HomeMy WebLinkAboutOrdinance 27550-03-2025 (3)Ordinance No. 27550-03-2025 AN ORDINANCE ADJUSTING APPROPRIATIONS IN THE 2018 BOND PROGRAM FUND IN THE AMOUNT OF $502,153.22 BY INCREASING APPROPRIATIONS IN THE 2025 ANIMAL SHELTER IMPROVEMENT PROJECT (CITY PROJECT NO. 106137) AND DECREASING APPROPRIATIONS IN THE NORTH ANIMAL CARE FACILITY PROJECT (CITY PROJECT NO. 100609) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE I OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: i SECTION 1. That the budget of the City of Fort Worth for Fiscal Year 2024-2025, as enacted by Ordinance 27107-09- 2024, as amended, is hereby further amended to make the following adjustments to appropriations in the 2018 Bond Program Fund in the amount of $502,153.22 by increasing appropriations in the 2025 Animal Shelter Improvement project (City Project No,106137) and decreasing appropriations in the North Animal Care Facility project (City Project -No. 100609) by the same amount. {, SECTION 2. That should any portion, section or part of a section ofthis ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27107-09-2024 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Goodall City Secretary City of Fort Worth, Texas Mayor and Council Communication DATE: 03/25/25 M&C FILE NUMBER: M&C 25-0260 LOG NAME: 232025 ANIMAL SHELTER IMPROVEMENTS SUBJECT (CD 10 and CD 11) Adopt a Finding that the Animal Care and Shelter Facility Improvements in the 2018 Bond Program are Substantially Complete and Reallocate Residual Funds in the Amount of $502,153.22 for the Purpose of Funding the 2025 Animal Shelter Improvement Project, Adopt Appropriation Ordinance, and Amend the Fiscal Years 2025- 2029 Capital Improvement Program RECOMMENDATION: It is recommended that the City Council: 1. Find that the Animal Care and Shelter Facility Improvements in the 2018 Bond Program are substantially complete and reallocate residual funds to another project coming within the original voted purpose; 1 2. Adopt the attached ordinance adjusting appropriations in the 2018 Bond Program Fund by decreasing appropriations in the North Animal Care Facility project (City Project No.1100609) by $502,153,22 and increasing appropriations in the 2025 Animal Shelter Improvement project (City Project No.106137) by the same amount; and 3. Amend the Fiscal Years 2025-2029 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to reallocate residual funds from Proposition E of the 2018 Bond Program to another project coming within the original voted purpose. In approving Proposition E, voters authorized funding for "Animal Care and Shelter Facility Improvements." The sole project identified in the bond booklet was the North Animal Care and Shelter Facility. Construction of that facility is now substantially complete and staff has identified a residual amount of $502,153.22 as being available for other uses coming within the voted purpose. Staff has identified capital needs at both existing shelter locations and proposes using these remaining funds to pay for the following improvements. 1. Kennel purchases for the Silcox Animal Campus: new and improved cat cages as well as small or medium dog enclosures and new kennel gates. 2. Play yard maintenance at North Animal Campus to include replacement of turf. 3. Stainless steel cabinetry for the clinic area. 4. Access to natural light in the building via skylights or other means. Approval of this M&C serves as findings from Council that the project originally proposed in the 2018 Bond Program is substantially complete and that the newly added uses are within the voted purpose authorized by the voters. The adoption of the attached ordinance will close out the North Animal Care Facility project and allow the remaining proceeds to be used for the necessary improvements at either shelter location. Funding is budgeted in the 2018 Bond Program Fund for the Code Compliance Department for the purpose of funding the 2025 Animal Shelter Improvement project. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION 1 CERTIFICATION: The Director of Finance certifies that funds are currently available in the North Animal Care Facility project within the 2018 Bond Program Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the 2018 Bond Program Fund for the 2025Animal Shelter Improvement project. Prior to an expenditure being incurred, the Code Compliance Department has the responsibility of verifying the availability of funds.
