Subject: ACQUISITION OF TEMPORARY CONSTRUCTION EASEMENTS FOR
SANITARY SEWER REHABILITATION M-146
In April 1992, the Environmental Protection Agency (EPA) issued an order
to the City to eliminate overflows in the City's sanitary sewer
collection system. A phased action plan has been developed to bring the
City into compliance with the EPA order. Sanitary Sewer M-146 with its
laterals are included in the EPA order with a scheduled completion date
of May 30, 1994.
The Monticello Drive/Hamilton Avenue area (Council District 7) is one of
the City's areas experiencing inflow/infiltration problems during wet
weather which result in manhole overflows and flooded homes. The City's
sewer line serving this older area is located in an eight-foot permanent
easement. Temporary construction easements are needed to provide working
space to rehabilitate the line. (Current design practice is to require
wider permanent easements so as to provide more working space for sewer
repair and rehabilitation. ) Due to the need for early completion of this
I project, homeowners were offered twenty-five percent (255) of the fee
low value of their land for temporary construction easements rather than the
usual payment of ten percent (10%) where dedication is not obtained from
the property owner. The higher compensation was offered as an incentive
to the owner(s) to reach agreement with the City so as to avoid lengthy
eminent domain proceedings. As of this date, agreement on eleven (11) of
the fourteen easements have been obtained; three others may require
eminent domain proceedings. The estimated total cost for the fourteen
easements is $29,600.00.
The purpose of this report is to advise the City Council of the
rationale for higher than normal payments for temporary construction
easements with regard to this particular project. The M&C for Council
authorization of securing these easemUentswi llow in two or three
weeks.
