HomeMy WebLinkAboutOrdinance 27449-02-2025Ordinance No. 27449-02-2025 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS CAPITAL PROJECT FEDERAL FUND, SUBJECT TO THE RECEIPT OF THE GRANT, IN THE AMOUNT OF $4,000,000.00, FOR THE PURPOSE OF FUNDING THE WEST FREEWAY ONCOR TRAIL PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2024-2025 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Capital Project Federal Fund, subject to the receipt of the grant, in the amount of $4,000,000.00, for the purpose of funding the West Freeway Oncor Trail project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27107-09-2024 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. City of Fort Worth, Texas Mayor and Council Communication DATE: 02/11/25 M&C FILE NUMBER: M&C 25-0121 LOG NAME: 20WEST FREEWAY ONCOR TRAILS GRANT APPLICATION SUBJECT (CD 3) Authorize Application for and Acceptance of, if Awarded, a 2025 Transportation Altematives Program Grant from the North Central Texas Council of Governments and the Texas Department of Transportation, in the Total Amount Up to $4,000,000.00, Authorize Execution of a Grant Agreement with the Texas Department of Transportation for the West Freeway Oncor Trail Project and Adopt Appropriation Ordinance RECOMMENDATION: It is recommended that the City Council: 1. Authorize the application for and acceptance of, if awarded, the 2025 Transportation Alternatives Program grant, in an amount up to $4,000,000.00, for the design and construction of a trail in the Oncor easement that is near the West Freeway (Interstate Highway 30); 2. Authorize execution of the grant agreement with the Texas Department of Transportation in the amount up to $4,000,000.00; and 3. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Grants Capital Project Federal Fund, subject to the receipt of the grant, in the amount up to $4,000,000.00 for the purpose of funding the West Freeway Oncor Trail project. DISCUSSION: The purpose of the Mayor and Council Communication (M&C) is to request application for and acceptance of if awarded, a Transportation Alternatives Program (TAP) grant in the amount up to $4,000,000.00 for the design and construction of a trail in the Oncor easement that is adjacent to the West Freeway corridor at Interstate Highway 30. The Texas Department of Transportation (TxDOT) is administering the 2025 TAP grant for eligible bicycle and pedestrian -oriented projects. The application deadline has not been released but is expected in June 2025, and it is anticipated to receive the notice of award in the fall of 2025. Application information has been entered into the Grants Application Repository record GRNT APPL-0000000102. The project boundaries extend from Dale Lane at Thorny Ridge Park to Calmont Avenue by Marquita Drive. This project is a segment of the North Central Texts Council of Governments (NCTCOG) regional veloweb mufti -use trail network. The project is consistent with the existing hike and bike trail agreement between the City and Oncor. The City will be responsible for providing a 20% local match or up to $800,000.00 as part of the grant. A separate M&C will be presented to Council once funding has been identified for the grant match requirement. Should no funding be available, then the Transportation and Public Works Department will not accept the grant award. Project management and review are the only anticipated indirect costs that are incorporated with the cost of the project. West Freeway Oncor Trail is located in COUNCIL DISTRICT 3. A Form 1295 is not required because: This contract will be with a governmental entity, state agency or public institution of higher education: TxDOT FISCAL INFORMATION ! CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, in the Grants Cap Projects Federal Fund. The Transportation and Public Works Department (and Financial Management Services) will be responsible for the collection and deposit of funds due to the City. Prior to expenditure being incurred, the Transportation and Public Works Department has the responsibility to validate the availability of funds. This is a reimbursement grant.
