JUSTIFICATION (REASONS) FOR CHANGE v,wc
The purpose to Change Order #11 is to reconcile the General Contingency Allowance from the Crime Lab Generator Replacement - Early Out Package
project. This early out project was executed by M&C 24-0053 (CS61183) for the generator procurement for the Police Department's Crime Laboratory.
A decrease of $37,909.00 to the original contract amount of $150,000.00 from CS61183 for a revised contract amount of $112,091.00, a 25.27% less to the
original contract. This results in a reduction in the project sum with no change to project duration. M&C 24-0585 (CS61741) authorized the remaining funds
and construction contract for the Crime Lab Generator Replacement.
SOB, INC. was selected as the Contractor on March 26, 2024, with a Base Bid of $896,727.88 plus General Contingency Allowance of $67,254.59. To
expedite the project, an early out package was executed with GS61183 for $150,000.00, which included a General Contingency Allowance of $37,909.00.
The remaining construction contract funds were executed with CS61741 for $813,983.00, which included $29,345.59 of General Contingency Allowance.
Change Order#1 will reconcile the General Contingency Allowance from CS61183 ($37,909.00) with CS61741($29,345.59) to combine the total of
$67,254.59 for CS61741.
Funding provided by Police Department.
It is understood and agreed that the acceptance of this Change Order by the contractor constitutes an accord and satisfaction and represents payment in full
(both time and money) for all costs arising out of, or incidental to the above Change Order.

RECOMMENDATION:
It is recommended that the City Council authorize execution of a contract with SDB, Inc., in the
amount of $813,983.00, including an owner's construction contingency allowance, for construction
associated with the installation of the Police Department's Crime Lab Generator.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to authorize construction contract
with SDB, Inc. for the installation of the generator for the Police Department's Crime Lab located at
3616 E. Lancaster Avenue. This contract will provide for all auxiliary equipment, materials and labor
for the installation of the backup generator for the facility.
On July 27 and August 3, 2023 in the Fort Worth Star -Telegram, the City published notice of a
Request for Competitive Sealed Proposals and on August 24, 2023 received two proposals. SDB was
the only respondent that provided the required Post Proposal -Pre -Award Submittals. On January 23,
2024, M&C 24-0053 authorized SDB to proceed with advance procurement of the generator. This
contract will include the materials, labor and ancillary equipment required to complete the scope of
work and install the generator.

Funding - Funding is budgeted in the General Capital Projects Fund for the Property Management
Department for the purpose of funding the Crime Lab Generator and the FY24 Emer Generator
Replace projects, as appropriated.
Waiver of Building Permit Fees - In accordance with the City Code of Ordinances, Part II, Chapter 7-
1 Fort Worth Building Administrative Code, Section 109.2.1, Exception 2; "Work by non -City personnel
on property under the control of the City of Fort Worth shall be exempt from the permit fees only if the
work is for action under a contract will be or has been approved by City Council with notes in the
contract packages stating the fee is waived."
Office of Business Equity - A waiver of the goal for Business Equity subcontracting requirements
was requested, and approved by the DVIN, in accordance with the applicable Ordinance, because the
purchase of goods or services is from sources where subcontracting or supplier opportunities are

The Police Department Crime Lab is located in COUNCIL DISTRICT 11.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds are available in the current capital budget, as previously
appropriated, in the General Capital Projects Fund for the Crime Lab Generator and the FY24 Emer
Generator Replace projects to support the approval of the above recommendation and execution of
the contract. Prior to any expenditure being incurred, the Property Management Department has the
responsibility to validate the availability of funds.

RECOMMENDATION:

for the procurement of a Police Department Crime Lab Generator.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to take actions associated with
procuring a General Contractor for the procurement and installation of a generator for the Police
Department's Crime Lab located at 3616 E. Lancaster Avenue. This project is to provide equipment,
materials and labor for the installation of a backup generator for the facility.
A Notice to Offerors was advertised in the Fort Worth Star -Telegram on July 27, 2023 and August 3,
2023 in the Bids and Proposal section for Best Value. Proposals were due August 9, 2023. The City
received two proposals from bidders. These contractors were:
NorCom Integrated Systems, Inc.
SDB, Inc.
Upon review only SDB, Inc. provided all requested Bid, Payment and Performance Bonds, General
Liability and Statutory Workers Compensation Coverage and was thus awarded the contract for this
project. In order to expedite the project, SDB, Inc. identified construction equipment which has long
lead times. Early procurement of the equipment is needed in order to hold pricing and maintain a
construction start date of Fall 2024.
