HomeMy WebLinkAboutOrdinance 15460ORDINANCE NO. ~ Jam' `f' (nQ AN ORDINANCE ADOPTING THE CITY OF FORT WORTH 2003 COMPREHENSIVE PLAN; ANALYZING POPULATION, ECONOMIC AND FINANCIAL TRENDS; DESCRIBING MUNICIPAL SERVICES AND FACILITIES; DESCRIBING ECONOMIC AND TECHNOLOGICAL ISSUES AFFECTING DEVELOPMENT; DESCRIBING IMPLEMENTATION TOOLS; DIVIDING THE CITY INTO 16 PLANNING SECTORS; PROVIDING MAPS DESCRIBING PROPOSED FUTURE LAND USES AN'D RECOMMENDED LAND USE POLICIES FOR EACH SECTOR; ESTABLISHING. GOALS AND RECOMMENDED POLICIES, PROVIDING A SEVERABILITY CLAUSE; A1VD PROVIDING AN EFFECTIVE DATE WHEREAS, the City Council approved Ordinance No. 14996 adopting the Fort Worth 2002 Comprehensive Plan on February 26, 2002; WHEREAS, the 2002 Comprehensive Plan is the City of Fort Worth's general guide for malting decisions about growth and development; WHEREAS, the 2002 Comprehensive Plan includes, without limitation, provisions on land use, housing, parks and community services, libraries, human services, neighborhood capacity building, economic development, transportation, telecommunications, education, historic preservation, urban design, arts and culture, police services, fire and emergency services, environmental quality, public health and municipal facilities; WHEREAS, it is the City Council's intent to update the Comprehensive Plan annually; WHEREAS, after conducting a joint work session with the City Plan Commission and the Zoning Commission on August 2$, 2002, and briefing the City Council on September 3, 2002, the Planning Department issued a public review draft of the 2003 Comprehensive Plan; WHEREAS, the Planning Department conducted a series of 12 community meetings and held a Citywide Forum on October 14, 2002, to receive comments on the 2003 Comprehensive Plan; WHEREAS, the City Plan Commission has reviewed the public review draft of the 2003 Comprehensive Plan and on December 20, 2002, recommended certain revisions to the future land uses shown in the Eastside, Far North, Far Northwest, Far West, Northeast, Southeast and Wedgwood sector maps included in Appendix C to the plan, so as to make the maps consistent with zoning cases recently approved by the City Council and platting cases recently approved by the City Plan Commission, and so as to reflect other land use trends; WI3EREAS, on January 22, 2003, the City Plan Commission conducted a public hearing on the 2003 Comprehensive Plan and recommended that the City Council approve the plan, as amended to include revisions to the sector maps in Appendix C identified above (attached hereto as Exhibit A); WHEREAS, the City Manager's Office distributed a memorandum on January 30, 2003, describing certain recommended revisions to policy statements in the Housing, Economic Development, and Financial Incentives chapters regarding the Neighborhood Empowerment Zone program (attached hereto as Exhibit B); WHEREAS, the City Council conducted public hearings on the 2003 Comprehensive Plan on February 4 and February 11, 2003, at which the public was given the opportunity to give testimony and present written evidence; and WI3EREAS, on February 18, 2003, the City Council discussed the public hearing comments and City staff responses, and directed staff to revise the Western Hills/Ridglea sector map in Appendix C so as to change the future land use designation of certain property from Institutional to Single Family Residential (attached hereto as Exhibit C). 2 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION 1. The 2003 Comprehensive Plan of the City of Fort Worth is adopted as set out in Exhibits A, B, and C attached and incorporated as if contained herein, specifically including existing plans and studies described in Appendix A to the Plan which are incorporated by reference. SECTION 2. The City of Fort Worth 2003 Comprehensive Plan supersedes and replaces the 2002 Comprehensive Plan. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. This ordinance shall take effect upon adoption. DISCUSSION: The City Council authorized staff to release a public hearing draft of the 2003 Comprehensive Plan for public review on December 3, 2002. On December 20, 2002, the City Plan Commission recommended certain amendments to the Eastside, Far .North, Far Northwest, Far West, Northeast, Southeast and Wedgwood future land use maps in Appendix C of the plan. These amendments are the result of recent zoning and platting decisions and land use trends. The City Plan Commission held a public hearing on the plan on January 22, ~ 2003. After providing an opportunity for public comment, the City Plan Commission voted to recommend adoption of the plan with the proposed amendments to the sector maps. City staff concurs with that recommendation and, in response to recent City Council discussions, further recommends the following minor amendments to policy statements regarding the Neighborhood Empowerment Zone program: ® Housing Chapter, Page 50 Revise the following policy statement: "9~+era~ Use the Neighborhood Empowerment Zone program d to promote the development of designated urban villages and the revitalization of surrounding lower-income neighborhoods; and . ® Economic Development Chapter, Page 90 Same as above; and ® Financial Incentives Chapter, Page 221 Delete, the following sentence: "The City Council has approved ,orienting the Neighborhood Empowerment Zone program toward development• of designated urban villages and: the revitalization of surrounding lower-income neighborhoods." The City Council held public hearings on February 4 and 11, 2003 (M&C G-13876), on the plan as recommended by the City Plan Commission. On February 18, 2003, the City Council discussed the public hearing comments, City staff responses, and directed staff to revise the future land use designation of certain property around the Vickery Boulevard and Southwest Boulevard intersection from Institutional to Single-Family Residential. The City Council also directed staff to place an appropriate Mayor and Council Communication on the February 25, 2003, City Council Agenda for adoption of the plan. C'aty of .~'oa~t Woa~th, ~'e.~as M~ or end Council Communication y .SATE REFERENCE NUMBER LOG NAME PAGE 2/25/03 G-13895 22PLAN 2~ of 3 suB~ECT ADOPTION OF THE CITY OF FORT WORTH 2003 COMPREHENSIVE PLAN The 2003 Comprehensive Plan reflects the following substantive revisioris to the 2002 Comprehensive Plan: Routine Updates • Incorporated the most current data available; and ® Added text to the introduction describing the relationship of departmental business plans to the Comprehensive Plan; and • Refined various goals, objectives, policies and strategies based on comments from the City Council, City departments and cooperating agencies; and ® Added sections to the Human Services chapter on Crisis Relief, Family Support, Health, Youth Services, Senior Services, and Information and Referral; and e Deleted the Telecommunications .chapter and moved pertinent text to Land Use, Human Services, Urban Design, and Municipal Facilities chapters; and • Added a section on the Justex Police Management Study to the Police Services chapter; and ® Added a section to the Environmental Quality chapter on energy conservation; and ® Added sections to the Public Health chapter on preventing bio-terrorism, obesity, and child injuries; and • Made various changes to the future land use maps in Appendix C in response to land use changes, zoning decisions,, and other factors; and • Removed completed or cancelled capital improvement projects in Appendix D, and added new projects to Appendices D and E. Recent Policy Decisions ® Added a strategy to the Development Regulations chapter to implement the recommendations of the Focus Group on Development Review Procedures; and • Added text to the Annexation Policy chapter on current annexation initiatives and limited- purpose annexation; and • Reflectedrecommended policies regarding designated urban villages on the Arlington Heights, Eastside, Northside, Southeast, Southside, TCU/Westcliff and Western Hills/Ridglea sector maps; and City of Fort '~Yorth, ~'exas Ma or and Council Communication SATE REFERENCE NUMBER LOG NAME PAGE 2/25/03 G-13895 22PLAN 3 of 3 SUBJECT ADOPTION OF THE CITY OF FORT WORTH 2003 COMPREHENSIVE PLAN • Added the 2002 Master Thoroughfare Plan, Central City Commercial Corridors Revitalization Strategy, Handley Model Block Plan, and Transit Alternatives Analysis to plans adopted by reference in Appendix A. Policy Initiatives • Added a recommended policy to the Land Use chapter to accommodate .residential and mixed uses in areas designated as commercial on future land use maps; and _ ~. • Added a recommended policy to the Land Use chapter to support zoning changes that reduce .the amount of vacant land zoned for multi-family residential development beyond designated growth centers and urban villages; and • Added a recommended policy to the Housing chapter to support neighborhood initiatives to regulate the design of industrialized and site-built housing to preserve neighborhood character; and I • Added a recommended policy to the Housing ,chapter to provide housing opportunities for i~~~ `': people at all income levels in neighborhoods across the City.
