Ordinance No. 27380-12-2024 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE PARD DEDICATION FEES FUND, IN THE AMOUNT OF $5,544,198.01, FROM DEVELOPER CASH CONTRIBUTIONS IN UN8214, UN8217, UN8231 AND UN8233, FOR THE PURPOSE OF FUNDING THE PARD NEW ENHANCEMENTS PROGRAMMABLE PROJECT (CITY PROJECT NO. P00132); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2024-2025 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the PARR Dedication Fees Fund in the amount of $5,544,198.01, from developer cash contributions in UN8214, UN8217, UN8231 and UN8233, for the purpose of funding the PARR New Enhancements programmable project (City Project No. P00132). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27107-09-2024 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the acquisition of a fee simple interest in approximately 298.189 acres of land located at 3150 and 3450 Tinsley Lane, Fort Worth, Tarrant County, Texas 76179 from Tinsley-Alliston Ranch Lands, L.P., Tinsley-Alliston Homestead, L.P., and the Ruby Lea Alliston Revocable Trust in the amount of $13,418,505.00 and pay estimated closing costs in an amount up to $205,000.00; 2. Authorize the City Manager or designee to accept the conveyance, to execute the necessary contract of sale and purchase, and to execute and record the appropriate instruments; 3. Authorize a loan repayment increasing estimated receipts in Park Planning District 2 Unspecifieds, Community Park 20 and 25 (UN8220 and UN8225) and Park Planning District 5 Unspecifieds, Community Park 16 and 17 (UN8216 and UN8217) in the amount of $2,978,217.00 and decrease the same amount from receipts from Park Planning District 1 Unspecifieds, Community Park 1, 2, 3 and 4, (UN8201, UN8202, UN8203, and UN8204); 4. Authorize a transfer increasing estimated receipts in the PARD New Enhancements Programmable Project in the amount of $8,079,306.99 from Park Planning District 5, Community Park 16 and 17, (UN8216 and UN8217); 5. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the PARD Dedication Fees Fund, in the amount of $5,544,198.01 from developer cash contributions in UN8214, UN8217, UN8231 and UNS233 for the purpose of funding the PARD New Enhancements Programmable Project (City Project No. P00132); 6. Dedicate the property as parkland to be known as Tinsley Ranch Park; and 7. Amend the Fiscal Years 2025-2029 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to seek approval to acquire land located at 3150 and 3450 Tinsley Lane, Fort Worth, Tarrant County, Texas 76179 in an acquisition for the Park & Recreation Department (PARD) in accordance with the Neighborhood and Community Park Dedication Policy and the Park, Recreation and Open Space Master Plan, which calls for the provision of adequate park and recreational areas in the form of Neighborhood -Based Parks and Community -Based Parks. The Park & Recreation Department (PARD) conducted an assessment of potential properties in Fort Worth for parkland acquisition. The proposed 298.189-acre property is located in the ETJ near Council District 10 and adjacent to Park Planning District 5, which is under -served in community -based parkland. Tinsley-Alliston Ranch Lands, L.P., Tinsley-Alliston Homestead, L.P., and the Ruby Lea Alliston Revocable Trust (Seller) has agreed to sell the property for a total purchase price of $13,418,606.00. An independent appraisal supports the purchase price. The mineral estate will not be acquired, and the deed will contain a surface use waiver for the exploration of the mineral estate. The real estate taxes will be pro -rated, and the Seller will be responsible for taxes up to the closing date. The City will pay closing costs in an amount up to $205,000.00. Partial funding for this land acquisition comes from loan repayments from Park Planning District 1 (South Fort Worth). On September 14, 2021, M&C 21-0672 appropriated funds from Park Planning District 2 ($496,101.00) to acquire land for Rock Creek Ranch park. On June 28, 2022, M&C 22-0515 appropriated funds from Park Planning District 5 ($2,482,116.00) to acquire land for the expansion of Rock Creek Ranch park. Recommendation 3 of this M&C will repay those borrowed funds. Funding for this project was not included in the FY2025-2029 Capital Improvement Program due to the unpredictability of parkland acquisitions. The action in this M&C will amend the FY2025-2029 Capital Improvement Program as approved in connection with Ordinance 27107-09-2024. This acquisition is estimated to increase the department's acreage by 298.189 acres, more or less, and annual maintenance by $7,398.00. Funding is budgeted in the PARD Dedication Fees Fund and the General Fund for the Park & Recreation Department forthe purpose of funding the Tinsley Acquisition project. This property is located in the ETJ near COUNCIL DISTRICT 10. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL_ INFORMATION I CERTIFICATION: The Director of Finance certifies that funds are currently available in the Community Park 14, 16, 17, 35, and 37 projects within the PARD Dedication Fees Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the PARD Dedication Fees Fund for the Tinsley Acquisition project to support the approval of the above recommendations and acquisition of land. Prior to an expenditure being incurred, the Park & Recreation Department has the responsibility of verifying the availability of funds.
