HomeMy WebLinkAboutOrdinance 27417-01-2025Ordinance No.27417-01-2025 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE MUNI AIRPORT GRANTS FEDERAL FUND IN AN AMOUNT UP TO (1) $687,000.00, SUBJECT TO THE RECEIPT OF THE GRANT, AND (2) $36,158.00 AS A TRANSFER FROM THE MUNICIPAL AIRPORT CAPITAL PROD FUND TO SATISFY THE CITY'S MATCH REQUIREMENT, TOTALING $723,158.00, FOR THE PURPOSE OF FUNDING A VEHICLE SERVICE ROAD, DRAINAGE IMPROVEMENTS PROJECT, REHABILITATION OF TAXILANE IGLO AND HANGAR DEVELOPMENT AT FORT WORTH SPINKS AIRPORT; PROVIDING FOR A SEVERABILITY CLAUSE; MAI{ING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2024- 2025 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations intheMuni Airport Grants Federal Fund in an amount up to (1) $687,000.00, subject to the receipt of the grant, and (2) $36,158.00 as a transfer from the Municipal Airport Capital Proj Fund to satisfy the City's match requirement, totaling $723,158.00, for the purpose of funding a vehicle service road, drainage improvements project, rehabilitation of Taxilane Kilo and hangar development at Fort Worth Spinks Airport. SECTION 2. That should any portion, section or partof a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall'be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27107-09-2024 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the application for and acceptance of the Bipartisan Infrastructure Investment and Jobs Act Fiscal Year 2025 Airport Infrastructure Grant, if awarded, from the Federal Aviation Administration passed through the Texas Department of Transportation in an amount up to $687,000.00 for a vehicle service road, drainage improvements project, rehabilitation of Taxilane Kilo and hangar development at Fort Worth Spinks Airport; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Muni Airport Grants Federal Fund in an amount up to (1) $687,000.00, subject to the receipt of the grant, and (2) $36,158.00 as a transfer from the Municipal Airport Capital Project Fund to satisfy the City's match requirement, totaling $723,158.00, for the purpose of funding a vehicle service road, drainage improvements project, rehabilitation of Taxilane Kilo and hangar development at Fort Worth Spinks Airport; and 3. Adopt the attached resolution as required by the Texas Department of Transportation, authorizing the City Manager or his designee to execute all necessary contracts associated with this project with the Texas Department of Transportation. DISCUSSION: On November 15, 2021, the Infrastructure Investment and Jobs Act of 2021 (IIJA) was signed into law, allocating $1.2 trillion in new spending of which $550 billion will go towards investment in our nation's core infrastructure priorities including roads and bridges, rail, transit, ports, airports, the electric grid, water systems and broadband. The infrastructure bill includes $15 billion for airport infrastructure grants over five years with $3 billion to be distributed annually. Of this amount, $12.4 billion would go to commercial service airports and $2.5 billion for nonprimary commercial service and general aviation airports. These funds will be available for. • Airport Improvement Program (A1P) Grants for runways, gates and taxiways that increase safety and expand capacity; • Airport Terminal Improvement program for terminals, concessions and multimodal connections for increased terminal energy efficiency and accessibility; and • Air Traffic Control infrastructure to replace facilities and equipment and improve safety, security and environmental standards. Based on the classification provided by the Federal Aviation Administration (FAA), Fort Worth Spinks Airport (Airport) is eligible to receive up to $687,000.00 under the program for this Fiscal Year 2025 (FY25). Per the FAA, the IIJA will provide "funding to modernize infrastructure, increase equity in transportation, help fight climate change, strengthen the supply chain and create jobs." Last year, the Airport was allocated $294,000.00 in funding, with additional funding expected next year, pending appropriation from Congress. Additionally, these grants will operate under the same guidelines as the FAA's AIP which requires specific projects to be identified on the sponsor's application. The federal share for previous IIJA grants was 90 percent, with the local match being 10 percent, however based on a change included in the FAA reauthorization law, the federal share for FY25 IIJA grants increased from 90 to 95 percent for nonhub and nonprimary airports. Conversely, the local match decreased from 10 to 5 percent for these airports. This same federal share increase will apply for next year's IIJA grant, if received. Funding from this FY25 IIJA grant will be used for, but not limited to, the following projects: • Construction of a vehicle service road • Drainage improvements • Rehabilitation of Taxilane Kilo • Hangar development The Vehicle Service Road project (VSR) will construct approximately 300 feet of a new service road on the east -side of the Airport (see attached map) to provide designated personnel and vehicles accessing airport operations areas with an alternate path to bring the Airport into conformity with current standards. The VSR will allow for the separation of vehicles and aircraft by providing a designated vehicular route to current and future airside facilities, as currently, vehicles must utilize private lease space or an active taxiway heading towards and active runway to access these facilities. The Drainage Improvements project (Drainage Improvements) Wit consist of moving current drainage infrastructure to allow for future development, also on the east -side of the Airport (see attached map). The current drainage infrastructure runs directly through a usable plot of land diagonally, making this area of land undevelopable. By re-routing the current drainage infrastructure, this will allow for this area of land to be developed. The Taxilane Kilo Rehabilitation project (Taxilane Kilo Rehab) will consist of rehabilitating the failed pavement on Taxilane Kilo on the east -side of the Airport (see attached map). This pavement is original to the old Oak Grove Airport that was closed in 1989, and according to the results of a Pavement Condition Index (PCI), Taxilane Kilo's PCI Rating indicates the taxilane pavement has failed and is in dire need of repair. The failed pavement on Taxilane Kilo currently provides access to three hangars on the Airport, along with available space that could be used for future development. This Project will not only greatly improve Taxilane Kilo for current users, but also for future, increased usage as well. A hangar waitlist currently consisting of over 150 individuals exists at the Airport, and development of hangars will help alleviate this issue. The exact size and location of these hangars have not yet been determined, but a separate M&C with more details will be drafted before any design or construction begins. Funding for the BIL will be a 9515 cost -split between the Texas Department of Transportation (TxDOT) and the City of Fort Worth (City), and Wit be administered through TxDOT from the FAA. Since no City salaries wilt be charged, indirect cost recovery does not apply. Upon award, the grant Wit increase funding to the Muni Airport Grants Federal Fund as shown below. CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, in the Muni Airport Grants Federal Fund. The Aviation Department (and Financial Management Services) will be responsible for the collection and deposit of funds due to the City. Prior to an expenditure being incurred, the Aviation Department has the responsibility to validate the availability of funds. This is a reimbursement grant.
