HomeMy WebLinkAboutOrdinance 27348-12-2024Ordinance No. 27348-12-2024 AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS OPERATING FEDERAL FUND, FROM AVAILABLE INTEREST EARNINGS IN 'VARIOUS UNITED STATES EQUAL EMPLOYMENT OPPORTUNITY COMMISSION AND FAIR HOUSING ASSISTANCE PROGRAM GRANT PROJECTS, BY (A) INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE AMOUNT OF $34,344.95 FOR THE PURPOSE OF FUNDING THE EEOC FEOA 2024 PROJECT (CITY PROJECT NO. 105921), (B) INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE AMOUNT OF $257,154.55 FOR THE PURPOSE OF FUNDING THE FHAP 2024 PROJECT (CITY PROJECT NO.105835) AND (C) DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS 1N THE AMOUNT OF $294,138.25 FOR THE PURPOSE OF USE IN FURTHERANCE OF THE CONTRACTED WORK UNDER THE CURRENT GRANTS; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the budget of the City of Fort Worth for Fiscal Year 2024-2025, as enacted by Ordinance 27107-09-2024, as amended, is hereby further amended to make the following adjustments to estimated receipts and appropriations in the Grants Operating Federal Fund, from available interest earnings in various United States Equal Employment Opportunity Commission And Fair Housing Assistance Program Grant projects, by (a) increasing estimated receipts and appropriations in the amount of $34,344.95 for the purpose of funding the EEOC FEOA 2024 project (City Project No. 105921), (b) increasing estimated receipts and appropriations in the amount of $257,154.55 for the purpose of funding the FHAP 2024 project (City Project No.105835) and (e) decreasing estimated receipts and appropriations in the amount of $294,138.25 for the purpose of use in furtherance of the contracted work under the current grants. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27107-09-2024 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Goodall Assistant City Attorney City Secretary ADOPTED AND EFFECTIVE: December 10, 20241 City of Fort Worth, Mayor and Texas Council Communication DATE: 12110/24 M&C FILE NUMBER: M&C 24-1054 LOG NAME: 08INTEREST APPROPRIATION EEOC AND HUD-2 SUBJECT (ALL) Adopt Appropriation Ordinance Adjusting Receipts and Appropriations in the Grants Operating Federal Fund, from Avaliable Interest Earnings, in Various United States Equal Employment Opportunity Commission and Department of Housing and Urban Development Grant Projects for Use in Furtherance of the Contracted Work Under the Current Grants forthe Diversity and Inclusion Department, City Project No. 105921 (EEOC) and City Project No. 105835 (HUD) RECOMMENDATION: It is recommended that the City Council adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Grants Operating Federal Fund, from available interest earnings in various United States Equal Employment Opportunity Commission and Department of Housing and Urban Development Grant projects, by (a) increasing estimated receipts and appropriations in the amount of $34,344.95 for the purpose of funding the EEOC FEPA 2024 project (City Project No. 105921), (b) increasing estimated receipts and appropriations in the amount of $257,154.55 for the purpose of funding the HUD FHAP 2024 project (City Project No 105835) and (c) decreasing estimated receipts and appropriations in the amount of $294,138.25 for the purpose of use in furtherance of the contracted work under the current grants. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to appropriate available interest earnings identified in United States Equal Employment Opportunity Commission and Department of Housing and Urban Development grants awarded to the City and move those funds to City Project No. 105921 and City Project No. 105835 to be used in furtherance of the contracted work under the current grants. EEOC Grants: City staff identified up to $38,776.68 in excess interest earnings thatwere previously appropriated in various EEOC grant projects per M&C 24- 0623. Funds in the amount of $34,344,95 will be moved and appropriated to City Project No. 105921 and staff will utilize the funds to continue the performance of work under the federal contracts and actuals in the amount of $4,431.73 will be moved to City Project No.102123 to balance and close the project. Adoption of the appropriation ordinance will further the Diversity and Inclusion Department's work under the federal work sharing agreementwith EEOC. EEOC grants are pay -for -performance, where the amount awarded is for services previously rendered. Currently, one employees salary is paid with the funds received as part of the 2024 EEOC contract and prior EEOC contracts: One (1) Human Relations Investigator totaling $65,000.00, 100% Grant Funded. If funding ends and the affected employee will not yet have performed the services for the next contract year, there may be several options to retain high -performing talent, including having the employee remain in the function through General Funds, or the employee may seek employment elsewhere, within or outside the City. HUD Grants: City staff identified up to $257,154.55 in excess interest earnings that were previously appropriated in various HUD grant projects per M&C 24- 0623. Funds will be moved and appropriated to City Project No. 105835 and staff will utilize the funds to continue the performance of work under the federal contracts. Adoption of the appropriation ordinance will further the Diversity and Inclusion Department's work under the contracts with HUD. HUD grants are awarded and reviewed yearly. Currently, two employees' salaries are paid with the funds received as part of the 2024 HUD FHAP contract and prior HUD FHAP contracts. If funding ends and the affected employees will not yet have performed the services for the next contract year, there may be several options to retain high -performing talent, including having the employee remain in the function through General Funds, or the employee may seek employment elsewhere, within or outside the City. Staff also will close out prior grants as soon as practicable following the close of each fiscal year. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION ! CERTIFICATION: The Director of Finance certifies that funds are currently available in various EEOC and HUD program grant projects within the Grants Operating Federal Fund and upon approval of the above recommendation and adoption of the attached appropriation ordinance, funds will be available in the EEOC FEPA 2024 and HUD FHAP 2024 projects .
