HomeMy WebLinkAboutOrdinance 15453Ordinance No. ~~~ ~~ AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GENERAL FUND IN THE AMOUNT OF $366,146.00 FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING REPAIRS TO FRENCH LAKE DAM; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2002- 2003 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the General Fund in the amount of $366,146.00 from available funds, for the purpose of funding repairs to French Lake dam. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 15184 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance. said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. FOR REPAIR OF FRENCH LAKE DAM RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations by $366,146 in the General Fund from available funds; and 2. Approve the transfer of $366,146 from the General Fund to the Park Improvements Fund; and 3. Adopt the attached appropriation ordinance increasing estimated receipts. and appropriations by $366,146 in the Park Improvements Fund from available funds; and 4. Authorize the City Manager to execute an engineering agreement with Freese & Nichols, Inc. in the amount of $113,000 for the damage assessment, engineering and preparation of plans and. specifications for repairs to French Lake Dam. DISCUSSION: On December 2, 2002, the earthen dam at French Lake was discovered to be leaking. Initial assessments by Transportation and Public Works Department (T/PW) engineers indicated that dam integrity was threatened and action was taken to lower the lake level in order to relieve pressure on the dam. Due to the urgency of this situation, City staff proceeded to obtain technical assistance from a local engineering firm, Freese & Nichols, Inc. (FNI), to determine the probable cause of dam seepage. As a short-term plan to protect the dam from further deterioration, FNI recommended construction of a diversion channel, which was completed by T/PW personnel on December 17, 2002. In consultation with the City, Attorney's Office, staff concluded that the emergency situation at French Lake was exempt from the Texas Local Government Code request for proposal requirements and competitive bid requirements. FNI's scope of work included geotechnical soil borings, hydraulic and hydrology analyses, local revisions to the floodplain map, engineering design, and the preparation of plans, specifications and cost estimates. Recommended dam repairs include: • Excavation and removal of the existing intake structure and drainage outlet; and • Construction of a new intake structure and outlet, which will allow for necessary flow capability during storm events; and • Rework of the existing stone wall at the pedestrian bridge; and • Raising the surface elevation of the spillway area: City of ~'o~t Worth, 7'exa~ Mayor and Council Communication DATE REFERENCE NUMBER LOG NAME PAGE 2/18!03 C®19478 80REPAIR 2 of 2 SUBJECT APPROPRIATION ORDINANCES AND AWARD OF ENGINEERING CONTRACT TO FREESE & NICHOLS, INC. FOR REPAIR OF FRENCH LAKE DAM Construction documents were completed by FNI in late January 2003.. Staff intends to negotiate a contract and will proceed to obtain quotes and select a contractor in February 2003. Upon approval from the City Council, staff will proceed with an award of contract and commence construction in March 2003, with completion in June 2003, contingent on weather and confirmed site conditions. This plan of action was previously outlined in Informal Report No. 8461, dated January 28, 2003, which indicated that the total project cost would be $416,666, of this amount, $50,520 will be funded from COUNCIL DISTRICT 6, Undesignated Funds and $366,146 will be funded from the General Fund. M/V1/BE requirements are waived due to the emergency nature of solicitation of design services. French Lake is located in COUNCIL DISTRICT 6. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the current capital budgefi, as appropriated, of the Park Improvements Fund.
