AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE WATER CAPITAL PROJECT FUND IN THE
AMOUNT OF $15,582 AND THE SEWER CAPITAL PROJECT FUND IN THE
AMOUN'T' OF $56,239 FROM AVAILABLE FUNDS FOR THE PURPOSE OF
FUNDING OF AN ENGINEERING AGREEMENT WITH TRANSYSTEMS
CORPORATION CONSULTANTS FOR WATER AND SANITARY SEWER
REPLACEMENT ON BERRY STREET FROM WAITS AVENUE TO FOREST
PARK BOULEVARD; PROVIDING FOR A SEVERABILITY CLAUSE; MATQNG
THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND
REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE TT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for the Fiscal Year 2002/03 and in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Water Capital Project Fund in the amount of $15,582 and the Sewer Capital Project Fund in the amount of $56,239
fiom available funds for the purpose of funding Water and Sanitary Sewer Replacement on Beriy Street fiom
Waits Avenue to Forest Park Boulevard..
SECTION 2.
Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any
reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the
remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and
remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 15184 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict with
such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances
and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

CORPORATION CONSULTANTS FOR WATER AND SANITARY SEWER REPLACEMENTS
ON BERRY STREET FROM WAITS AVENUE TO FOREST PARK BOULEVARD
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the transfer of $71,821 from the Water and Sewer Fund to the Water Capital Project Fund in the
amount of $15,582 and the Sewer Capital Project Fund in the amount of $56,239; and
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Water Capital Project Fund in the amount of $15,582 and the Sewer Capital Project Fund in the
amount of $56,239 from available funds; and
3. Authorize the City Manager to execute an engineering agreement with TranSystems Corporation
Consultants in the amount of $67,821 for Water and Sanitary Sewer Replacement Contract on
Berry Street from Waits. Avenue to Forest Park Boulevard.
DISCUSSION:
The 1998 Capital Improvement Program included funds for Berry Street Urban Design from Evans
Avenue to University Drive.
On February 4, 2003 (M&C C-19457), the City Council authorized the City Manager to .execute an
engineering contract with TranSystems Corporation Consultants to prepare plans and specifications for
pavement reconstruction of Berry Street from Waits Avenue to Forest Park Boulevard.
This engineering agreement will -provide for the design, of the water and sanitary sewer lines, which will
be constructed prior to the construction of the street improvements.
TranSystems Corporation Consultants proposes to perform the design work for a lump sum fee of
$67,821. Staff considers this fee to be fair and reasonable for the scope of services proposed.
TranSystems Corporation Consultants is in compliance with the City's M/WBE Ordinance by committing
to 15% M/VVBE participation. The City's goal on this project is 15%.
In addition to the contract amount, $4,000 (water: $1,000, sewer: $3,000) is .required for project
management by the Engineering Department.
This project is located in COUNCIL DISTRICT 5, Mapsco 79C, Z, 80E, 93K, and P.

FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon approval and completion of recommendation No. 1, and
adoption of the attached appropriation ordinance, funds will be available in the current capital budgets,
as appropriated, of the Water and Sewer Capital Project Funds.
