HomeMy WebLinkAboutOrdinance 15441ORDINANCE NO. ) �4 L_ A CONFLICT HEREWITH; PROVIDING A SEVERABILITY CLAJUS 4"LIVII, I'VIONT WHEREAS, on April 5, 1976, the City Council adopted Ordinance No. 7323 establishing the boundaries of the eight City Council single-member districts; WHEREAS, on November 5, 2002 (Mayor and Council Communication G-13796) the City Council approved Ordinance No. 15319 revising the exterior boundaries of City Council districts 2 through 9 to reflect the single-member district plan approved by the City Council on August 13, 2002 (Mayor and Council Communication G-13700) as amended on November 5, 2002 (Mayor and Council Communication G-13795); WHEREAS, on December 10, 2002 (Mayor and Council Communication PZ-2437) the City Council approved Ordinance No. 15358 annexing approximately 1, 238 acres located north and east of Boat Club Road and south of Bonds Ranch for limited purposes; WHEREAS, on December 17, 2002 (Mayor and Council Communication C-19380) the City Council approved Ordinance No. 15381 adjusting the boundary between the City of Fort Worth and the City of Burleson; WHEREAS, on January 7, 2003 (M & C PZ-2438) the City Council approved Ordinance No. 15389 annexing approximately 7,744 acres located west of IR 35 and north and south of U.S Highway 287 for limited purposes; WHEREAS, the qualified voters residing in areas annexed for limited purposes are entitled to vote in municipal elections regarding the election or recall of members of the City Council or regarding amendment of the municipal charter, but not in any bond election; WHEREAS, residents of areas annexed for limited purposes are not eligible to be a candidate for or to be elected to a municipal office; WHEREAS, the City Council now wishes to amend Ordinance No. 7323, as previously amended, by adopting an ordinance redefining the exterior boundaries of District 6 and District 7 to reflect the annexations described above; SECTION 1. Section 6 of Ordinance No. 7323, as amended, is further amended to read as follows: SECTION 6. For the purpose of determining the qualifications as to candidacy, election or appointment of a member to Place 6 of the City Council of the City of Fort Worth, District No. 6 shall be, and the same is hereby established, and shall comprise all of that portion of the City located within the following described boundary: DISTRICT NO.6 BEGINNING at the Intersection of Granbury Road and Interstate 20 (Southwest Loop 820); THENCE East on Interstate Highway 20 (Southwest Loot 820) to Interstate Highway 35W (South Freeway); THENCE South on Interstate Highway 35W (South Freeway) to the intersection of a line measured at right angles, 900.00 feet South of the centerline of McAlister Road (County Road No. 1017); 2 THENCE West, along a line 900.00 feet South of and parallel to the centerline of McAlister Road (County Road No. 1017), to the northeast comer of that certain Joint Ordinance and Boundary Agreement, between the City of Fort Worth, and the City of Burleson, City of Fort Worth, Ordinance Number 15381; THENCE with the east line of said Agreement, South 00 degrees 10 minutes 19 seconds West, 29.25 feet, to its southeast comer, and being in a line 929.25 feet South of the centerline of McAlister Road (County Road No. 1017); THENCE with the south line of said Agreement, with a line 929.25 feet South of the centerline of McAlister Road (County Road No. 1017), and with the common building line between the buildings addressed as 12950 South Freeway, currently Linen's and Things, and 12930 South Freeway, currently Petsmart, South 89 degrees 52 minutes 10 seconds West, 480.89 feet, to its intersection with the west right-of-way line of the U.P. Railroad; THENCE Northwest, along and with the west right-of-way line of the U.P. Railroad, to the north right-of-way line of said McAlister Road; THENCE West, along and with the north right-of-way line of McAlister Road (County Road No. 1017), to a point for the southeast comer of the tract conveyed to Joe W. Crouch, et ux., et al., by deed recorded in Volume 2276, Page 510 of the Deed Records of Tarrant County, Texas, which point for comer is also the southwest comer of the tract conveyed to Margaret B. For the purpose of determining the qualifications as to candidacy, election or appointment of a member to Place 7 of the City Council of the City of Fort Worth, District No. 7 consists of all of that portion of the City located within the boundary described in Section 7 of Ordinance No. 15319 approved by the City Council on November 5, 2002. In addition, the areas described below, which have been annexed for limited purposes, are included in District 7 with certain limitations mandated by state law. Pursuant to Section 43.130, Texas Local Government Code, residents of the areas described below are entitled to vote in municipal elections relating to the Mayor and the City Council member for Place 7 or regarding amendment of the municipal charter, but may not vote in bond elections. Further, residents of the areas described below are not eligible to be a candidate for or to be elected to a municipal office. 287 Zone — Area "A" 1,830 ACRES OR 2.9 SQUARE MILES (MORE OR LESS) being situated in: the H. Robertson Survey, A -1259, the J. Hibbins Survey, A -639, the S.C.T. Ford Survey, A -531, the I. & G.N.R.R. Co. Survey, A -1956, the J.A. OF CITY COUNCIL DISTRICTS 6 AND 7 RECOMMENDATION: It is recommended that the City Council: 1. Amend the attached single-member district plan to reflect full purpose annexations in City Council Districts 3, 4, 6 and 7 and limited purpose annexations in District 7 approved by the City Council, since July 23, 2002; and 2. Adopt the attached ordinance amending Ordinance No. 7323, as amended, to make the boundaries of City Council Districts 6 and 7 coincide with the current full purpose and limited purpose boundaries of the City. DISCUSSION: An election will be held on May 3, 2003 for the purpose of electing the Mayor and City Council members for Council Districts 2 through 9. - Before conducting the election, the City must revise its single-member district plan and Ordinance No. 7323 establishing the boundaries of the Council districts to reflect changes. in the boundaries resulting from recent annexations. In addition, the City* must submit annexations recently approved by the City Council to the Voting Rights Division of the Department of Justice prior to the election. The City Council approved a revised single-member district plan on August 13, 2002, redefining the boundaries of the eight City Council districts to reflect population shifts in the 2000 census. The City Council approved minor amendments to the plan on November 5, 2002. The City submitted the revised single-member district plan to the Department of Justice on November 19, 2002, together with the following annexations: • Ordinance No. 15164 approved July 23, 2002: Boundary adjustment with City of Saginaw (District 7); and • Ordinance No. 15171 approved July 30, 2002: Annexation of 3.26 acres (District 4); and • Ordinance No. 15224 approved September 3, 2002: Annexation of 171.805 acres (District 7); and • Ordinance Nb.'15270 approved October 1, 2002: Annexation of 339.6 acres (District 3). Also on November 5; 2002, the City Council approved an amendment to Ordinance No. 7323 revising boundaries of the City Council districts to reflect changes to the single-member district plan and to incorporate annexations, including the four annexations described above. The City received notice by letter dated January 16,' 2003', that the Department of Justice does not (` object to the revised single-member district plan, the annexations described above, or inclusion of the annexed areas in the City Council districts identified above. Council Communication 2/18/03 12SINGLE 2 of 2 SUBJECT AMENDMENT OF SINGLE-MEMBER DISTRICT PLAN TO REFLECT ANNEXATIONS AND ADOPTION OF ORDINANCE REVISING THE EXTERIOR BOUNDARIES OF CITY COUNCIL DISTRICTS 6 AND 7 • Ordinance No. 15389 approved January 7, 2003, annexing approximately 7,744 acres located west of IH 35 and north and south of U.S Highway 287 for limited purposes (District 7); and Ordinance No. 15400 approved January 14, 2003, annexing .656 acres near the intersection of Hulen Street and Oakmont Boulevard (District 3); and Ordinance No. 15431 approved February 4, 2003 annexing 47.562 acres located south of Keller Hicks Road, east of Alta Vista Road and north of Golden Triangle Road (District 2). Such annexations must be submitted to the Department of Justice for review before the May 3, 2003 election. A map is attached for your information showing all annexations approved by the City Council since July, 2002. Approval of this Mayor and Council Communication accomplishes the following: 1. Amends the single-member district plan to reflect the annexations submitted to the Department of Justice on November 19, 2002. The Justice Department has raised no objections to these annexations or to the inclusion of the annexed areas to Districts 3, 4 and 7 as outlined above; and 2. In accordance with state law, the ordinance reflects that the qualified voters of the areas annexed for limited purposes are eligible to vote in City Council elections and charter elections, but not bond elections. The ordinance also reflects that residents of the limited purpose areas are not eligible to be a candidate for or to be elected to a municipal office. The 47.562-acre annexation in District 2 and the .656-acre annexation in District 8 do not change the exterior boundaries of Districts 2 and 3 and therefore are not reflected in the ordinance.
