AMENDMENT No. 1 6ONTRACT K0-
TO CITY SECRETARY CONTRACT
WHEREAS, the City of Fort Worth (CITY) and Brown & Gay
Engineers, Inc. , (ENGINEER) made and entered into City Secretary
Contract No. 44281 , (the CONTRACT) which was authorized by M&C
C-26438 on the 5th day of March, 2013 in the amount of
$1,158, 764 .00; and
"WHEREAS, the CONTRACT involves engineering services for
the following project:
Northside II 48-inch Water Main, Phase 1, from Heritage
Trace Parkway to Alta Vista Road.
WHERE ►S, it has become necessary to execute Amendment No .
I to the CONTRACT to include an increased scope of work and
revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and
through their duly authorized representatives, enter into the
following agreement, which amends the CONTRACT:

Article I of the CONTRACT is amended to include the
additional engineering services specified in a proposal dated
July 24, 2013, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional design
services to be performed by Engineer totals $175, 805 . 00 .
2 .
Article II of the CONTRACT is amended to provide for an
increase in the fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall be an
amount of $1, 354 ,569 . 00 .

expressly attended herein, shall remain in full force and effect.

Keifer Hicks Sanitary Server Additional Services
At the conceptual milestone meeting for Phase 1, 1-.)art 1, BGE was asked to determine the
feasibility of providing sanitary sewer service to the properties on the south side of Keller Hicks
from Old Denton Road to the 15-inch interceptor approximately 2,200 east of Old Denton
Road/Keller Hicks intersection. Additional design services for the additional sanitary sewer
include:
• approximately 2,200 linear feet of topographic survey on private property parallel and
south of Keller Hicks
• design of approximately 2,200 linear of 8-inch sanitary sewer line
• easement documents for utility improvements along, Keller Flicks
The proposed fee for this work is $88,470 and is summarized in the following table.

In accordance with Out* contract, Article V, Section K of the STANDARD AGREEMENT FOR
ENGINEERING RELAITI`) DEISIGN SERVICES, Brown & Gay Engineers, Inc., requests an
cquitable adjustment to our contract to account fOr the additional cost required to perform the
City's requested additional services.
The proposed man hour breakdown for the additional services is attached. 'The proposed
$175,805 for these services was determined based on the time estimated to complete at the
hourly rates established in negotiated total budget outlined in Exhibit E-1 . This includes $56,065
for SBE sub consultants resulting in approximately 31.9% `RE participation for this amendment.
The breakdown of the proposed fee for additional services is as follows:
$ 48,990 – Gorrondona & Associates Inc. (Surveying & easement documents)
$ 7,075 --The Rios Group (Subsurface Utility Exploration)
$ 3,500 – V&A Consulting Engineers, Inc. (Cathodic Protection)
$116,240– Brown & Cray Engineers (Project Management & Engineering)
This proposed amendment increases the total contract amount summarized below:

RECOMMENDATION:
|t (o recommended that the City Council authorize the execution of Amendment No. 1tuCity
Secretary Contract No. 44281, an Engineering Agreement with Brown & Gay Engineers, Inc., in the
amount of$175.805.00 for the Nqrth8ide |( 49-inCh water main, Phase i from Heritage Trace Parkway
to Alta Vista Road thereby increasing the contract amount to $1,354,569.00.
DISCUSSION:
On March 5. 2013. (M&C C-26144) the City Council authorized an Engineering Agreement with
Brown & Gay Engineers, |nc., iD the amount Uf$1.158'7840O for NOdhSid8 |\ 4O-inCh Water Main
Phase | from Heritage Trace Parkway tO Alta Vista Road. The proposed project will provide for the
connection of 48-inoh water main off Heritage Trace Parkway west of I.H. 35 to an existing 42-inch
water main that <s located ot the Timberland Bou|evard64haVieta intersection.
Amendment No. 1 will provide for the following that are necessary on the project:
Design fora valve and interconnection between the 30-inch water main feeding [ay|ortank and
the existing 42-inch water main to Keller to isolate the end of the existing 43-inch water main,
which will allow for expedited construction of the project main at the Timberland Boulevard/Alta
Vista intersection.
Design to provide sewer service to residents on the south side uf Keller Hicks Road.
Construction phase services for two additional construction parts on the project.
Additional design survey.
Subsurface utility engineering.
Additional easement preparation.
Brown & Gay Engineers, Inc., proposes to perform the necessary design work for o lump sum fee of
$175.805.00. Staff considers this fee tobe fair and reasonable for the scope Vfservices proposed,
k0/VVBE [)MiDe - BrOvvD & Gay Engineers, Inc., is in compliance with the City's BDE Ordinance by
committing to32 percent 8BE participation on this Amendment No. 1. The City's goal onthis
amendment io28percent.
