AN ORDINANCE INCREASING ESTIMATED RECElPT5 AND APPROPRIATIONS IN
THE GRANTS FUND IN THE AMOUNT OF 560.000.00, SUBJECT TO RECEIPT OF AN
EXECUTED CONTRACT AMENDMENT WITH THE TEXAS GQMMISSION ON
ENVIRONMENTAL QUALITY, FOR THE PURPOSE OF FUNDING THE OPERATION OF
OZONE MONITORING STATIONS; PROVIDING FORA SEVERABILITY CLAUSE;
MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH: AND PROVIDING AN EFFECTIVE DATE.
BE !T ORDAINED BY THE CITY COUNCIL QF THE CITY OF FORT WORTH, TEXAS:
SECTION 1
That in addition to those amounts allocated to the various City departments for Fiscal Year 2008-2409, there
shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of
$60,000.00, subject to receipt of an executed contract amendment with the Texas Commission on
Environmental Quality, for the purpose of funding the operation of ozone monitoring stations.
SECTION 2.
That should any portion, section ar part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in na way
impair the remaining portions. sections, or parts of sections of this ordinance, which said remaining
provisions sha61 be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 18283 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of sad prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Authorize Execution of Amendment No. 2 to City Secretary Contract No. 35652 in the Amount of
$60,000.00 with the Texas Commission an Environmental Quality for the Operation of Ozone Monitoring
Stations and Adop# Appropriation Ordinance
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the City Manager to execute Amendmen# No. 2 to City Secretary Contract Na. 35652 with the
Texas Commission on Environmental Quality extending the contract period through August 31, 2010, and
increasing the not to exceed amount from $120,000.00 to $180,000.00;
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Grants Fund in the amount of $60,000.04 in Fiscal Year 2009-2010, subject to receipt of an executed
contract amendment; and
3. Apply indirect cost at the rate of 21.48 percent in accordance with the terms of the Interlocal
Agreement.
DISCUSSION:
The Environmenta! Management Department operates and maintains three continuous air monitoring
stations for the Texas Commission on Environmental Quality (TCEQ}. Qne station is located in the Keller
area, another is near Annetta in Parker County and the third is located in the northwest corner of Tarrant
County. All three stations are equipped with an ozone monitor and a meteoroiogioa! tower to monitor wind
speed; wind direction and temperature. These monitors are part of the state initiative for Environmental
Monitoring far Public Access and Community Tracking of ozone air pollution in the Fort ?~larthrpa(ias area.
The TCEQ provides aIY the air monitoring equipment, parts and supplies for the proper r_,pera,ion of the air
