Subject: USE OF RACKS ON GARBAGE COLLECTION DAYS

On March 11, 1993 (I.R. 7696) , the City Council was briefed on the
City's efforts to enforce provisions of Chapter 14 of the City Code
prohibiting the use of garbage cans and racks on the curb for
residential garbage collection. As you are aware, in 1971 the City of
Fort Worth initiated curbside garbage collection using disposable bags.
This system increased crew safety and productivity; it decreased odor
and rodent problems; it was convenient for residents; and it improved
the appearance of neighborhoods by not having trash cans and racks on
the curb both before and after collection.
In recent months staff became aware that in some parts of the City that
had previously been serviced by BFI some residents had been allowed on
a continuing basis to use cans and racks for garbage collection.
Residents and some neighborhood associations complained because the
ordinance was not being enforced and the new contractor was concerned
because their bid to provide the service was based on collecting garbage
in one-way containers placed on the curb and not from cans and racks.
It was indicated during the discussion on March 11 that a number of
complaints had been received from residents regarding the prohibition of
00�r cans and racks. Complaints primarily related to stray animals tearing
open bags and littering neighborhoods with garbage. The City Council
indicated that recent cuts in Animal Control were at least partially to
blame for this problem. Staff was directed to investigate the use of
racks or carts in certain controlled situations and develop a
recommendation that might address the problem.
Section 14-23, sub-section (b) (1) of the City Code currently reads as
follows:
Curb line service. Household garbage and trash shall be
properly prepared for collection and placed on the front curb
line in disposable containers, and recyclables shall be
properly prepared for collection and placed on the front curb
line in the recycling container, by 7:00 a.m. on the scheduled
collection day and no earlier than 6:00 p.m. on the day
preceding the , scheduled collection day.
The revised Section could read as follows:

The intent of this ordinance is that the use of garbage cans
and racks be prohibited for reasons of public health, crew
productivity and neighborhood appearance. However, realizing
that under certain controlled conditions the use of garbage
racks or carts might be in the best interest of overall
neighborhood cleanliness, the Director of City Services or his
designee shall have the authority to approve the use of such
equipment. . Racks must be mobile and in good repair; they
must not impede crew productivity; and they must contain only
one-way containers (bags) . Racks or carts must be placed at
the front curb line no later than 7:00 a.m. on the scheduled
collection day, and no earlier than 6,00 p.m. on the day
preceding the scheduled collection day. All garbage racks,
carts, stands, including recycling containers must be removed
from the front curb line, and from public sight, after being
emptied or by 7:00 p.m. of the collection day, whichever is
latest.
It is staff Is understanding that the City Council did not intend to
repeal the prohibition of the use of garbage cans at the curb, but to
simply allow for the use of garbage racks or carts in certain controlled •rti
conditions. The revision to the ordinance outlined herein will addrese
this concern. If the City Council concurs an amendment to the ordinance
will hQ pared for City Council approval.
