AN ORDINANCE VACATING AND EXTINGUISHING AN 8-FOOT
WIDE BY 170-FOOT LONG UTILITY EASEMENT LOCATED
WITHIN LOTS 4B AND 5A, .PEBBLE CREEK SUBDIVISION;
FORT WORTH, TEXAS, AND CONTAINING APPROXIMATELY
1,358 SQUARE FEET OF LAND; PROVIDING FOR REVERSION
OF FEE IN SAID .LAND; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That an 8-foot wide by 170-foot long utility easement located within Lots
4B and 5A, Pebble Creek Subdivision, an addition to the City of Fort Worth,
Texas, containing approximately 1,358 square feet of land, and as recorded in
Volume 388-86, Page 52, Plat Records, Tarrant County, Texas, and as more
specifically described in Exhibit A, attached hereto and incorporated herein by
reference, be and the same is vacated and extinguished.
SECTION 2.
That the fee to the land in the above described vacated utility easement is
hereby released and shall revert to the adjacent owner as provided by law.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith are hereby
repealed.
SECTION 4.
That this ordinance shall take effect upon adoption.

Description for an Eight Feet (8') wide Utility Easement in Lots 4B & 5A,
PEBBLE CREEK SUBDIVISION, an Addition to the City of Fort Worth,
Tarrant County, Texas, according to the plat recorded in Volume 388-86,
Page 52, Plat Records, Tarrant County, Texas, and being described by
metes and bounds as follows:
BEGINNING in the east line of Lot 5A and in the west line of Pebble Creek Road at the
southeast corner of said easement, said point lying 8.18 feet, South 20 degrees 10
minutes 59 seconds East from the southeast corner of said Lot 4B;
THENCE South 86 degrees 54 minutes 00 seconds West a distance of 168.81 feet to
the southwest corner of said easement;
THENCE North 32 degrees 09 minutes 08 seconds West a distance of 9.15 feet to the
northwest corner of said easement;
THENCE North 86 degrees 54, minutes 00 seconds East a distance of 170.79 feet to the
northeast corner of said easement, and to the east line of Lot 4B and the west line of
Pebble Creek Road;
THENCE South 20 degrees 10 minutes 59 seconds East a distance of 8.37 feet along
the west line of Pebble Creek Road and along the east line of said easement to the
POINT OF BEGINNING, said described tract containing 1,358 square feet of land.

RECOMMENDATION:
It is recommended that the City Council adopt the attached ordinance vacating an 8 foot wide by 170
foot long utility easement in Lots 4B and 5A, Pebble Creek Subdivision, City of Fort Worth, Texas,
according to the plat recorded in Volume 388-86, Page 52, Plat Records, Tarrant County, Texas, and
containing 1,358, square feet of land.
DISCUSSION:
Kenneth S. Moczulski, owner of the above described properties, has requested vacation of the above
referenced utility easement to expand the building area. Parking is the only known existing
improvement within said easement.
The Engineering Department, Real Property Services Division states that a fee of $1.00 will satisfy the
public interest. Reviewing City departments and public utility companies have raised no objections to
this request. A replat is not required.
This request is located in COUNCIL DISTRICT 7.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that this action will have no material effect on City funds.
