HomeMy WebLinkAboutOrdinance 15427Ordinance No. f ~ T Z~ AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $665,405.00, SUBJECT TO RECEIPT OF A GRANT FROM THE TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS (TDHCA), FOR THE PURPOSE OF FUNDING THE FISCAL YEAR 2003 COMPREHENSIVE ENERGY ASSISTANCE PROGRAM; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2002- 2003 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $665,405.00, subject to receipt of a grant from the Texas Department of Housing and Community Affairs (TDHCA), for the purpose of funding the fiscal year 2003 Comprehensive Energy Assistance Program. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 15184 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. ENERGY ASSISTANCE PROGRAM-THROUGH .DECEMBER 31, °2003 -AND ADOPTION OF RELATED.APPROPRIATION ORDINANCE RECOMMENDATION: It is recommended that the City Council: 1. Authorize the City Manager to accept a grant from the Texas Department of Housing and Community Affairs (TDHCA) in the amount of $665,405; and 2. Authorize anon-interest bearing inter-fund loan from the General Fund to the Grants Fund in the `amount of $166,351 for interim financing of this grant project pending contract execution; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the grants fund by $665,405; and 4. Apply indirect costs at a rate of 26.19%, which is the most recently approved rate for this department, and apply the new, approved rate when available. DISCUSSION: The City has been notified by the TDHCA to use the original Fiscal Year (FY) 2002 contract amount, $665,405, as a planning figure for the FY2003 Comprehensive Energy Assistance Program (CEAP). The TDHCA will reimburse the City for its expenses after the contract is executed. The CEAP for contract year 2003 has six components: • Energy Crisis; and • Elderly/Disabled Assistance; and • Co-Payment Assistance; and • Heating and Cooling Systems; and • ..Direct Service Support; and ' • Case Management. All households at or below 125% of the Federal Poverty Level will be afforded access to the program.. Alf applicant households will be determined eligible according to -income guidelines and program procedures. The benefit determinations include the household's income, the household size, the energy consumption and/or the vulnerability of the household, -and the availability of funds. The Parks and Community Services Department will review all applications at the .nine City-operated Neighborhood Resources Development Program Center facilities. Payments will be made for eligible clients directly to the utility vendors' and heating and cooling systems repair .companies of Tarrant County. THROUGH DECEMBER 31, :.2003-..AND ADOPTION OF RELATED APPROPRIATION ORDINANCE The administrative cost for FY2003 is restricted to a rate of 10%, Case Management to a rate of 6% and Direct Services Support to a rate of 5%. The remaining funds will be used for .Energy Crisis, Elderly/Disabled Assistance, Co-Payment Assistance and Heating and Cooling Systems for the duration of the contract. This program is located in ALL COUNCIL DISTRICTS. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds .will be available in the current operating budget, as appropriated, of the Grants Fund.: Upon. execution of the grant contract, the interim inter-fund loan will be returned to the General Fund.
