HomeMy WebLinkAboutContract 61189-A3City of Fort Worth, Texas Eagle Mountain Water Treatment Plant Expansion Prof Services Agreement Amendment Template CPN 105176 Revision Date: 12/08/2023 Page 1 of 2 AMENDMENT No.3 TO CITY SECRETARY CONTRACT No. 61189 WHEREAS, the City of Fort Worth (CITY) and CDM Smith Inc., (ENGINEER) made and entered into City Secretary Contract No. 61189, (the CONTRACT) which was authorized by M&C No. 24-0172 on the 27th day of February, 2024 in the amount of $3,695,990.00; and WHEREAS, the CONTRACT was subsequently revised by: Amendment No. 1 in the amount of $0.00 administratively authorized on July 16th, 2024 and Amendment No. 2 in the amount of $11,149,078.00 authorized by M&C 24-0729 on 7th, 202 ; and WHEREAS, the CONTRACT involves engineering services for the following project: Eagle Mountain Water Treatment Plant Expansion, CPN 105176; and WHEREAS, it has become necessary to execute Amendment No. 3 to the CONTRACT to include an increased scope of work at no additional fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $0.00, (This amendment provides for substitution of work task at no additional cost). 2. There is no fee increase to Article II of the CONTRACT. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. Project Manager City of Fort Worth Water Department 1000 Throckmorton Street Fort Worth, TX 76102 Subject: Eagle Mountain WaterTreatment Plant Amendment No. 3 CDM Smith Project No.: 0515-294565 City Secretary No. 61189 - City Project No. 105176 Dear Mr. McDonald: This letter is in reference to a contract between Consultant (CDM Smith Inc.) and the City of Fort Worth (the City) dated February 27, 2024 referred to herein as the "Contract." CDM Smith is pleased to submit our Amendment No. 3 for the City's Eagle Mountain Water Treatment Plant Phase IV Expansion — Project No. 105176. CDM Smith is eliminating the following services and as directed by the City. It should be noted that some time in coordination was billed to this task before removal, therefor there are some charges to this task: Task 4.3 - Electrical Pre-Procurement — Added in Amendment 2. Large electrical equipment across the country has a lengthy delivery schedule following receipt of a purchase order that can impact construction schedules. To reduce the overall construction schedule risk, the Engineer will prepare pre-procurement documents for long-lead electrical gear, specifically transformers and switchgear. Engineer will prepare front end technical specifications and associated drawings and figures necessary for the pre-procurement of electrical gear to be provided for the EMWTP expansion design. The proposal documents will include requirements for capital costs and warranty provisions. Owner will submit proposal documents to qualified equipment manufacturers. Engineer will answer questions from the electrical equipment manufacturers, prepare required addenda, and attend proposal opening. Engineer will evaluate the received proposals with Owner and provide a recommendation of award for the pre-selection equipment. CDM Smith is also adding the following services to Task 9.2 as directed by the City: Task 9.2 Survey and Subsurface Utility Engineering Services 75 State Street, Suite 701, Boston, Massachusetts 02109 � tel: 617 452-6000 CDM Smith Mr. McDonald December 19, 2024 Page 2 Task 9.2.3 Subsurface Utility Engineering Services — Added in Addenda 3. This task includes obtaining SUE work for up to twenty (20) test holes on site to inform the site- civil design for critical crossings and connections on the Eagle Mountain WTP site. Data will be included in the design drawings as part of the original agreement and made available to potential Contractors during bidding and construction. Budget Modifications The elimination of scope and budget from Task 4.3 is being moved to the new Task 9.2.3 to be used to expedite the Environmental Permitting and TWDB Report Documents to aid the City in maintaining the project schedule.
