AN ORDINANCE VACATING AND EXTINGUISHING A 15-FOOT WIDE
BY 20-FEET LONG UTILITY EASEMENT AND A 10-FOOT WIDE BY
168.5-FOOT LONG SANITARY SEWER EASEMENT, BOTH LOCATED
IN THE STONEGATE ADDITION TO THE CITY OF FORT WORTH,
TEXAS; PROVIDING FOR. REVERSION OF FEE IN SAID LAND;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT the following:
1. a 15-foot wide by 20-foot long utility easement, containing 300 square feet
of land, located in Lot 4R, Block 4, Stonegate Addition, an addition to the
City of Fort Worth, and as recorded in Cabinet A, Slide 5562 of Plat
Records, Tarrant County, Texas; and
2., a 10-foot wide by 168.5-foot long sanitary sewer easement located in Lot
3R1, Block 4, Stonegate Addition, an addition to the City of Fort Worth,
and as recorded in Cabinet B, Slide 1962, Plat Records, Tarrant County,
Texas,
and as more specifically described in Exhibit A attached hereto and incorporated
herein by reference be and the same are vacated and extinguished.
SECTION 2.
That the fee to the land in the above described vacated sanitary sewer easement
is hereby released and shall revert to the adjacent owner as provided by law.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith are hereby
repealed.
SECTION 4.
That this ordinance shall take effect upon adoption.

BEGINNING at the southeast corner of Lot 4R and at the southeast corner of said
easement;
THENCE WEST a distance of 168.59 feet along the south line of Lot 4R to the
southwest corner of said Utility Easement acid to the east line of a 30 feet (30') wide
Common Ingress/Egress, Emergency Access and Utility Easement;

SUBJECT UTILITY AND SANITARY SEWER EASEMENT VACATIONS: LOTS 3R.1 AND 4R,

RECOMMENDATION:
It is recommended that the City Council adopt the attached ordinance vacating the following:
a. A 15-foot wide by 20 foot long, utility easement in Lot 4R, Block 4, Stonegate Addition, City
of Fort Worth, Texas, according to .the plat recorded in Cabinet A, Slide 5562, Plat
Records of Tarrant County, Texas, and containing 300 square feet of land; and
b. A 10-foot wide by 168.5 foot 1ong~ sanitary sewer easement in Lot 3R1, Block 4, Stonegate
Addition, City of Fort Worth, Texas, according to the plat recorded in Cabinet B, Slide
1962, Plat Records of Tarrant County, Texas, and containing 1,685 square feet of land.
DISCUSSION:
Darrell Lester and Gregory Scheidwan, owners of the above described properties, have requested
vacation of the above referenced utility and sanitary sewer easements to expand the building area.
The sanitary sewer is the only known existing improvement within said easement.
The Engineering Department, Real Property Services Division states that a fee of $1.00 will satisfy the
public interest. Reviewing City departments and public utility companies have raised no objections to
this request. An acceptable replat has been provided (FS-02-171).
This request is located in COUNCIL DISTRICT 9.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that this action will have no material effect on City funds.
