AN ORDINANCE VACATING AND EXTINGUISHING A 10-FOOT
WIDE BY 248-FOOT LONG UTILITY EASEMENT LOCATED
WITHIN NANCY ANN ROBERTS SURVEY, ABSTRACT NO.
1275 AND BETWEEN LOTS 1 AND 2, BLOCK 4,
SUMMERBROOK ADDITION, FORT WORTH, TEXAS, AND
CONTAINING APPROXIMATELY 2,480 SQUARE FEET OF
LAND; PROVIDING FOR REVERSION OF FEE IN SAID LAND;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That a 10-foot wide by 248-foot long utility easement located within the
Nancy Ann Roberts Survey, Abstract No. 1275, and between Lots 1 and 2, Block
4, Summerbrook Addition, an addition to the City of Fort Worth, Texas,
containing approximately 2,480 square feet of land, and as recorded in Cabinet
A, Slide 3837, Deed Records, Tarrant County, Texas, and as more specifically
described in Exhibit A, attached hereto and incorporated herein by reference, be
and the same is vacated and extinguished.
SECTION 2.
That the fee to the land in the above described vacated utility easement is
hereby released and shall revert to the adjacent owner as provided by law.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith are hereby
repealed.
SECTION 4.
That this ordinance shall take effect upon adoption.

EASEMENT VACATION
BEING a 10.00 feet wide easement situated in the Nancy Ann Roberts
Survey, Abstract No. 1275, and further being situated in Lot 1
and Lot 2, Block 4, Summerbrook Addition, an Addition to the
City of Fort Worth, per plat recorded in Cabinet A, Slide 3837
of said deed records, Tarrant County, Texas; being more
particularly described by metes and bounds as follows:
COMMENCING at a 5/8 inch Huitt-Zollars capped steel rod at the Southwest
corner of said Lot 2 at the Northwest corner of the intersection of
Prewitt Road (a variable width R.O.W.)and Beach Street (a 120 feet
R.O.W.) THENCE North 00 degrees 02 minutes 22 seconds East, along
the East R.O.W. line of said Beach Street a distance of 233.98 feet
to the POINT OF BEGI7VI~TING;
THENCE North 00 degrees 02 minutes 22 seconds East continuing along said
R.O.W. line a distance of 10.00 feet to a point for corner;
T'I~NCE East, a distance of 247.58 feet to a point for corner;
THENCE South 00 degrees 03 minutes 10 seconds West, a distance of 10.00
feet to a point for corner;
THENCE West, distance of 247.58 feet to the POINT OF BEGINNING
and embracing 2,476 Square Feet or 0.057 Acre of Land.

RECOMMENDATION:
It is recommended that the City Council adopt the attached ordinance vacating a 10 foot wide by 248
foot long utility easement, situated in the Nancy Ann Roberts Survey, Abstract No. 1275 and between
Lots 1 and 2, Block 4, Summerbrook Addition per plat recorded in Cabinet A, Slide 3837 of said deed
records, Tarrant County, Texas, and containing 2,480 square feet of land.
DISCUSSION:
Dr. Steve Hardee of Fort Worth, Texas, owner of the above described properties, -has requested
vacation of the above referenced utility easement to expand the building area. There are no known
utilities in said easement.
The Engineering Department, Real Property Services Division states that a fee of $1.00 will satisfy the
public interest. Reviewing City departments and public utility companies have raised no objections to
this request. A replat is not required.
This request is located in COUNCIL .DISTRICT 4.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that this action will have no material effect on City funds.
