HomeMy WebLinkAboutOrdinance 15432oRDINANCE N®.. /~ ~t~~-- AN ORDINANCE VACATING AND EXTINGUISHING A 40-FOOT WIDE PORTION OF '100 BLOCK OF WEST TERRELL AVENUE AS RECORDED IN TERRELL'S ADDITION, FORT WORTH, TARRANT COUNTY, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION ~ . That a 40-foot wide portion of 100 block of West Terrell Avenue right-of- way in Terrell's Addition, and as recorded in Volume 63, Page 155, Plat Records, Tarrant County, Texas, and containing 0.0762 acres of land and as more specifically described in Exhibit A attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the fee to the land in the above described vacated street right-of-way is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect upon adoption. TERI2ELI., AVENUE BEING a portion of West Terrell Avenue and being a 0.0762 acre tract of land out of the Terrell's Subdivision to the City of Fort Worth, Tarrant County, Texas according to the plat recorded in Volume 63, Page 155, Plat Records of Tarrant County, Texas and being more particularly described as follows: BEGINNING at a 5/8" iron rod found being the northwest corner of Lot 43 of said Terrell's Subdivision, said iron rod also being in the existing south right-of--way line of said West Terrell Avenue (40.0' R.O.W.) and also being in the most westerly east line of Lot 1-R, Fields Welch Addition according to the plat recorded in Volume 388-78, Page 50, P.R.T.C.T.; THENCE, North 00 degrees 02 minutes 18 seconds West, along the east line of said Lot 1-R, Fields Welch Addition, 40.00 feet to a 5/8" iron rod found for corner; THENCE, North 89 degrees 57 minutes 42 seconds East, along the existing north right- of-way line of said West Terrell Avenue and along the most northerly south line of said Lot 1-R, 74.40 feet to a 5/8" iron rod found for corner being in the existing west right-of- way line of College Avenue (80.0' R.O.W.) and being the begilming of anon-tangent curve to the left with a radius of 40.00 feet and a long chord bearing South 45 degrees 02 minutes 18 seconds East, 56.57 feet; THENCE, along said curve to the left, passing through a central angle of 90 degrees 00 minutes 00 seconds an arc length of 62.83 feet to an iron rod for corner, said iron rod being in the existing south right-of--way line of said West Terrell Avenue and the north line of Lot 42 of said Terrell's Subdivision; THENCE, South 89 57 minutes 42 seconds West, along the existing south right-of--way line of said West Terrell Avenue, 114.40 feet to the 1'OIN'I' OF BEGINNING. EXHIBIT ~~ 6~~ City o, f ' .~'oa~t T~'oa~th, ~'exa~ ® Y1 DATE REFERENCE NUMBER LOG NAME PAGE 2/4/03 f~Z-2454 06VA-01-024 1 of 1 SUBJECT STREET VACATION: PORTION OF THE 100 BLOCK OF WEST TERRELL AVENUE, TERRELL'S SUBDIVISION, FORT WORTH, TEXAS (VA-01-024) RECOMMENDATION: It is recommended that the City Council adopt the attached ordinance vacating a 40-foot wide portion of the 100 block of West Terrell Avenue, Terrell's Subdivision, according to the plat recorded in Volume 63, Page 155, Plat Records of Tarrant County, Texas and containing 0.0762 acres of land. DISCUSSION: The Fort Worth Independent School District, owner of adjacent properties, has requested vacation of the above referenced portion of West Terrell Avenue to expand the yard area. There are no known utilities in the said portion of West Terrell Avenue. The City Plan Commission recommended approval at it's Public Hearing on May 23, 2002. The Engineering Department, Real Property Services Division states that a fee of $1.00 will satisfy the public interest. The reviewing City departments and public utility companies have raised no objections to this request. An acceptable replat has been provided (FS-01-1019). This request is located in COUNCIL DISTRICT 9. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that this action will have no material effect on City funds.
