NONATTAE`4MENT STATUS
In response to questions raised at Pre-Council on May 14, 1996, the following information is
offered for the City Council's review.
Guidance procedures for bumping up "moderate" nonattainment areas have not yet been
established by the Environmental Protection Agency (EPA). However, the Texas Natural
Resource Conservation Commission (TNRCC) believes that the following sequence of events
would occur under the current (0.12 parts per million) ozone standard. Some dates could
possibly be moved up if the process is fast-tracked.
1. Based upon the air quality monitoring data from 1994 and 1995, it is likely that the
DFW area cannot demonstrate attainment by the November 15, 1996 deadline;
2. EPA may grant up to two 1-year extensions of the attainment dates (November 15,
1996) specified in section 18 1(a)(5) of the Clean Air Act (CAA) upon application by
the State (TNRCC) if the State has complied with all the State Implementation Plan
(SIP) requirements and if there is no more than one ozone exceedance at any one
monitoring site in the area in the year the extension year.,
3. Section 181(b)(2) of the CAA states that the EPA will determine within six (6)
months following the applicable attainment date (November 15, 1996) whether an
area attained the standard. The CAA requires the EPA to publish a notice in the
Federal Register identifying the areas that have not attained the standard no later than
six (6) months following the attainment date;
4. EPA would assign a new deadline for the State's submittal of the DFW Attainment
Demonstration (probably November 1998 -- May 1999);
5. The TNRCC would develop a complete emissions inventory;
6. The TNRCC would run new modeling, preferably using 1996 as the baseline instead
of 1990 (as previously used) (May 1998 -- November 1998);
7. The TNRCC would develop control strategies based on the results of the emissions
inventory in order to make the necessary reductions (May 1999);
8. The TNRCC would revise the SIP and take it through the public hearing process
(November 1999); and
9. This would be in keeping with the attainment date for "serious" i ft—e, ..............

The Department of Environmental Management will continue to actively monitor this situation
with the EPA and the TNRCC. The department has requested the North Texas Clean Air
Coalition to schedule a meeting, in June 1996, for representatives from all municipalities and
major industries in the DFW area to address potential actions for mitigation. A request was also
made of the Council of Govenments (COG) to convene local government officials and EPA
representatives to discuss alternate measures. In addition, efforts will continue with the COG, the
Chamber of Commerce, and other cities to increase citizen awareness of the situation and solicit
their involvement and cooperation.
The Department of Environmental Management is preparing a list of bump-up actions that could
be imposed on the Metroplex and what their direct consequence could be. This list will be
reported to the City Council as soon as possible. For further information concerning this issue,
