AGREEMENTS BETWEEN THE TEXAS DEPARTMENT OF TRANSPOR-
Subject:
TATION AND THE CITY OF FORT WORTH FOR CONGESTION MITIGATION
AND AIR QUALITY IMPROVEMENTS
The Intermodal Transportation Efficiency Act of 1991 (ISTEA) established a congestion mitigation
and air quality improvement program (CMAQ) to contribute to the attainment of a clean air quality
standard. On November 30, 1994, the Texas Transportation Commission passed Minute Order No.
104667 which effectively approved the Fort Worth-Dallas Transportation Improvement Program
(TIP) for fiscal year 1995-97. Eight projects are funded through a combination of State, Federal and
City funds. The City share of cost varies from 20% to 50%. Since State and Federal funds were
limited, projects with greater than 20% local participation were given higher priority and thus a
better change of being included in the adopted program.
The following City of Fort Worth projects are included in the 1995-97 fiscal year of the T.I.P.:

TxDOT has prepared' agreements which detail the responsibilities of both the City of Fort Worth and
TxDOT. Generally, the City will be responsible for designing the project, securing needed rights-of-
way, and clearing utilities. TxDOT will approve the construction plans and specifications, bid the
projects and inspect the construction work.
Funds are available in the 1993 Capital Improvement Program to fund five of the eight projects. The
remaining three projects (N. Beach at 1-820, N. Beach Grade Separation at Railtran, and Granbury-
Wabash between Trail Lake and Seminary Drive) totaling $2,704,000 in City share cost is funded
from the Assessment paving Revolving Fund as approved by City Council on February 14, 1995,
M&C G-10979, Policies and Alternative Uses for the Special Assessments Fund - GS94. M&C's
recommending approval of the eight agreements are included on today's Council agenda.
Once the agreements have been approved and signed by all parties, staff will initiate a consultant
selection process approved by TxDOT to select consultants to do the design work. M&C's
recommending consultant contract awards will be submitted at the appropriate time to City Council
for consideration.
