Home My WebLink AboutContract 61209-A2CSCO NO. 61209-A2 TRANSPORTATION IMPACT FEE CREDIT AGREEMENT AMENDMENT AMENDMENT NO.2 TO CITY SECRETARY CONTRACT NO.61209 WHEREAS, the City of Fort Worth ("City"), a Texas home rule municipal corporation, and GBTM Sendera LLC, a Delaware limited liability company authorized to do business in Texas ("Owner"), made and entered into a Transportation Impact Fee Credit Agreement, City Secretary Contract No. 61209, on 03/29/2024 (the "Agreement"), and has been further amended ("Amendment No. 1"), City Secretary Contract No. 61209-A1, on 02/01/2025; and WHEREAS, the Owner received approval for construction plans (IPRC22-0220) on 02/02/2023, executed a Community Facilities Agreement (CFA22-0186, CSCO 60711) on 01/07/2024, and obtained final acceptance by the City for Sendera Ranch Boulevard, City Project Number 104386, on 03/25/2025; and WHEREAS, the Owner has dedicated 66,812 square feet of additional right-of-way for Sendera Ranch Boulevard north of Rancho Canyon with FP-23-031, recorded as Instrument 202405243, on 04/24/2024; and WHEREAS, it has become necessary to execute this Amendment No. 2 to said Agreement to incorporate additional credits created by the dedication of Sendera Ranch Blvd. right-of-way north from Rancho Canyon Way by supplementing Exhibit "D" with the Exhibit "D-2" and supplementing Exhibit "E" with the Exhibit "E-2"; NOW, THEREFORE, for and in consideration of the mutual agreements, covenants, and conditions contained herein, and other good and valuable consideration, the City and the Owner hereby covenant and agree as follows: 1. Recitals. The recitals contained in this Agreement are true and correct as of the Effective Date and form the basis upon which the Parties negotiated and entered into this Agreement. 2. Exhibit "D" to the Agreement shall be supplemented with Exhibit "D-2"attached hereto and incorporated herein by this reference. 3. Exhibit "E" to the Agreement shall be supplemented by adding Exhibit "E-2", attached hereto and incorporated herein by this reference.
