BLOCK 19 PROSPECT HEIGHTS ADDITION, AN ADDITION TO THE CITY OF
FORT WORTH, TARRANT COUNTY, TEXAS ACCORDING TO THE PLAT
FILED IN VOLUME 63, PAGE 59 OF THE PLAT RECORDS OF TARRANT
COUNTY, TEXAS, AND BLOCK 20R, TCU ADDITION, AN ADDITION TO THE
CITY OF FORT WORTH, TARRANT COUNTY TEXAS, ACCORDING TO THE
PLAT FILED IN INSTRUMENT NUMBER D220018642 IN THE PLAT RECORDS
OF TARRANT COUNTY, TEXAS, AND CONTAINING APPROXIMATELY
36,100 SQUARE FEET OR 0.829 ACRES OF LAND MORE OR LESS; AND
VACATING AND EXTINGUISHING A PORTION OF A SIXTEEN -FOOT WIDE

PLAT FILED IN CABINET A, SLIDE 5473 OF THE PLAT RECORDS OF
TARRANT COUNTY, TEXAS, AND CONTAINING APPROXIMATELY 9,600
SQUARE FEET OR 0.220 ACES OF LAND MORE OR LESS; PROVIDING FOR
VACATION OF THE EASEMENTS IN THE LAND AND REVERSION TO THE
ADJACENT PROPERTY OWNER; PROVIDING THAT THE CITY SHALL
RETAIN ALL EXISTING UTILITY EASEMENTS; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of the right-of-way of Merida Avenue, a fifty -foot wide right-of-way, situated
between Block 19 Prospect Heights Addition, an addition to the City of Fort Worth, Tarrant County, Texas
according to the plat filed in Volume 63, Page 59 of the Plat Records of Tarrant County, Texas, and Block
20R, TCU Addition, an addition to the City of Fort Worth, Tarrant County, Texas according to the plat
fled in Instrument Number D220018642 of the PIat Records of Tarrant County, Texas, and containing
approximately 36,100 square feet or 0.829 acres of Iand more or less, as more specifically described in
Exhibit "A" attached hereto and incorporated herein by reference, be and the same is vacated and
extinguished.
SECTION 2.
Merida Avenue ROW and Alley Vacation (VA-24-019) Ordinance No. 27342-12-2024
That a portion of a sixteen -foot wide alley, situated between Block 19 Prospect Heights Addition,
an addition to the City of Fort Worth, Tarrant County, Texas according to the plat filed in Volume 63,
Page 59 of the Plat Records of Tarrant County, Texas, and Block 13, TCU Addition, an addition to the
City of Fort Worth, Tarrant County, Texas according to the plat filed in Cabinet A, Slide 5473 of the Plat
Records of Tarrant County, Texas, and containing approximately 9,600 square feet or 0.220 acres of land
more or less, as more specifically described in Exhibit "A" attached hereto and incorporated herein by
reference, be and the same is vacated and extinguished.
SECTION 3.
That easements to the land in the above -described vacated street right-of-way and alley are hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 4.
All existing utility easements shall be retained by the City until such time all utilities located in the
easements are relocated at the owner's expense.
SECTION 5.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 6.
That this ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating a portion of Merida Avenue between Block 19 Prospect Heights Addition and Block 20R TCU
Addition, and an alley between Block 19 Prospect Height Addition and Block 13 TCU Addition, between West Bowie Street and
West Lowden Street, to be replatted with the adjoining property for student housing on the Texas Christian University campus; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Teague Nall and Perkins, on behalf of Texas Christian University (TCU), has requested vacation of this street and alley to be replatted with the
adjoining property for student housing on the TCU Campus. The subject property is zoned "CF" Community Facilities and will retain this zoning
after the vacation of the right-of-way. The City Plan Commission recommended approval of this request at its meeting on October 9, 2024. An
acceptable final plat (FS-24-269) has been received in accordance with the Subdivision Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned rights -of -way through plat dedication. The City does not own any fee interest
in the rights -of -way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easements. In
accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007, Mayor and
Council Communication (M&C G-15624), staff recommends waiving the fair market value or any portion thereof of purchase price of this right-of-
way easement for the street and alley.
This project is located in COUNCIL DISTRICT 9.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
