AN ORDINANCE VACATING AND EXTINGUISHING EXCESS PORTIONS OF
EAST ALTAMESA BLVD RIGHT OF WAY SITUATED IN THE SHELBY
COUNTY SCHOOL LAND SURVEY, ABSTRACT NUMBER 1375, A PORTION
BEING IN THE NIGHT TRAIN COMPRESSOR SITE, AN ADDITION TO THE
CITY OF FORT WORTH ACCORDING TO THE PLAT THEREROF
RECORDED IN DOCUMENT NUMBER D212014810 IN THE PLAT RECORDS
OF TARRANT COUNTY, TEXAS, CONTAINING APPROXIMATELY 18,229
SQAURE FEET OR 0.418 ACRES OF LAND, AND TWO PORTIONS OF A
CERTAIN TRACT OF LAND DESCRIBED BY DEED TO THE CITY OF FORT
WORTH AS RECORDED IN VOLUME 10038, PAGE 745, DEED RECORDS,
TARRANT COUNTY, TEXAS, CONTAINING APPROXIMATELY 13,487
SQUARE FEET OR 0.309 ACRES OF LAND, AND 10,728 SQUARE FEET OR
0.246 ACRES OF LAND, RESPECTIVELY; PROVIDING THAT THE CITY
SHALL RETAIN ALL EXISTING UTILITY EASEMENTS; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of East Altamesa Boulevard, a one hundred ten foot wide public right of way,
situated in the Shelby County School Survey, Abstract Number 1375, in the Night Train Compressor Site,
an addition to the City of Fort Worth, Tarrant County, Texas, according to the plat thereof, recorded in
Document Number D212014810 of the Plat Records of Tarrant County, Texas, and containing
approximately 18,229 square feet, or 0.418 acres of land, and as more specifically described in Exhibit "A"
attached hereto and incorporated herein by reference, be and the same is vacated and extinguished.
SECTION 2.
That a portion of East Altamesa Boulevard, a one hundred twenty foot wide public right of way,
situated in Blocks 13 and 16, SheIby County School Land Survey, Abstract No. 1375, in the City of Fort
Worth, Tarrant County, Texas, and being a portion of a certain tract of land described by deed to the City
of Fort Worth as recorded in Volume 10038, Page 745, Deed Records, Tarrant County, Texas, and
containing approximately 13,487 square feet, or 0.309 acres of land, and as more specifically described in
Exhibit "A" attached hereto and incorporated herein by reference, be and the same is vacated and
extinguished.

Portions of East Altamesa Boulevard Excess ROW Vacation (VA-24-007)

That a portion of East Altamesa Boulevard, a one hundred twenty foot wide public right of way,
situated in Blocks 13 and 16, Shelby County School Land Survey, Abstract No. 1375, in the City of Fort
Worth, Tarrant County, Texas, and being a portion of a certain tract of land described by deed to the City
of Fort Worth as recorded in Volume 10038, Page 745, Deed Records, Tarrant County, Texas, and
containing approximately 10,728 square feet, or 0.246 acres of land, and as more specifically described in
Exhibit "A" attached hereto and incorporated herein by reference, be and the same is vacated and
extinguished.
SECTION 4.
That the easements to the land in the above -described vacated street right of way are hereby
released and shall revert to the adjacent owner as provided by law.
SECTION S.
All existing utility easements be shall be retained by the City until such time all utilities located in
the easements are relocated at the owner's expense.
SECTION 6.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 7.
That this ordinance shall take effect upon adoption.

PROPERTY DESCRIPTION
BEING a tract of land situated in Block 13, Shelby County School Land Survey, Abstract 1375, City
of Fort Worth, Tarrant County, Texas, being a portion of E. Altamesa Blvd. (110' width right—of—way),
dedicated by Night Train Compressor Site, cn Addition to the City of Fort Worth, according to the
plat recorded in County Clerk's Document No. 212014810, Plat Records, Tarrant County, Texas, said
tract of land being more particularly described by metes and bounds as follows:
COMMENCING at a found concrete monument for the northwest corner of Lot 2, Block 1, of said
Night Train Compressor Site, the southwest corner of a certain tract of Icnd described in deed to IV5
Frontier Commerce Park LP., as recorded in County Clerk's Document No. 223048440, Deed Records,
Tarrant County, Texas, and being in a easterly line of that certain tract of land described by deed to
Texas Electric Service Company, recorded in Volume 2574, Page 545, Deed Records, Tarrant County,
Texas;
North 61'35'25" East, with the north line of said Lot 2, Block 1, Night Train Compressor Site
and the south line of said IV5 Frontier Park LP., a distance of 449.07 feet to a point for the
northwest corner of said F. Altamesa Blvd. right—of—way, the northeast corner of said Lot 2,

BEGINNING at a point in the south line of Block 1, Night Train Compressor Site, an Addition to the City of Fort Worth, according
to the plat recorded in County Clerk's Document No. 0212014810, Plat Records, Tarrant County, Texas, the northeast corner of a
certain tract of land described by deed as Tract 2 to IV5 Frontier Commerce Park LP., as recorded in County Clerk's Document
No. D223204077, Deed Records, Tarrant County Texas, and being the northwest corner of said City of Fort Worth tract;
THENCE North 61'34'06" East, with the west line of said City of Fort Worth tract, and the south line of said Block 1, Night Train
Compressor Site, a distance of 25.81 feet to a point in the west line of said City of Fort Worth tract for the beginning of a
non—tongent curve to the left, having a central angle of 15'08'14", a radius of 1,440.00 feet and a chord bearing and distance of

Code and the Reversionary Clause in the Deed for an Industrial Warehouse Development
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating portions of excess right-of-way along East Altamesa Boulevard to be replatted with the adjoining
property for an industrial warehouse development;
2.1n accordance with City policy, waive the purchase price for the vacation of the right-of-way;
3. Authorize conveyance of approximately 0.555 acres of Altamesa Boulevard located northwest of its intersection with Wichita Street to the
adjoining property owner, IV5 Frontier Commerce Park LP in accordance with Section 272.001(b)(2) of the Texas Local Government Code and
the revisionary clause in the deed; and
4. Authorize the City Manager or his designee to execute and record the appropriate instruments to complete the vacation of the right-of-way and
the conveyance of the property.
DISCUSSION:
Dunaway and Associates, on behalf of IV5 Frontier Commerce Park LP, has requested vacation of three portions of excess right-of-way to be
replatted with the adjoining property for an industrial warehouse development. The City Plan Commission recommended approval of this request
at its meeting on April 24, 2024. An acceptable final plat (FP-24-129) has been received in accordance with the Subdivision Ordinance.
The City of Fort Worth (City) originally obtained one portion of the subject right-of-way through plat dedication. The City does not own any fee
interest in this right-of-way or own any property adjacent to the right-of-way and did not expend any City funds to obtain the right-of-way. In
accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007, Mayor and
Council Communication (M&C) G-15624, staff recommends waiving the purchase price for this portion of right-of-way that is to be vacated and
released to the adjacent property owner.
The City obtained the remaining two portions of this right-of-way through a deed recorded in Volume 10038, Page 745 Deed Records Tarrant
County, Texas (Instrument Number D190151064). Based upon a review of the City's records it appears that the consideration paid for the 1.869
acres that was dedicated to the City was $10.00. These two portions of right-of-way total 0.555 acres. While not specifically addressed in the
City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007, Mayor and Council Communication
(M&C) G-15624, waiver of the purchase price is in line with the intent and purpose of the policy. Additionally, per the terms of the deed, fee title to
the 1.869 acres automatically reverts to the grantor, or their successors and assigns, upon platting of the property and dedication street right-of-
way in connection with the plat. An acceptable final plat has been received by the City. Therefore, staff recommends waiving the fair market value
or any portion thereof of purchase price of this right-of-way easement for the street. According to Section 272.001(b)92) of the Local Govemment
Code, streets or alleys owned in fee may be conveyed to an adjacent property owner without notice and bidding.
By approval of this M&C, the City Council authorizes the execution and recording of the appropriate instruments to convey this property to the
adjacent property owner, IV5 Frontier Commerce Park LP.
This project is located in COUNCIL DISTRICT 8.
