FLOOD-PROOFING OF FLOODPRONE RESIDENTIAL
PROPERTY
The 1993 Capital Improvement Program (CIP), approved by the voters on
November 2. 1993, included $1,000,000 for the purchase of floodprone
residential property and $1,000,000 for a pilot residential flood-proofing
program. No specific locations were identified in the CIP but staff is aware of
numerous locations throughout the City where homes flood on a recurrent
basis and where storm drainage improvements to relieve the flooding are
technically or economically impractical.
Previous I.R.'s to Council have detailed the recurrent flooding problems
associated with Dry Branch Creek and the corresponding high cost of installing
drainage facilities. A similar situation exists in Arlington Heights where
mid-block low points and adjacent homes flood during even a moderate
rainfall. Other areas can be cited with sin-War problems. Realistically,
traditional storm drainage facilities cannot deal with these problems.
The purchase or flood-proofing of floodprone homes provides the City an
opportunity to assist these home-owners where no opportunity previously
existed. However, it is understood that funds are limited, and that priorities
will have to be established based on reasonable and prudent guidelines.
Any guidelines established at this point in time may have to be modified later
on as staff develops a better understanding as to what flood-proofing
techniques work the best and as the relative costs of various alternatives are
better known.
With this in mind, staff proposes to utilize the following initial guidelines in
administering the program:
A. Criteria for the Purchasing of Floodprone Property
At the written request of the property owner and upon deposit of$500 in
good faith money, staff will recommend to City Council that floodprone
residential property be purchased if any of the following conditions exist:
1. The home is located in a recognized floodway area. ECO 13,

3. The home's floor elevation is below the 10-year frequency flood
elevation.
4. The home has experienced documented flood damage of more than
25% of its TAD evaluation.
If one or more of the foregoing conditions exist, outright purchase will be
based on fair market value as deterinined by a fee appraiser and as
negotiated by the property owner and City Staff. Purchase will be subject
to City Council approval.
Relocation costs will be at the property owner's expense.
Upon closing on the sale of the property to the City, the property owner's
deposit of$500 will be refunded. However, if at any point in the above
process, the property owner elects to withdraw from the program, only
one-half, or $250, of the property owner's deposit.will be returned. The
remaining $250 will be retained to offset administrative costs.
B. Criteria for Flood-Proofing of Floodprone Property
Where none of the above criteria is met, but flooding has been
demonstrably recurrent, staff will recommend to City Council that
floodprone property be flood-proofed on a case-by-case basis. It is the
opinion of staff that the benefiting property owner should be a partner in
this process and bear a portion of the cost of flood-proofing his home.
Therefore, when a request is received from a property owner, staff will
utilize the following guidelines and procedures:
1. The property owner must apply in writing for flood-proofing assistance
and deposit $500 in good faith money.
2. The property owner must be able to demonstrate that his home has
been subject to recur-rent flooding over the years.
3. City staff will retain an outside consultant(s) to investigate an

4. City staff will concurrently obtain an appraisal of the residence to
determine its fair market value.
5. City staff will meet with the property owner to review alternatives and
determine if the property owner wants to proceed with the flood-
proofing recommended by the Consultant.
6. The City's contribution to flood-proofing for any single residence
would be limited to 90% of the flood-proofing cost, not to exceed
$30,000 or 40% of the fair market value of the residence, whichever is
less. The property owner is responsible for costs in excess of the
City's Contribution.
7. If staff and the property owner are in agreement with the
recommended action, the Consultant will be directed to complete the
plans. The property owner will provide right-of-entry to his property
and temporary construction easements as may be necessary. If staff
and the property owner cannot reach agreement, negotiations will be
terminated and the deposit will be retained by the City to offset
administrative costs incurred.
8. The City will invite competitive bids for construction of the
flood-proofing. If the low bid is acceptable, the property owner will be
requested to deposit his/her share of the cost of flood-proofing less
the initial $500 deposit.
9. Following the usual M&C procedure, City staff will recommend award
of the construction contract to City Council. If City Council agrees
with the staff recommendation, the project will be awarded and
construction will commence as soon as the construction contract is
executed.
10. Once the flood-proofing construction has been accepted by the City,
and upon completion of the warranty period, all temporary
construction easements and rights-of-entry will expire. Maintenance
of the flood-proofing will then become the sole responsibill WORD

The above guidelines/procedures may require refinement as staff becomes
more experienced in this pilot program. Any significant modifications to these
guidelines will be brought back to City Council with appropriate explanations.
