AN ORDINANCE INCREASING .ESTIMATED RECEIPTS AND APPROPRIATIONS IN
THE WATER CAPITAL PROJECT FUND IN THE AMOUNT OF $148,334.46 AND THE
SEWER CAPITAL PROJECT FUND IN THE AMOUNT OF $22,471.37 FROM AVAILABLE
FUNDS FOR THE PURPOSE OF FUNDING A REIMBURSEMENT TO THE TEXAS
DEPARTMENT OF TRANSPORTATION (TXDOT) FOR THE WATER AND SANITARY
SEWER MAIN RELOCATIONS THAT WERE NECESSARY DURING THE
RECONSTRUCTION OF FARM TO MARKET ROAD FM157 FROM STATE HIGHWAY
SH10 TO MOSIER VALLEY; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2002-2003 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Water Capital Project Fund in the amount of $148,334.46 and the Sewer Capital Project Fund in the amount
of $22,471.37 from available funds for the purpose of funding a reimbursement to the Texas Department of
Transportation (TXDOT) for the water and sanitary sewer main relocations that were necessary during the
reconstruction of Farm to Market Road FM157 from State Highway SH10 to Mosier Valley.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no' way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 15184 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

SUBJECT APPROPRIATION ORDINANCE AND REIMBURSEMENT TO TEXAS DEPARTMENT OF
TRANSPORTATION FOR WATER AND SANITARY SEWER MAIN RELOCATIONS FOR
RECONSTRUCTION OF FM157 FROM SH10 TO MOSIER VALLEY ROAD
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the transfer of $170,805.83 from the Water and Sewer Operating Fund to the Water
_ Capital Project Fund in the amount of $148,334.46 and the Sewer Capital Project Fund in the
amount of $22,471.37; and
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Water Capital Project Fund in the amount of $148,334.46 and the Sewer Capital Project Fund in the
amount of $22,471.37, from available funds; and
3. Authorize the City Manager to reimburse the Texas Department of Transportation (TXDOT) in the
amount of $170,805.83 for the water and sanitary sewer main relocations that were necessary
during.the reconstruction of Farm to Market Road 57 from State Highway 10'to Mosier Valley Road.
DISCUSSION:
On February 2, 2001 (M&C C-18466), the City Council authorized the City Manager to .execute a
contract with B&H Utilities, Inc. for the relocation of the existing. water mains within the limits of the
FM157 reconstruction project.
During construction of the FM157 roadway project, City staff determined that additional water delivery
to this area of the City_ could be provided by connecting the proposed 24-inch line in FM157 to an
existing 24-inch water main on Pipeline Road. It was also necessary to adjust additional unknown
water and sanitary main conflicts that were encountered during pavement reconstruction.
Due to unsatisfactory job performance and unnecessary delays by B&H Utilities, Inc, and to keep
TXDOT's FM157 pavement reconstruction project on schedule, staff determined that it was in the best
interest of the City not to execute a change order with B&H Utilities, Inc., but to instead. negotiate a
price with TXDOT's contractor for the necessary additional water and sanitary improvements.
TXDOT has submitted a change order for the additional work and has requested reimbursement in the
amount of $170,805.83. Staff concurs with this request and recommends approval.
