DELEGATING AUTHORITY TO ISSUE LETTERS OF APPROVAL AND MAKE
REQUIRED FINDINGS PURSUANT TO TEXAS HEALTH AND SAFETY CODE
SECTION 773.0573 TO THE CITY MANAGER
WHEREAS, in 1988, Fort Worth and certain other Tarrant County municipalities came
together to create a regional ambulance and emergency medical services ("EMS") agency
known as the Area Metropolitan Ambulance Authority, d/b/a Medstar, (the "Authority")
through the adoption of a uniform EMS ordinance and interlocal cooperative agreement
(the "Agreement") under the provisions of Section 773.051 of the Texas Health and Safety
Code and pursuant to Ordinance Number 10094 (the "Ordinance");
WHEREAS, as permitted by the Agreement and the Ordinance, interfacility
transportation services ("IFT") for hospitals and other local medical facilities within the City
have been exclusively provided by the Authority;
WHEREAS, the Agreement further provides that the Authority shaIl continue in
existence until all units of governments that are party to the Agreement (the "Member Cities")
withdraw from the Agreement;
WHEREAS, the Member Cities have, pursuant to the Memorandum of Understanding
and Agreement ("MOUA") executed by each Member City agreed to: withdraw from and
terminate the Agreement; dissolve the Authority; and designate the City as the licensed
EMS Provider for the Member Cities' jurisdictions;
WHEREAS, the MOUA further provides for the transition of all EMS related services,
operations, assets, and responsibilities to the City, to be administered by the City of Fort
Worth Fire Department with independent medical direction provided by a Medical Director
through the new City of Fort Worth Department Office of the Medical Director;
WHEREAS, Fort Worth and its EMS division will not be designated as the exclusive
provider of IFT services within the EMS System service area;
WHEREAS, to provide IFT and EMS related services, a provider must hold a license
with the Texas Department of State Health Services;
WHEREAS, in 2013, the Texas Legislature passed section 773.0573 of the Texas
Health and Safety Code, which requires that any applicant for an EMS provider license obtain
a letter of approval from the governing body of the municipality in which the applicant is
located;
WHEREAS, section 773.0573 also requires that the governing body make certain
determinations before issuing a letter of approval to an applicant;
WHEREAS, the Fort Worth `City Council (the "Council") finds that, in order to
facilitate operational efficiencies, it is prudent to delegate the authority to issue a letter of
approval for an applicant's EMS provider license and to make the findings required by section
773.0573 to the Fort Worth City Manager's Office ("CMO"); and
WHEREAS, this Resolution shall be effective as of the date of its adoption by the
Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS, THAT:
The CMO, by and through the Fort Worth City Manager, the Deputy City Manager,
or an Assistant City Manager, is authorized to take the following actions pursuant to
the requirements in section 773.0573 of the Texas Health and Safety Code:
1. Review the application for an EMS Provider license and determine whether
the addition of another licensed EMS provider will interfere with or adversely
affect the provision of emergency medical services by the licensed EMS
providers operating in the City;
2. Review the application for an EMS Provider license and determine whether
the addition of another licensed EMS provider will remedy an existing provider
shortage that cannot be resolved through the use of the licensed EMS providers
operating in the City;
3. Review the application for an EMS Provider license and determine whether
the addition of another licensed EMS provider will cause an oversupply of
licensed EMS providers in the City; and
4. Issue a letter of approval to an applicant for an EMS Provider license if it is
determined by the CMO that the addition of another licensed EMS provider will
not interfere with or adversely affect the provision of EMS by the EMS providers
operating in the City; it will remedy an existing provider shortage that cannot be
resolved through the use of the licensed EMS providers operating in the City;
and the addition of another licensed EMS provider will not cause an oversupply
of licensed EMS providers in the City.
