MAINTENANCE AGREEMENT
THIS AGREEMENT, made and entered into this ____ day of
_____________, 20 , by and between Marcia B. Jacobs, as Trustee of the Marcia B.
Jacobs Family Trust, dated September 19, 2016, acting by and through, its duly authorized
representative, hereinafter referred to as “Landowner”, and the City of Fort Worth,
hereinafter referred to as “City”.
WITNESSETH
WHEREAS, the Landowner is the owner of certain real property described as a
tract of land situated in the all of Lots 2 and 3, and a portion of Lots 1 and 4, Block 4,
Westover Hills, an Addition to the City of Fort Worth, Tarrant County, Texas as more
particularly described in that certain (i) Trust Distribution Deed recorded January 17,
2024, Document No. D224008354 (as to an undivided 50% interest) Official Public
Records, Tarrant County, Texas, and (ii) Trust Distribution Deed, recorded January 22,
2024 under Document No. D224011173 (as to the remaining undivided 50% interest),
Official Public Records, Tarrant County, Texas, hereinafter called the “Property”.
WHEREAS, the Landowner is proceeding to build on and develop the Property
according to the Site Plan/Subdivision Plan known as Merrymount Pond hereinafter called
the “Plan”, which is expressly made a part hereof, as approved or to be approved by the
City.
WHEREAS, pursuant to the Plan, the City and the Landowner provides for
management of storm water within the confines of the Property;
WHEREAS, the City and the Landowner, and their respective successors and
assigns, agree that the health, safety and welfare of the residents of the City of Fort Worth,

Texas require that an on-site Stormwater Management Facility be constructed and
maintained on a portion of the Property; as further described herein; and
WHEREAS, the City requires that an on-site Stormwater Management Facility
(“Facility”) as shown on the Plan, be constructed and adequately maintained by the
Landowner, its successors and assigns, the location and dimensions of which is shown and
more particularly described by metes and bounds in the attached Exhibit “A” (“Facility
Property”); and
NOW, THEREFORE, in consideration of the foregoing premises, the mutual
covenants contained herein, and the following terms and conditions, the parties hereto
agree as follows:
1. The Landowner, its successors and assigns, shall adequately construct and
adequately maintain the on-site Stormwater Management Facility (“Facility”)
at no expense to the City of Fort Worth in accordance with the design
specifications for the Facility, attached as Exhibit “B”, and the current
standards then in force and effect in the City of Fort Worth and with the
Operations and Maintenance Plan a list of which is attached to this Agreement
as Exhibit “C”. The Stormwater Facility, as such term is used herein, includes
all pipes, channels or other conveyances built to convey stormwater to the
Facility, as well as all structures, improvements, and vegetation provided to
control the quantity and quality of the stormwater. Adequate maintenance as
used herein means the Facility remains in good working condition such that the
systems and equipment comprising the Facility are performing their intended
design functions. The City shall use the Stormwater Structural Control
Maintenance Checklists, attached to this Agreement as Exhibit “D”, to
establish whether the Facility is in good working condition that is acceptable to
the City.
2. The Landowner, its successors and assigns, shall inspect the Facility and
submit an inspection report to the City annually. The purpose of such

inspections is to ensure the safe and proper functioning of the Facility. The
inspection shall cover the entire Facility, berms, outlet structure, pond areas,
access roads, etc. Components of the Facility, which need maintenance or
replacement as required herein to perform their design function, shall be noted
in the inspection report along with the corrective actions to be taken, if any.
3. The Landowner, its successors and assigns, hereby grant permission to the
City, its authorized agents and employees, to enter upon the portion of the
Property necessary to access the Facility for the sole purpose of accessing,
inspecting, or in cases of emergency, the Facility Property whenever the City
deems necessary. The City will attempt to notify the Landowner on site before
an inspection, however, if such notification is unsuccessful, the City will not be
required to provide any additional notice and may proceed with its inspection
or maintenance as needed. The purpose of such inspections by the City would
be to follow-up on reported deficiencies and/or to respond to citizen
complaints. The City shall provide the Landowner, its successors and assigns,
copies of the inspection findings and a directive to commence with the repairs,
if necessary, to bring the Facility back in good working condition, if
applicable.
4.In the event the Landowner, its successors and assigns, fail to adequately
maintain the Facility in good working condition as specified herein, and such
failure continues for a period of thirty (30) days after receiving written notice
from the City describing in reasonable detail such deficiencies with respect to
the Facility (or such longer period if the deficiency(ies) cannot reasonably be
cured within 30 days and Landowner, its successors and assigns, diligently
pursues cure to completion) the City, its authorized agents and employees, may
enter upon the Facility Property and take whatever steps necessary to correct
deficiencies identified in the inspection report and to charge the actual costs of
such repairs to the Landowner, its successors and assigns. It is expressly
understood and agreed that the City is under no obligation to routinely
maintain or repair said Facility, and in no event shall this Agreement be

construed to impose any such obligation on the City, such obligation is
Landowner’s subject to the terms and conditions provided herein.
5. The Landowner, its successors and assigns, will perform the required work
necessary to keep the Facility within the standards and specifications as
required herein. In the event the City, as permitted pursuant to in accordance
with terms and conditions of this Agreement, performs work of any nature, or
expends any funds deemed necessary in performance of said work for labor,
use of equipment, supplies, materials, and the like, the Landowner, its
successors and assigns, shall reimburse the City upon demand, within thirty
(30) days of receipt thereof for all actual costs incurred by the City hereunder.
In the event that Landowner or its successors or assigns fail to pay the City for
the costs incurred for material and labor in performing the work permitted
under this section, the City may impress a lien for the actual costs of such work
upon the Facility Property or other lots owned by the Landowner, if any. Such
lien shall be perfected by filing in the office of the Official Public Records of
Tarrant County, Texas an affidavit identifying the property to be charged with
such lien, stating the amount thereof, and making reference to this Agreement.
6. Except as otherwise expressly provided herein, this Agreement imposes no
liability of any kind whatsoever on the City. THE LANDOWNER AGREES
TO HOLD THE CITY HARMLESS FROM ANY LIABILITY IN THE
EVENT THE FACILITY FAILS TO OPERATE PROPERLY.
LANDOWNER COVENANTS AND AGREES AND DOES HEREBY
INDEMNIFY, HOLD HARMLESS AND DEFEND THE CITY OF FORT
WORTH, ITS AGENTS, SERVANTS AND EMPLOYEES (TOGETHER
THE “CITY PARTIES”) FROM AND AGAINST ALL ACTUAL COSTS,
EXPENSES, LOSSES, DAMAGES, CLAIMS OR CAUSES OF ACTION
(COLLECTIVELY “CLAIMS”) WHATSOEVER ARISING FROM THE
FAILURE OF LANDOWNER OR ANY FUTURE OWNERS OF THE
FACILITY PROPERTY TO ADEQUATELY MAINTAIN THE
FACILITY, INCLUDING, BUT NOT LIMITED TO THE BED AND
STORMWATER FACILITY MAINTENANCE AGREEMENT

BANKS OF THE DETENTION POND; (B) ANY DAMAGES CAUSED
TO PERSON OR PROPERTY DUE TO (1) FLOODING OF THE POND
AND ITS BANKS, (2) SLOPE FAILURE OF THE BANKS OF THE
POND, OR (3) FAILURE OF THE POND OR ITS BANKS TO
OPERATE IN A MANNER CONSISTENT WITH CITY OF FORT
WORTH CRITERIA (C) THE FAILURE OF LANDOWNER TO
PERFORM ANY OTHER DUTIES OR OBLIGATIONS HEREUNDER.
THE FOREGOING PROVISIONS AND OBLIGATIONS IN THIS
PARAGRAPH SHALL NOT APPLY TO THE EXTENT OF THE
CITY’S GROSS NEGLICENCE OR WILLFUL MISCONDUCT. IN
THE EVENT ANY OF THE CITY PARTIES CAUSES DAMAGE TO
ANY PORTION OF THE PROPERTY, THROUGH NEGLIGENCE OR
OTHERWISE, THE CITY, ITS SUCCESSORS AND ASSIGNS, SHALL
PROMPTLY REPAIR SUCH DAMAGE AT ITS SOLE COST AND
EXPENSE.
7. Landowner covenants and agrees that no habitable building shall be erected
within the boundaries of the Facility Property which is located as outlined on
Exhibit “A” but this paragraph shall not preclude construction of other
improvements within the boundaries of the Facility Property which do not
impede drainage. Nor does it impede the construction of habitable buildings on
the remaining portion of the Property subject to the following sentence.
Landowner covenants and agrees that no habitable building shall be erected on
the remaining portion of the Property abutting such boundaries of the Facility
Property, which shall have a finished floor at an elevation less than two feet
above the maximum depth of water in the detention pond which would occur
during a 100-year frequency flood.
8. This Agreement shall be recorded among the land records of Tarrant County,
Texas, shall constitute a covenant running with the land, and shall be binding
on the Landowner, its administrators, executors, assigns, heirs and any other
successors in interests, including any property owner’s association.

MAINTENANCE PLAN FOR WET POND MERRYMOUNT DETENTION POND
MERRYMOUNT ROAD, FT. WORTH, TX
DETENTION SYSTEM OPERATION AND MAINTENANCE PLAN
The detention pond located at 5701 Merrymount Road; Ft. Worth, Texas contains
a storm water detention basin to mitigate the impact of increased runoff due to
existing development of the land. In order to maintain functionality and reduce the
risk of flooding, these systems should be inspected and maintained on a regular
basis by the property owner. This plan outlines the requirements and procedures
for ensuring the system works properly.
System Description
The detention system consists of a single facility that serves the immediate area.
The purpose of this facility is to restrict runoff from storm events which flows at a
higher rate due to impervious areas (concrete paving, building roof, etc.) and
release it at a steady rate like when the land was undeveloped. This restriction of
flow occurs at the outlet structure, which consists of an outlet structure located
generally in northwest portion of the property which discharges into the public
storm system through an existing 24” Storm Drain Pipe. The outlet structure
consists of a 2’ by 1’ opening for the 100-year rainfall event. The basin also has a
spillway designed for any extreme event, or in case of a blockage at the outlet.
The spillway was designed to convey more than a 100-year rainfall event.
System Maintenance
Inspection and general maintenance of the detention facility is not complex and
should be done on a regular basis. Outlined below are guidelines for the
inspection and maintenance procedures. These are for routine maintenance only.
The system should be inspected immediately after a storm event if the basin
ponds above the bottom of the spillway.
- Visual inspections conducted every six (6) months of all components,
including:
o The outflow area on the downstream side of the spillway and outlet,
o The soil area around the rip rap for any signs of washout or rutting
o The retaining wall for any cracks or loose rock and repair as
required.
o The outlet structure for any damage or deterioration.
- Remove any trash within the detention basin, the outlet pipe and rip rap
area and the grate on the outlet structure.
- Mow the entire pond at least once every three (3) months.
- Sediment removal from the detention/retention facility when the retention
pond is 4’ or less.
- A log shall be kept of maintenance actions, and inspections.
o The log should document the condition of the detention system’s
primary components, mowing, and silt, litter and debris removal
dates.
- Written maintenance and repair records shall be maintained by the party or
parties signing the attached Agreement and shall be provided to the City
upon request.
General Maintenance Procedures
The structural and functional integrity of the Facility shall be maintained at all
times by removing and preventing drainage interference, obstructions, blockages,
or other adverse effects into, though, or out of the system.
Periodic silt removal shall occur when the pond’s storage volume is reduced by
more than 10%. Silt shall be removed, and the pond returned to original lines and
grades shown on the approved engineering plans. In addition, corrective
measures are required any time a basin does not drain completely within 72 hours
of cessation of inflow.
Accumulated litter, sediment, and debris shall be removed every 6 months or as
necessary to maintain proper operation of the basin. Disposal shall be in
accordance with federal, state and local regulations.
To prevent debris from entering and clogging the downstream storm sewer
system a wire mesh screen or similar screening device shall be installed over the
outlet until final acceptance.
Maintenance of Public and Private Storm Lines
Private storm drain lines as identified on the construction plans shall be the
landowner and association, its successors and assigns identified in the storm
water facility maintenance agreement. In order to provide for maintenance of
public storm drain lines adjacent to ponds or City requested dewatering of pond,
the pond water surface elevation will be drawn down below the storm drain pipe
flow line elevation at the pond outfall by the landowner and association, its
successors and assigns. The landowner and association, its successors and
assigns shall be provided notice 72 hours in advance of the intended maintenance
and will be required within to draw down the pond to a level suitable to allow the
City, its authorized agents and employees, the ability to access, clean, and flush
public storm drain lines. In the event the landowner and association, its
successors and assigns fail to draw down the pond water surface elevation to a
suitable elevation at the time of the prescribed maintenance or in the event of an
emergency, the City, its authorized agents and employees, may enter upon the
facility property and take whatever steps necessary to draw the pond water
surface elevation and maintain the public storm drain lines and to charge the
costs of such activities to the landowner, its successors and assigns. The City is
not responsible for raising the water surface elevation in the pond after
maintenance.
