BACKGROUND
Since July 1995 a multi-departmental task group has been involved in an on-going investigation
of locations along Hemphill Street that are used as rooming/lodging houses and that may be in
violation of the City's codes for such uses. In July 1995 members of the Southside Alliance
presented a list of 26 such locations. The addresses for these locations are attached. It was agreed
that the City staff would begin investigations and, if appropriate, enforcement actions on
properties that were not in compliance with City codes. Both Mayor (then Council member) Barr
and Council member Hirt have been involved in meetings with staff and representatives of the
Southside Alliance.
A staff task force consisting of staff from Code Compliance, Law, Development, and the Fire
Departments began work to research and inspect the 26 addresses. After initial inspections, City
staff added four addresses for investigation, bringing the total number of questionable properties
to 30.
DISCUSSION
Each address was researched for zoning information and it was determined whether or not the
location had a valid Certificate of Occupancy. Research on these properties involved reviewing
paper and microfilm records for properties that may be up to sixty or seventy years old. Field
inspections involved inspectors from Code Compliance, Development, and Fire to visit each site
to determine compliance with various provisions of the City Code. For those locations found to
have violations, notices were issued. Properties that did not come into compliance within the
designated time frame were issued citations. These citations were then processed through the
courts via the Prosecutor's Office.
Of the 30 properties investigated, 19 have been confirmed to be in compliance with City codes.
The remaining 11 properties are scheduled or will be scheduled for a court hearing date in the
near future. Six addresses are scheduled for a court hearing on March 24, 1997. The remaining
five properties have not been scheduled for a definite hearing date, but will be the subject of
litigation if the code violations are not abated.
Although the time frame to address these properties has been lengthy, the task force has been
very successful in responding to the concerns of the citizens who originally brought these
properties to the attention of the City. Attached is a list of all addresses that have been
investigated and a notation as to the outcome of the investigations.

RECOMMENDATION
There is no action required by the City Council. The remaining properties will be the subject of
enforcement actions until compliance has been obtained or otherwise disposed of through the
courts.
