That the wor�C herein cont�mplated shall consist of furnishing as an indeqendent contraefor all
labar, tools, appliances and materials necessary for the c,or�struc�ian and campletion of said project in
accordance with the Plans and Specifications and Contract Documents pr�pared by the Dep�rtment of
Engineering for t�e Transportation and Public Works Departm�nt of the City of Fort Worth adopted by the
City Council of the City of Fort Worth, which Plans and Specifiic�tions and Can#ract Dacuments are hereto
attached and made a part pf this contract tl�e same as if written herein.

The Contraetor hereby agrees and binds himself ta commence the construction af said work within
ten (10} days after being notified in wriiing to do so by the Department of Engineering of the City ofi Fort
Worth.

The Cor�tractor hereby agr�ees to prosecute said wor�c with reasonable diligence after the
commencement thereof and to fully complete and #ini�h t�te sam� ready for the inspection and appro�al of
the Department of Engineering of the City of Fort Worth and tF�e City Council of the City af Fort Worth
within a period af 55 (Fif�v�F`ieel _ working days.
If the Cor�tractor shouid fail to complefie the wor�t as set fort� in the Plans and Specifications and
Contract Documer��s wii�hin the time so stipula#ed, plus any additional time allawed as pro�ided in the
General Conditions, there shall be dedu�#ed from any monies due or which may thereafter become due
F�im, the sum of � �10.�� per warking day, nat as a penalty buk as liq�ida#ed damag�s, the
Contractor and his Surety sk�al� be liable to the Owner for such deficiency.

carry on and cr�mplete the same according io the true meaning of the intent and terms of said Plans,
Sp�cifica#ions, and Co�trac� Documents, then th� Owner shall ha�e the right to either demand the s�f�ty
to take over tl�e woric and compleie the same in accordance with the Contract Documents or to take
charge of and complete the work in such a manner as it may deem proper, and if, in the completion
thereaf, th� cos# to the said City shall exceed the contract price or prices set forth in t4�e said Plans and

In the euent 4wner recei�es a written claim fior damage� against the Contractor or its subcontractors
prior to final paymen�, finai payment shaff not be made until Contractor either (a) submits to �wner
satisf�ctory evidenc�; that the claim has been s�ttled andlor a refease from the claimant in�ol�ed, or
(b) provides Owner with a letter from Contractor's liability ir�surance carrier that the claim has been
referred to the insurance carrier.
The Director may, if he deems it appropriate, refuse to accept bids on other City of Fort Worth pu�lic
work from a Contractor against whom a claim for damages is outst�nding as a result of work
performed under a City Car�t�act,

The Contractor agrees, an the exe�ation of this Contract, and before beginning work, to make,
ex�cute and de�i�er to satd City of Fort Worth good and sufficient surety bonds for tl�e faithfui
performance nf �e terms and stipulations of the Cor�tract and for the payment to aA cf�imants for lafoor
andlor ma�erials fumished in the prosecution of the work, such bonds being as pro�ided and required in
�e�as Go�rem�rr�►�t Code Secfion �2�3, as amended, in the form included in the Cantract Documents,
and such bonds shall be 1 DO percent (100%) of the total contract price, and the said surety shall be a
surety company duly and legally authorized to da business in the State af Texas, and acceptable to the
Ci#y Coun�il of the Ci#y ofi Fort Worth.

RECOMMENDATION:
It is recommended #hat the City Council:
1. Authorize the City Manager to transf�r $�44,943.�0 from the General Fund ta t�e Confiract Streef
Maintenance Fund; and
2. Adopt #he attached apprapriatian ordinance increasin� estimated receipts and appropriafiions in the
Contract Street Mainte�ance Fund in the amaunt of $544,943.50 from a�ailable funds to fund a
portion of the 2001-2002 Street Maintenance Program; and
3. Authorize the City Manager to execute a con#ract with Peachtree Construction, Ltd. in the amouni of
$461,516.5� for 55 warking days for HMAC (hot mix asphaltic concrete) 5urtace Overlay 2002-15.
�ISCUSSION:
In the FY2Q01-2002 Contract Major Maintenance Program, various types of street maintenance I
techniques are grouped into specific contract packages. HMAC Surtace Overlay 2002-15 provides for i
surface and base rehabilitation, ccarb and gutter, and vafley gutter replacements for asphal� sireets at �
various lacations funded from the Cantract Street Main�enance Fund.
The follawing list details the limits for each of the streets included in thi� praject:
