HomeMy WebLinkAboutContract 52483-A9AMENDMENT No. 09 CSC No.52483-A9 TO CITY SECRETARY CONTRACT No. 52483 WHEREAS, the City of Fort Worth (CITY) and Halff Associates, Inc., (ENGINEER) made and entered into City Secretary Cont act No. 52483, (the CONTRACT) which was authorized M&C No. C-29147 on the 11 day of June, 2019 in the amount of $ 930,000.00; and WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in the amount of $27,000.00 which was administratively authorized on June 23, 2020; Amendment Number 2 in the amount of $37,000.00 which was administratively authorized on September 02, 2020; Amendment Number 3 in the amount of $35,945.00 which was administratively authorized on December 28, 2020; Amendment Number 4 in the amount of $36,700.00 which was authorized by M&C No. 21-0219 on April 14, 2021; Amendment Number 5 in the amount of $56,841.00 which was administratively authorized on October 25, 2021; Amendment Number 6 in the amount of $428,665.00 which was authorized by M&C No. 21-0996 on December 14, 2021; Amendment Number 7 in the amount of $22,000.00 which was administratively authorized on February 01, 2023; Amendment Number 8 in the amount of $2,000.00 which was administratively authorized on February 05, 2024 and WHEREAS, the CONTRACT involves engineering services for the following project: CentrePort Trail Phase I (CPN 100082); WHEREAS, it has become necessary to execute Amendment No. 9 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $50,000.00 (See Attached Funding Breakdown Sheet, Page -4-) OFFICIAL RECORD CITY SECRETARY FT. (ENGINEER) is pleased to submit the following scope and fee proposal to provide trail design services for the CentrePort Trail Phase 1 within the City of Fort Worth (CITY) city limits. Page 1 ■ ■ haLff Centreport Trail Phase 1: Construction Administration City of Fort Worth July 2, 2024 ATTACHMENT A ENGINEERING SERVICES for CENTREPORT TRAIL PHASE 1: CONSTRUCTION ADMINISTRATION PURPOSE Halff Associates, Inc. (ENGINEER) will provide the additional construction administration services listed in Task 1 for Centreport Trail Phase 1 (PROJECT) for the CITY and TxDOT (ADMINISTRATOR). This scope of services supplements the scope of services outlined in the Professional Services Agreement dated July 2, 2019. The services to be provided as part of this amendment are as follows: ASSUMPTIONS The scope of services for this proposal has been prepared using the following assumptions as a basis for its preparation: 1. The services listed below shall be completed on a lump sum basis, and once the fee is exhausted an additional supplemental will be required to continue construction administration services. Page 2 mom haLff BASIC SCOPE OF SERVICES TASK 1— COORDINATION MEETINGS Centreport Trail Phase 1: Construction Administration City of Fort Worth July 2, 2024 ENGINEER will attend a maximum of twenty-four (24) virtual one -hour meetings with the CITY and Contractor. • The CITY will schedule the meetings and invite all attendees. • Effort for Task 1 is limited to 60 hours. Effort in excess of 60 hours will warrant additional fee. TASK 2 — SITE VISITS ENGINEER will attend a maximum of six (6) site visits with the CITY and Contractor. • The CITY will schedule the site visits, and let the ENGINEER know which site visits to attend. • This task shall be a contingent item and will only be utilized as needed. • Effort for Task 2 is limited to 35 hours. Effort in excess of 35 hours will warrant additional fee. TASK 3 — RESPONSE TO RFI/SUBMITTAL REVIEW ENGINEER will review RFIs and Submittals and submit review comments to the CITY. • The CITY will coordinate with the ENGINEER on which RFIs and Submittals are to be reviewed by the ENGINEER. • Effort for reviewing and responding to RFIs and Submittals is limited to 200 hours. RFI and Submittal review effort in excess of 200 hours will warrant additional fee. BASIS OF COMPENSATION CITY CENTREPORT TRAIL PHASE 1: CONSTRUCTION ADMINISTRATION A. Basic Fee Services: The basis of compensation for Basic Fee services shall be as follows: Task 1— COORDINATION MEETINGS $10,000 Task 2 — SITE VISITS $6,000 Task 3 — RESPONSE TO RFI/SUBMITTAL REVIEW $34,000 OVERALL TOTAL: $50,000 Page 3 ■ ■ haLff Centreport Trail Phase 1: Construction Administration City of Fort Worth July 2, 2024 B. Billing Schedule: The compensation for tasks listed as Basic Services in the compensation schedule shall be Lump Sum, and the services for each Basic Service task shall be invoiced on a percent complete basis. Total fees will not be exceeded without prior approval. The project will be billed to CITY on a monthly basis. Page 4 ■ 111111111 haLff Centreport Trail Phase 1: Construction Administration MENCity of Fort Worth 1 July 2, 2024 ATTACHMENT B EXCLUSIONS The following services are not included in the scope or fees for this proposal; but can be provided by Halff Associates, Inc., subject to negotiation: General: 1. Any additional work not specifically included in the Proposed Scope of Work will be accomplished as Additional Services 2. Client generated changes to the design once Construction Document Preparation is in progress. Time will be billed at fee base per task, per a proposal approved by the CLIENT, until the work is at the same level of completion as it was prior to the change. 3. Revisions to the plans requested by the CLIENT after the plans are approved, unless necessitated by discrepancy and inaccuracy in the surveys and plans. 4. Design of areas outside the limits of the defined project site. 5. Design of gas, telephone or other utility improvements. 6. Traffic engineering reports or studies. 7. Extra Public meetings or hearings not specified in the original scope of services described in the Professional Services Agreement dated June 11, 2019. 8. Additional graphic products. 9. Additional meetings or workshops not identified in the project scope of services. 10. Permit fees, filing fees, pro -rated fees, impact fees, taxes, federal and/or state regulatory agency review fees. 11. Printing of additional drawings, specification and contract documents not identified in the project scope of services. 12. Construction staking. 13. Permit fees, filing fees, pro -rated fees, impact fees, taxes, federal and/or state regulatory agency review fees. 14. Design/coordination of existing utility relocations or modifications, unless necessitated by discrepancy and inaccuracy in the surveys and plans. 15. Extra negotiations with adjacent property owners not specified in the original scope of services within the Professional Services Agreement dated June 11, 2019, or as described below within the "Trail Width Study/Easement Acquisition and Coordination" section. 16. Additional TxDOT or regulatory agency requirements not identified in the proposed scope of services. 17. Technical reports for the following items are excluded from this scope of services: noise, air quality, community impacts, indirect impacts, and cumulative impacts, unless necessitated by the completion of the CE process. 18. Effort to obtain right -of -entry from public or private landowners to allow for the completion of environmental services is not included in this scope of work. 19. This scope of work does not include threatened or endangered species surveys of Section 7 consultation with the USFWS under the Endangered Species Act, unless necessitated by the completion of the CE process. 20. If TxDOT or a regulatory agency requires additional information other than standard information and submittals required for the completion of this project, then a supplemental services agreement will be required. Traffic Signal modifications are not included. 23. Irrigation is not included. 24. Bridge Inspection Services. 25. Geospatial Survey services. 26. Additional Geotechnical Services including additional borings, direct shear testing, triaxial testing, global stability analyses, re -mobilization, and permitting are excluded. 27. Any redesign of driveways or sidewalk crossings, including addition of driveway profiles or updating spot grades are excluded. 28. Any additional easement or ROW documents needed from any of the above revisions are excluded. 29. Design of new walls and/or revisions to previously -design walls other than Wall A and B are excluded. Page 6
