INF&MAL REPORT TO CITY COUNCIL MEMBERS No. 7657 November 5, 1992 Jk T I Revised 11/09/92 VOJO To the Mayor and Members of the City Council X Subject: 'S'3 BENEFIT HEARING FOR THE PAVING OF SCHWARTZ AVENUE FROM 28TH STREET TO LONG AVENUE On October 27 , 1992, at the benefit hearing for the assessment paving of Schwartz Street from 28th Street to Long Avenue, Mr. Doyle Harrell and Mr. Chris L. Stewart appeared to request reduction of the assessments against property owned by Mr. Harrell, specifically, Lots 10 through 14 and Lot A, Block 6, J. M. Moody Subdivision. One of the properties owned by Mr. Harrell (Lot 10 , Block 6, J. M. Moody Subdivision) is a corner lot which has previously been assessed for the paving of Lorraine Street. The appraiser has advised staff that the enhancement to a corner lot is not cumulative for the paving of both adjoining streets; therefore the assessment against this lot is being reduced from $2 ,000.00 to -0- . This property is therefore excluded from the following discussion. The specific points raised with regard to the remainder of Mr. Harrell 's properties are as follows: 1 . Mr. Stewart stated that four of the lots are residential but are being assessed as commercial property. The assessment roll shows Lots 11 through 14 as having C zoning. Lot 14 is zoned CF, Community Facilities , which permits public facilities of all types including churches, post offices, health services , schools , etc . Lots 11 through 13 are zoned C-R Multi-Family, which permits multi-family dwelling units in accordance with Unified Residential Development provisions . As the roll indicates, the property at the corner of Schwartz and 28th Street is zoned E, which permits commercial buildings such as retail stores, banks, restaurants, and retail sales with gasoline sales . The Assessment Paving Policy provides differential treatment based on zoning only for A (one-family) and B (two-family) residential zoning. Mr. Harrell stated that the TAD valuations listed for these properties are incorrect. The valuations which staff obtained from the Tarrant Appraisal District amounted to $4, 000. 00 each for the four lots fronting on Schwartz and $81,323 .00 for the property at the corner of Schwartz and 28th Street. In response to Mr. Harrell's statements, staff researched the records and found that the information obtained on July 6, 1992, included a valuation of $25,323. 00 for a building on the corner lot which is no longer in existence. The roll has been amended accordingly to reflect only the land value of $56,000.00 . The total value of these properties is therefore $72,000 .00; forty percent of this amount is $28,800.00, which exceeds the total proposed assessment of $16,000 .00. 3. Council questioned the method of application of the forty percent cap for assessments on non-residential property in CDBG Target areas. The basis for the property ownership and property value data is the records of the Tarrant Appraisal District. Properties are listed on the TAD rolls in various ways: If there are several lots under one ownership, they may be listed separately or they may be grouped into one tax account. Because assessment billings are done by the TAD tax account number (called the SKEY number) , properties are listed on the paving rolls in the same manner as these SKEY numbers are assigned. Where several lots are grouped together on the TAD rolls, only one value is listed, even though some of the lots may be vacant and some may have structures . An example of a multiple-lot listing is Property #2 on the Schwartz assessment roll. The Stockyards Masonic Lodge owns lots 7, 8, 9, and 10 of Block 60, W. A. Archer Addition. In order to give consistent treatment to owners of multiple properties with regard to paving assessments, since it is not possible to separate the valuations for properties grouped in the TAD listings, staff has elected to consolidate the valuations for the computation of assessment caps where properties are listed individually by TAD. With regard to the specific properties on Schwartz Street owned by Mr. Harrell, the existing zoning would preclude the construction of E zoning facilities on all five lots; therefore, a case can be made for dealing with the E-zoned lot separately from the remaining properties. Treated separately, the four lots would have a total value of $16,000 .00; the forty-percent cap would therefore be $6,400 .00, resulting in a $1,600 . 00 reduction in the assessment for the five northern lots . The remaining lot, valued at $56,000 . 00, is assessed at the enhancement amount of $8,000. 00, and this amount would not change. The total assessment against Mr. Harrell 's properties would be reduced from $16,000 . 00 to $14 , 400 .00. On the other hand, since the property is vacant and already has a variety of commercial zoning, it may be just as reasonable to consolidate the values of all of the properties . According to the owner, he is, in fact, currently marketing all of the properties as one commercial site. Four of the properties in question are shown on the TAD records as belonging to Doyle Ford Harrell; the owner of the fifth is listed as Doyle Ford Harrell Living Trust. The mailing address for all properties is the same, and they have been treated as being under one ownership. OFFICIAL RECORD 4 . Mr. Stewart presented Council a written opinion regarding the enhancement to the properties to be derived from the paving. The appraiser, Robert Martin, will be available at the Council meeting to address this issue. One other lot on Schwartz Street was previously assessed for the paving of Lorraine; in compliance with the appraiser's ruling, the assessment against Lot 7 , Block 60, W. A. Archer Addition, owned by the Stockyards Masonic Lodge, is being reduced from $8, 000 .00 to $4 ,500 .00. A revised roll reflecting the changes outlined above has been prepared; staff recommends that the hearing be closed and the assessments levied in accordance with the revised roll . Should Council require any additional information, it will be provided upon request. Under this policy assessments cannot exceed: (a) The computed rate. (b) The enhancement to the property. opk (c) For residential property; twenty percent (20%) of the property values as determined by the Tarrant Appraisal District. (d) For commercial property located within a target area; forty percent (40%) of the property values as determined by the Tarrant Appraisal District. All replacement of sidewalks is at 50% cost to the property owner and 50% cost to the city. NOTES (1) Curb inlet credit. (2) TA413 - Traffic Approval dated August 12, 1986. 100% credit given for replacement of driveway approach and curb. (3) Tax-exempt places of worship are assessed at 50% of the residential rate: $23.44 @ 50% = $11.72 for pavement $ 1.98 @ 50% = $ .99 for curb (4) Properties #6 thru #11 are owned by the same person. The full assessment rate is applied to residential frontage exceeding 200 feet under single ownership.
