, and adopt the attached resolution. DISCUSSION: Section 10-17 of the Code of the City of Fort Worth (2015). as amended, (City Code) specifies that the City of Fort Worth Parking Violations Bureau is composed of one or more Hearing Officers who are appointed by the City Council for terms of two years and who report to and are under the administrative oversight of the Director of Municipal Court Services. Under Chapters 7, 10, 12.5, 20 and 22 of the City Code, the City Council and the City Manager are tasked with appointing Hearing Officers to perform various functions and the parking violations Hearing Officer has been designated to perform those duties as well. With the approval of the Fiscal Year (FY) 2025 Budget the City made changes to all pay structures to maintain market competitiveness. Because of the change to the Hearing Officer pay structure, Marie Omelas and Karen Williams fell below the minimum pay rate. The proposed pay rate adjustments are to bring them to the minimum rate for their job title. The attached resolution would provide for a 1.5% pay rate increase for Marie Omelas to become effective on October 1, 2024, and a 4% pay rate increase for Karen Williams effective October 1, 2024. The new pay rate adjustments will set the FY2025 hourly pay rates for the Hearing Officers as follows: Increase from $28.42 to $28.84 per hour for Fiscal Year 2025 for Hearing Officer Marie Omelas. Increase from $27.73 to $28.84 per hour for Fiscal Year 2025 for Hearing Officer Karen Williams. Funding is budgeted in the Part Time Employee Salaries account within the General Fund for the Municipal Court Administration Department. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION 1 CERTIFICATION: The Director of Finance certifies that upon the approval of the recommendation, funds are available in the current operating budget, as previously appropriated, in the General Fund. Prior to any expenditure being incurred, the Municipal Court Department has the responsibility to validate the availability of funds.
