HomeMy WebLinkAboutContract 61171-A1City of Fort Worth, Texas McLeland Tennis Center Outdoor Court Improvements Prof Services Agreement Amendment Template CPN 105168 Revision Date: 12/08/2023 Page 1 of 4 AMENDMENT No.1 TO CITY SECRETARY CONTRACT No. 61171 WHEREAS, the City of Fort Worth (CITY) and Lockwood, Andrews & Newnam Inc., (ENGINEER) made and entered into City Secretary Contract No. 61171, (the CONTRACT) which was administratively authorized on the 22nd day of March, 2024 in the amount of $ 98,315.00; and WHEREAS, the CONTRACT involves engineering services for the following project: McLeland Tennis Center Outdoor Court Improvements, CPN 105168; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $71,475.00. (See Attached Funding Breakdown Sheet, Page -4-) 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $169,790.00. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. Both the CITY and ENGINEER have attempted to clearly define the work to be performed and address the needs of the Project. Under this scope, "ENGINEER" is expanded to include any sub-ENGINEER, including surveyor, employed or contracted by the ENGINEER. PROJECT UNDERSTANDING The City of Fort Worth has identified several structural concerns at the McLeland Tennis Center located at 1600 W Seminary Dr, Fort Worth, TX 76115. The City was first made aware that some of the light pole foundations at the facility were out of plumb and leaning over the courts in 2022. LAN performed a facility assessment and submitted an assessment report August 22nd 2024, which laid out short and long term recommendations for the City to take. The City has selected Option 1 in the assessment report for an immediate option. LAN understands that long-term option in the report will be further evaluated and put into long term planning. It should be understood that the work described in this proposal is only expected to last 2-3 years as noted in the assessment report. SCOPE OF WORK Based on the previously submitted limited Condition Assessment, LAN will prepare a plan set for the installation of guy wires to stabilize existing leaning light poles. a. Review applicable national, state and local codes and standards for project compliance. b. Review structural record documents. Review geotechnical report(s). d. Design of a helical pile guy-wire system for shoring light poles. e. Design of a topping slab over three (3) existing tennis courts. LAN anticipates preparing 22x34" construction drawings for design submittals at Pre-Final, and Final, signed and sealed submissions to the Owner. LAN anticipates preparing the following plan sheets: a. Cover Sheet b. Construction/General Notes c. Quantity sheet d. Existing conditions and Survey Control sheet (Spooner) e. Any applicable traffic control sheets and traffic control details f. Demolition, Erosion Control and construction staging g. Proposed plan sheets h. Helical Pile structural detail sheets i. General details 3. Prepare construction specifications for design submittals at Pre-Final, and Final submissions to the Owner. 4. Prepare Engineer's estimate of probable construction cost for Pre-Final, and Final, signed and sealed submissions to the Owner. 5. Conduct coordination review between other disciplines of design submittals at Pre-Final, and Final, signed and sealed submissions to Owner. 6. Conduct internal Quality Control (QC) review by an independent Engineer for Pre-Final, and Final, signed and sealed submissions to the Owner. 7. LAN will retain a Spooner & Associates to aid in an existing conditions/survey control sheet. Additionally additional detail will be obtained by the surveyor to aid in structural design. a. Establish horizontal and vertical control for the project area. The network and baseline are to be tied based on City of Fort Worth standards. b. Establish horizontal and vertical project control monuments for use during construction. c. Tie-in existing buildings, screen walls, fence lines, trees 4-inches in diameter and larger, edges of pavements, landscape areas, utility surFace appurtenances and all other visible surFace features to the project control baseline. Existing utility structures shall be located and referenced by utility name (i.e., Oncor Electric, Atmos Gas, Frontier Fiber Optic, etc.). d. Map existing underground utilities based on available public record plans from the City of Fort Worth and field locates provided by 811 Texas or other one-call subsurface utility locator services. (Note that we have some record drawings already) e. Collect topographic information including pavement, top of curb, drives, sidewalks, walls, bridges, culverts, water lines, manholes (rim and inverts), storm drain inlets (rim and inverts), and other improvements as needed within the project limits. Collect topographic surveying of sufficient detail to produce cross sections and all other areas of significance to the project baseline. g. Tie in exposed underground utilities to the project control baseline. 8. Conduct Bid support tasks including the following: a. PM and design engineer to attend virtually 1 hours' worth of a pre bid conference. b. Respond to RFI's and issue applicable addenda if needed. c. PM to attend the project bid opening. d. Tabulate bids and recommend award. e. Issue conformed contract documents. 9. Conduct construction phase tasks including the following: a. PM and design engineer to attend virtually 1 hours' worth of a preconstruction conference. b. Respond to RFI's c. Conduct applicable submittal reviews. d. Attend final walk through and review contractor punch list. e. Provide record drawings to client. City of Fort Worth, Texas Attachment A— Scope of Services McLeland Tennis Center Outdoor Court - Option 1 Page 3 of 4 ASSUMPTIONS Only a performance specification will be used for the Helical Piles, and the contractor for the project will need to hire an engineer/manufacturer to finalize design of the helical piles. It will be a delegated design that the contractor will have to coordinate during construction. The helical pile manufacturer will submit a signed and sealed design package including calculations and drawings. LAN will still design and detail the connection between the helical pile and the guy wire (either a concrete cap or a direct steel chain-link type connection). 2. LAN will use the survey from the Condition Assessment project from August 2024. 3. Owner has not been able to locate the as-builts of the Outdoor Tennis Courts. LAN will make conservative assumptions about the foundations of the outdoor courts and light pole foundations. (City Secretary No. 61171) DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to authorize execution of Amendment No. 1 to the Engineering Services Agreement with Lockwood, Andrews & Newnam, Inc. (LAN), in the amount of $71,475.00, for additional engineering services for improvements of the outdoor courts at McLeland Tennis Center for a revised design contract amount of $169,790.00. On March 22nd, 2024, City Secretary No. 61171 was executed befinreen the City of Fort Worth and LAN in the amount of $98,315.00. The contract included a structural assessment of the outdoor courts at McLeland Tennis Center and an assessment report detailing the findings. The amended contract amount will be used to create construction documents that remedy the structural issues identified in the assessment. Funding for this project is budgeted in the General Capital Projects Fund for the Park & Recreation Departments for the purpose of funding the FY23 McLeland Assessment project, as appropriated. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are available in the current capital budget, as previously appropriated, in the General Capital Projects Fund for the FY23 McLeland Assessment project to support the approval of the above recommendation and execution of the amendment to the agreement.
