AN ORDINANCE VACATING AND EXTINGUISHING A PUBLIC
ACCESS EASEMENT SITUATED IN THE JOHN VAN LENT SURVEY,
ABSTRACT NO. 1871, IN THE CITY OF FORT WORTH, TARRANT
COUNTY, TEXAS, BEING A PORTION OF LOT 11, BLOCK 13,
SUMMER CREEK STATION, AN ADDITION TO THE CITY OF FORT
WORTH, TARRANT COUNTY, TEXAS, ACCORDING TO THE PLAT
RECORDED IN INSTRUMENT NO. D218196478 OF THE OFFICIAL
PUBLIC RECORDS OF TARRANT COUNTY, TEXAS, SAID TRACT
BEING ALL OF A TEMPORARY TURNAROUND EASEMENT
RECORDED IN INSTRUMENT NO. D215212129 OF THE OFFICIAL
PUBLIC RECORDS OF TARRANT COUNTY, TEXAS AND
CONTAINING APPROXIMATELY 7,113 SQUARE FEET OR 0.1633
ACRES OF LAND MORE OR LESS; PROVIDING FOR VACATION OF
THE EASEMENTS IN THE LAND AND REVERSION TO THE
ADJACENT PROPERTY OWNER; PROVIDING THAT THE CITY
SHALL RETAIN ALL EXISTING UTILITY EASEMENTS; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a public access easement, situated in the John Van Lent Survey, Abstract No. 1871
in the City of Fort Worth, Tarrant County, Texas, being a portion of Lot 11, Block 13, Summer
Creek Station, an addition to the City of Fort Worth, Tarrant County, Texas, according to the plat
recorded in Instrument No. D218196478 of the Official Public Records, Tarrant County, Texas,
said tract being all of a temporary turnaround easement recorded in Instrument No. D215212129
of the Official Public Records of Tarrant County, Texas, and containing approximately 7,113
square feet or 0.1633 acres of land more or less, as more specifically described in Exhibit "A"
attached hereto and incorporated herein by reference, be and the same is vacated and
extinguished.

Summer Creek Station Public Access Easement Vacation (VA-24-025) Ordinance No. 27343-12-2024

That easements to the land in the above -described vacated public access easement are
hereby released and shall revert to the adjacent owner as provided by law.
SECTION 3.
All existing utility easements shall be retained by the City until such time all utilities
located in the easements are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

EASEMENT ABANDONMENT
BEING a 0.1633 acre (7,113 square foot) tract of land situated in the John Van Lent Survey, Abstract No. 1871, City
of Fort Worth, Tarrant County, Texas; said tract being part of Lot 11, Block 13, Summer Creek Station, an addition to
the City of Fort Worth according to the plat recorded in Instrument No. D218196478 of the Official Public Records of
Tarrant County, Texas; said tract also being all of a public access easement recorded in Instrument No. D215212129
of said Official Public Records; said tract being more particularly described as follows:
COMMENCING at a "X" cut found at the northeast corner of said Lot 11;
THENCE South 22025'44" East, along the east line of said Lot 11, a distance of 152.32 feet to a 1/2-inch iron rod
found at the east corner of said Lot 11;
THENCE South 58039'57" West, departing the said east line of Lot 11, a distance of 17.21 feet to the POINT
OF BEGINNING; said point being the beginning of a non -tangent curve to the left;
THENCE in a northwesterly direction, with said non -tangent curve to the left, having a radius of 20.00 feet, a central
angle of 40048'44", and a chord bearing and distance of North 84°15'03" West, 13.95 feet to a point for corner at the
beginning of a non -tangent curve to the right;
THENCE in a northerly direction, with said non -tangent curve to the right, having a radius of 65.00 feet, a central
angle of 175017'08", and a chord bearing and distance of North 16°59'52" West, 129.89 feet to a point for corner;
THENCE South 22025'44" East, a distance of 135.89 feet to the POINT OF BEGINNING and containing 7,113

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating a public access easement in Lot 11, Block 13 Summer Creek Station Addition to be replatted with
the adjoining property for a commercial development; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Kimley-Hom, on behalf of Skylar Long, has requested vacation of this public access easement to be replatted with the adjoining property for a
commercial development on Lot 11, Block 13 Summer Creek Station Addition. The public access easement was dedicated as a temporary
turnaround for traffic. In connection with the development of the property as a commercial development, a new public access easement connecting
the two adjacent lots will be dedicated. The City Plan Commission recommended approval of this request at its meeting on November 15, 2024.
An acceptable final plat (FS-24-090) has been received in accordance with the Subdivision Ordinance.
The public access easement proposed to be abandoned was dedicated a to the City of Fort Worth by separate instrument (Instrument No.
D215212129). The City does not own any fee interest in the public access easement or own any property adjacent to the public access easement,
and did not expend any City funds to purchase the public access easement. In accordance with the City's policy regarding street and alley vacation
transactions approved by the City Council on March 6, 2007, Mayor and Council Communication (M&C G-15624), staff recommends waiving the
fair market value or any portion thereof of purchase price of this easement.
This project is located in COUNCIL DISTRICT 6.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
FISCAL INFO MATION CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
