BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of a ten -foot wide alley, located between Lot 9-R, Block 15, Frisco Heights Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as shown in the plat thereof recorded in Volume 388-79, Page 57 of the Plat Records of Tarrant County, Texas; Lot 1- R, Block 3, Prospect Heights Addition, to the City of Fort Worth, Tarrant County, Texas, as shown in the plat thereof recorded in Volume 388-4, Page 397 of the Plat Records of Tarrant County, Texas; and Lots 10-A and 11-B, Block B, Prospect Heights Addition, to the City of Fort Worth, Tarrant County, Texas, as shown in the plat thereof recorded in Volume 388-16, Page 107 of the Plat Records of Tarrant County, Texas, and containing approximately 1,611 square Alley ROW Vacation (VA-24-021) Ordinance No. 273 3 8-12-2024 Page 1 of 2 feet or 0.037 acres of land, and as more specifically described in Exhibit A attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the easement to the land in the above -described vacated alley right-of-way is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. All existing utility easements shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. Adopt the attached ordinance vacating a portion of an alley adjacent to Block 15 Frisco Heights Addition between West Cantey Street and West Lowden Street to be replatted with the adjoining property for student housing on the Texas Christian University Campus; and 2. Waive any and all purchase fee value of the vacated land in accordance with City policy. GK Teague Nall and Perkins, on behalf of Texas Christian University (TCU), has requested vacation of this portion of an alley to be replatted with the adjoining property for student housing on the TCU Campus. The City Plan Commission recommended approval of this request at its meeting on October 9, 2024. An acceptable final plat (FS-24-271) has been received in accordance with the Subdivision Ordinance. A site plan has been included to show how the alleyway tumout will be accommodated to prevent the dead end alley created by the vacation of this portion of the alley. The City of Fort Worth (City) originally obtained the above mentioned right-of-way through plat dedication. The City does not own any fee interest in the right-of-way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easements. In accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007, Mayor and Council Communication (M&C G-15624), staff recommends waiving the fair market value or any portion thereof of purchase price of this right-of- way easement for the alley.
