Home My WebLink AboutContract 49555-A5CSC No. 49555-A5 AMENDMENT No . 5 TO CITY SECRETARY CONTRACT No. 49555 WHEREAS, the City of Fort Worth (CITY) and HDR Engineering, Inc., (ENGINEER) made and entered into City Secretary Contract No. 49555, (the CONTRACT) which was authorized by M&C C-28288 on the 20tn day of June, 2017 in the amount of $400,000,00; and WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in the amount of $ 843,000.00 which was authorized by M&C # C-28764 on June 26, 2018, Amendment Number 2 in the amount of $ 1,746,516.00 which was authorized by M&C # 21-0206 on March 23, 2021, Amendment Number 3 in the amount of $ 61,952.00 which was authorized administratively on August 15, 2023, Amendment Number 4 in the amount of S 382,936.00 which was authorized by M&C # 24-0275 on April 9, 2024; and WHEREAS, the CONTRACT involves engineering services for the following project: Avondale-Haslet Road, CPN 101014; and WHEREAS, it has become necessary to execute Amendment No. 5 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals 599,944.00. (See Attached Funding Breakdown Sheet, Page -3-) 2. City of Fort Worth, Texas Page 11 of 34 Attachment A Revision Date: 05.23.2024 Page 11 of 34 Avondale-Haslet Road CPN# 101014 FORT WORTH�� • Utility Coordination (Assume 8 Months) o Weekly coordination with the utility owners. o Preparation and delivery of project files to utility owners. o Aid in the preparation of one utility agreement. o Coordination and preparation of monthly meetings, meeting minutes and utility reports. o Review of proposed utility relocation design an its revisions for confirmation of no impacts to projects design/construction. o Revision of existing and proposed utility layout CADD and PDF files as relocation design is being reviewed and finalized. o Revision of conflict matrix as utility relocations are completed. o Revision of existing and proposed utility layout CADD and PDF files as utilities relocations are completed. Assumptions for Utility Coordination o Final ROW parcel will be acquired by the end of December 2025 so there is no delay in the start dates for the utility relocations in that area. 0 100% PS&E will not have addendums will require a re-analysis of existing and proposed utilities to confirm clearance and no impacts to projects construction. o Only one utility agreement will be coordinated, prepared and finalized. o Only 8 monthly meetings will all utility owners and only 2 follow up meetings with each individual owner. o No additional record investigation and/or SUE will be required for confirmation of existing utilities. o No work shall be done past the assumed 8 months unless there is a supplemental in place for such work. o No project design adjustments shall be requested by the City to avoid/accommodate existing and/or proposed utilities. o No monitoring and verification will be required for the utility relocations. o No site visits will be required for any reason. o No coordination and preparation of a construction management plan will be required. o Monthly utility report and matrix updates via email to City PM. o Final proposed and existing utility coordination package via email to City PM. Per previous City of Fort Worth direction in coordination with Parcel 38 developer, HDR has been instructed to provide multiple drainage stub-outs within the proposed ROW to facilitate the parcel's development. However, City of Fort Worth recently informed HDR that the stub-outs are no longer needed. Therefore, the drainage and other plans need to be modified to incorporate this design change. o Storm drain design, drainage calculations and data sheets, as well as drainage plan and profile will need to be revised. Assumptions for Drainage Changes for Parcel 38 o Any new or revised direction on Parcel 38 will not be included in the scope. • Water 8� Sanitary Sewer Relocations — 50% Design o Detailed design including plans, specifications, and construction cost estimate for 100 LF of proposed 6" gravity sanitary sewer line and two 4' diameter sanitary sewer manholes for future connections, just West of Moonlake Way near Road STA 45+72 and east of Ragged Spur Court near Road STA 65+98. o Detailed design including plans, specifications, and construction cost estimate for 40 LF of proposed 8" potable water line including necessary bends/fittings to avoid conflict with proposed storm curb inlet, just South of Austin Stone Drive near Road STA 61 +50. o Detailed design including plans, specifications, and construction cost estimate for relocating 525 LF of existing 15" gravity sanitary sewer line, 45 LF of existing 8" gravity sanitary sewer line, 60 LF of 6" gravity sanitary sewer line, and five 4' diameter sanitary sewer manholes to avoid conflicts with storm drain improvements, from approximately Road STA 60+75 to 65+75. This line item includes plans for the abandonment of the existing 15" sanitary sewer line. o Detailed design including plans, specifications, and construction cost estimate for relocating 375 LF of existing 24" gravity sanitary sewer line, 40 LF of existing 15" gravity sanitary sewer line, 45 LF of 8" gravity sanitary sewer line, and five 4' diameter sanitary sewer manholes to avoid conflict with storm drain improvements, from approximately Boaz Road STA 11+00 to 14+00. Subcontract expenses and outside services shall be reimbursed at cost to ENGINEER plus a markup of ten percent (10%). iv. Budgets. ENGINEER will make reasonable efforts to complete the work within the budget and will keep the City informed of progress toward that end so that the budget or work effort can be adjusted if found necessary. ENGINEER is not obligated to incur costs beyond the indicated budgets, as may be adjusted, nor is the City obligated to pay ENGINEER beyond these limits. When any budget has been increased, ENGINEER's excess costs expended prior to such increase will be allowable to the same extent as if such costs had been incurred after the approved increase. B. The ENGINEER shall be paid monthly payments as described in Section II - Method of Payment. II. Method of Payment A. The ENGINEER shall be paid by the City based upon an invoice created on the basis of statements prepared from the books and records of account of the ENGINEER, based on the actual hours and costs expended by the ENGINEER in performing the work. B. Each invoice shall be verified as to its accuracy and compliance with the terms of this Agreement by an officer of the ENGINEER. C. ENGINEER shall prepare and submit invoices in the format and including content as presented in Exhibit B-1. D. Payment of invoices will be subject to certification by the City that such work has been performed. III. Progress Reports A. The ENGINEER shall prepare and submit to the designated representative of the Transportation and Public Works Department monthly progress reports and schedules in the format required by the City.
