AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN
THE WATER CAPITAL PROJECT FUND IN THE AMOUNT OF $134,720.00 AND THE
SEWER CAPITAL PROJECT FUND IN THE AMOUNT OF $89,158.00 FROM AVAILABLE
FUNDS FOR THE PURPOSE OF FUNDING A CONTRACT WITH MCLENDON
CONSTRUCTION COMPANY, INC. FOR ALTERNATE "A" (ASPHALT PAVEMENT) FOR
THE RECONSTRUCTION OF FOARD STREET (EAST SEMINARY DRIVE TO NORTH
DEAD END), BROOKLINE AVENUE (TRENTMAN DRIVE TO ALGERITA STREET) AND
ALGERITA STREET (TRENTMAN DRIVE TO MILLER AVENUE) INCLUDING WATER
AND SANITARY SEWER MAIN REPLACEMENTS; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2002-2003 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Water Capital Project Fund in the amount of $134,720.00 and the Sewer Capital Project Fund in the amount
of $89,158.00 from available funds for the purpose of funding a contract with Mclendon Construction
Company, Inc. For Alternate "A" (asphalt pavement) for the reconstruction of Foard Street (East Seminary
Drive to north dead end), Brookline Avenue (Trentman Drive to Algerita Street) and Algerita Street
(Trentman Drive to Miller Avenue) including water and sanitary sewer main replacements.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall. in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 15184 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

' AVENUE) INCLUDING-WATER AND SANITARY SEWER MAIN REPLACEMENTS
RECOMMENDATION:
It is .recommended that the_City Council:
1. Authorize the transfer ofr$223,878.00 from the Water and Sewer Operating Fund to the Water
Capital Project Fund in the amount of $134,720.00; and the Sewer Capital Project Fund in the
amount of $89,158.00; and
2. Adopt the attached appropriation ordinance. increasing .estimated receipts and .appropriations. in the
Water Capital Project Fund in the amount of $134,720.00, and the Sewer Capital Project Fund in
the amount of $89,158.00. from available funds; and
3. Authorize the City Manager to execute a contract with McClendon Construction Company, Inc. for
Alternate "A" (asphalt pavement) in the amount of $560,537.00 for the reconstruction of Foard Street (East
Seminary Drive to north dead end), Brookline Avenue (Trentman Drive to Algerita Street), and Algerita
Street (Trentman Drive to Miller Avenue) including water and sanitary sewer main replacements.
DISCUSSION:.
On December 19, 2000, the City Council adopted a resolution authorizing the issuance of $45 million in
Certificates of Obligation to address critical capital projects that included $8 million for the reconstruction of
neighborhood streets to supplement the 1998 Capital Improvement Program. This project includes funds for
the reconstruction of Foard Street (East Seminary Drive to north dead end), Brookline Avenue (Trentman
Drive to Algerita Street), and Algerita Street (Trentman Drive to Miler Avenue). The street improvements
include 6-inch lime stabilized subgrade and asphalt pavement, construction of standard concrete curb and
gutter and driveway approaches and sidewalks, where shown on the plans.
The Water Department had determined that the water and sanitary mains should be replaced prior to
the street reconstruction.
BID ADVERTISEMENT -This project was advertised for bid on October 24 and 31, 2002. On
November 14, 2002, the following bids were received:

Time of completion is 160 working days.
M/WBE -McClendon Construction Company, Inc. is in compliance with the City's M/WBE Ordinance
by committing to 14% M/V1/BE participation and documenting good faith effort. McClendon Construction
Company, Inc. identified several subcontracting and supplier opportunities. However, the. M/V1IBEs
contacted in the areas identified did not submit the lowest bids. The City's goal on .this project is 28%.
This project is located in COUNCIL DISTRICTS 5 and 8, Mapsco 92K, L, and M.
In addition to construction costs, a $9,995.00 contingency (water: $6,015.00, sewer: $3,980.00) is
required for possible change orders and $13,993.00 (water: $8,420.00, sewer: $5,573.00) is required
for inspection and survey. Contingencies in the amount of $18,033.00 are required for possible change
orders associated with street construction. ,
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon approval: of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the current capital budgets, as appropriated,
of the Water and Sewer Capital Project Funds and the Critical Capital Projects Fund.
