Home My WebLink AboutResolution 6040-12-2024X%JUJ RESOLUTION NO.6040-12-2024 APPOINTING BOARD MEMBERS, ACKNOWLEDGING THE APPOINTMENT OF BOARD MEMBERS WHOSE TERMS HAVE NOT EXPIRED, ACKNOWLEDGING THE APPOINTMENT OF BOARD MEMBERS FROM OTHER ENTITIES, AND APPOINTING A CHAIRPERSON FOR THE BOARD OF DIRECTORS OF EACH OF THE CITY'S TAX INCREMENT REINVESTMENT ZONES WHEREAS, the City Council of the City of Fort Worth ("City Council" and "City") previously created the following Tax Increment Reinvestment Zones ("TIF(s)") via the respective ordinances referenced below ("Creation Ordinance(s)"): a. Tax Increment Reinvestment Zone Two (Ordinance No. 12323) b. Tax Increment Reinvestment Zone Three (Ordinance No. 12324) c. Tax Increment Reinvestment Zone Four (Ordinance No. 13259) d. Tax Increment Reinvestment Zone Six (Ordinance No. 15325) e. Tax Increment Reinvestment Zone Eight (Ordinance No. 15775) f. Tax Increment Reinvestment Zone Nine (Ordinance No. 15797) g. Tax Increment Reinvestment Zone Twelve (Ordinance No. 17061-07-2006) h. Tax Increment Reinvestment Zone Thirteen (Ordinance No. 17889-11-2007) i. Tax Increment Reinvestment Zone Fourteen (Ordinance No. 20505-1 I-2012) j. Tax Increment Reinvestment Zone Fifteen (Ordinance No. 21550-12-2014); WHEREAS, each Creation Ordinance provides that the TIFs are governed by a Board of Directors ("Board") of which certain other municipal entities have the right to appoint a Board member and the City Council has the right appoint all remaining Board members; WHEREAS, House Bill 2853, which was passed by the 82"d Texas Legislature and took effect on June 17, 2011, amended Texas Tax Code Section 311.009 regarding appointment of Board members of tax increment reinvestment zones and prevails over any conflicting provision of Creation Ordinances dated prior to June 17, 20I 1; WHEREAS, the term for certain Board members of each respective TIF expires on December 31, 2024, and the City Council wishes to make appointments to those places for terms beginning as shown on Exhibit A; WHEREAS, the City Council wishes to acknowledge the Board members of each respective TIF serving terms that expired December 31, 2024; WHEREAS, the City Council wishes to acknowledge the Board members of each respective TIF appointed by other entities; WHEREAS, Texas Tax Code Section 311.009(c) provides that Board members shall be appointed for a term of two (2) years unless otherwise indicated; WHEREAS, the City Council has the right, at any time and for any reason, to appoint an individual to the Board to replace any current member appointed by the City Council for the remainder of that person's term; and WHEREAS, Texas Tax Code Section 311.009(D provides that the City Council must appoint one (1) member of the Board to serve as the Board's chairperson for a term of one (1) year beginning January 1, 2025; and WHEREAS, the City Council, for operational efficiency and effectiveness of the respective TIFs appoints (1) member of the Board to serve as the Board's vice -chairperson for a term of one (1) year beginning January 1, 2025; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The City Council appoints, and acknowledges, the persons listed as representing the City of Fort Worth to the Board of each respective TIF for terms shown on the spreadsheet attached hereto as Exhibit A. 2. The City Council acknowledges the Board members listed as representing the City of Fort Worth for each respective TIF appointed by the City Council for the terms shown on Exhibit A. 3. The City Council acknowledges the persons appointed to the Board of each respective TIF by other entities for the terms shown on Exhibit A. 4. The City Council appoints the persons designated as chairperson and vice - chairperson on Exhibit A for each respective TIF to serve in such position for a term beginning January 1, 2025, and expiring December 31, 2025. 5. The City Council hereby reserves the right, at any time and for any reason, to remove a Board member appointed by the City Council and to appoint individuals to the Board to replace any of the City Council appointed Board members. 6.
