MEMORANDUM OF UNDERSTANDING
BETWEEN THE CITIES OF FORT WORTH, ARLINGTON,
AND COUNTY OF TARRANT, TEXAS
FY 2024 EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT FORMULA PROGRAM
AWARD
This Memorandum of Understanding ("MOU") is made and entered into this 2nd th day of
May 2025, by and between the COUNTY of TARRANT, acting by and through its duly
authorized representative (hereinafter referred to as COUNTY), the CITY of FORT WORTH, acting
by and through its duly authorized representative (hereinafter referred to as CITY), and the City of
Arlington acting by and through their duly authorized representatives (hereinafter referred to as
SUBRECIPIENT), located entirely within the State of Texas, witnesseth:
WHEREAS, the governing bodies of City, County, and Subrecipient find that the performance of this
MOU is in the best interests of all parties, that the undertaking will benefit the public, and that the
division of costs fairly compensates the performing party for the services or functions under this MOU;
and
WHEREAS, under the FY 2024 Edward Byrne Memorial Justice Assistance Grant (Grant), the
Department of Justice (DOJ) has awarded a total of $519,546.00 to be distributed to the parties to
this MOU; and
WHEREAS, the CITY has agreed to serve as the fiscal agent for the Grant, and distribute all such
funds between the cooperating parties; and
WHEREAS, DOJ agrees to provide the COUNTYan amount of $10,021.00 from the Grant award; and
WHEREAS, the CITY agrees to provide the COUNTY an amount of $88,399.00 from the Grant award;
and
WHEREAS, SUBRECIPIENT agrees to provide the COUNTY an amount of $38,982.00 from the
Grant award; and
WHEREAS, the CITY, SUBRECIPIENT and COUNTY believe it to be in their best interests to
reallocate the Grant funds as set forth herein.
NOW THEREFORE, the COUNTY, CITY, and SUBRECIPIENT agree as follows:
Section 1
A breakdown of funds being allocated pursuant to this MOU is set forth in the Table attached
as Exhibit A to this MOU. As set forth in Exhibit A, CITY shall make the following reimbursements:
CITY agrees to reimburse COUNTY a total of $137,402.00 of Grant funds. This total includes
the amounts provided by CITY, SUBRECIPIENT, and a direct allocation outlined above. In no event
shall County receive more than $137,402.00 under this MOU.

CITY agrees to reimburse ARLINGTON a total of $116,945.00 of Grant funds which is the
allocation total of $155,927.00 minus 25% to Tarrant County.
Section 2.
The above parties agree to utilize their jurisdiction's individual award as outlined in a separate
Memorandum of Understanding between the City of Fort Worth and the individual municipality or county.
Section 3.
It is expressly understood and agreed that, in the execution of this MOU, no party waives, nor shall be
deemed hereby to waive, any immunity or defense that would otherwise be available to it against claims
arising in the exercise of governmental powers and functions.
Section 4.
Each party to this MOU will be responsible for its own actions in providing services under this MOU and
shall not be liable for any civil liability that may arise from the furnishing of the services by any other party.
This MOU creates no rights in any third party.
Section 5.
Section 6.
As to each individual party, this MOU incorporates by reference the terms and conditions contained in the
following three additional documents, as if set forth at length herein: (1) the Memorandum of
Understanding between the City of Fort Worth and the individual municipality or county regarding the
FY2024 Byrne Justice Assistance Grant; (2) the applicable Grant Award Agreement; and (3) the
individual municipality's budget submitted in connection with this grant award. This MOU, including the
documents incorporated specifically herein by reference, contains the entire understanding between the
parties as to the matters contained herein. Any prior or contemporaneous oral or written agreement or
other documents are hereby declared null and void to the extent they may conflict with any provision of this
MOU.
The signature lines for each subrecipient are being executed on individual pages and are attached as
part of the MOU.
Section 7.
The person signing this MOU hereby warrants that he or she has the legal authority to execute this MOU
on behalf of his or her respective Party, and that such binding authority has been granted by proper order,
resolution, ordinance, or other authorization of the entity. The other Party is fully entitled to rely on this
warranty and representation in entering into this MOU. This MOU may be executed in one or more

counterparts and each counterpart shall, for all purposes, be deemed an original, but all such counterparts
shall together constitute one and the same instrument. Any signature delivered by a party by facsimile
or other electronic transmission (including email transmission of a portable document file (pdf) or similar
image) shall be deemed to be an original signature hereto.

AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE GRANTS OPERATING FEDERAL FUND, SUBJECT
TO RECEIPT OF THE GRANT, IN THE AMOUNT UP TO $750,000.00, FOR THE
PURPOSE OF FUNDING THE EDWARD BYRNE MEMORIAL JUSTICE
ASSISTANCE GRANT PROGRAM FOR FISCAL YEAR 2024, PROVIDING FOR
A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2023-2024 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants
Operating Federal Fund, subject to the receipt of the grant, in the amount up to $750,00.00, for the purpose of
funding the Edward Byrne Memorial Justice Assistance Grant Program for Fiscal Year 2024.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the application for, and the acceptance of, if awarded, the Edward Byrne Memorial Justice Assistance Grant Program for Fiscal
Year 2024 from the United States Department of Justice, Office of Justice Programs and Bureau of Justice Assistance in an amount up to
$750.000.00;
2. Authorize the execution of a grant agreement with the United States Department of Justice, Office of Justice Programs and Bureau of Justice
Assistance;
3. Authorize the execution of related memoranda of understanding with sub -grantees identified by the Department of Justice; and
4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Operating Federal Fund, subject
to receipt of the grant, in an amount up to $750,000.00, for the purpose of funding the Edward Byrne Memorial Justice Assistance Grant
Program for Fiscal Year 2024.
DISCUSSION:
The City of Fort Worth Police Department (FWPD) will apply for program funding in an amount up to $750,000.00 in eligible grant expenses
including but not limited to training, supplies, equipment, or contractual services. The goal of the United States Department of Justice (US
DOJ) Edward Byrne Memorial Justice Assistance Grant (JAG) Fiscal Year 2024 (FY2024) Program, which was established by the US DOJ, is to
allow local governments to support a broad range of activities aimed at preventing crime and improving the criminal justice system. FWPD will
apply for the grant in conjunction with the US DOJ identified sub-awardees that were determined on a formula basis through crime data. In
general, FWPD will request funds to purchase police equipment, supplies, contracts, and training. Selected projects will be approved through our
Chain of Command and Needs Assessment process. No employee positions are funded through this grant.
The JAG Program has a public comment requirement that must be completed prior to the submission of the grant application. FWPD utilizes the
City of Fort Worth Mayor & Council (M&C) Agenda Meeting process to meet this requirement. The grant application is typically released in mid -
June with an early August due date.
Matching funds are not required under this grant. The funding type is reimbursable. Indirect costs are an allowable budget category in this
grant. No indirect cost revenues are expected to result from this program.
The grantwill serve ALL COUNCIL DISTRICTS.
A Form 1295 is not required because: This contract will be with a governmental entity, state agency or public institution of higher education: U. S.
Department of Justice
FISCAL INFORMATION 1 CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations, and adoption of the attached appropriation ordinance, funds
will be available in the current operating budget, as appropriated, in the Grants Operating Federal Fund. The Police Department (and Financial
Management Services) will be responsible for the collection and deposit of funds due to the City. Prior to an expenditure being incurred, the Police
Department has the responsibility to validate the availability of funds. This is a reimbursement grant.

Justice Assistance Grant (JAG) Group MOU with the Department of Justice (DOJ) totaling $519,546.00.00.
The Fort Worth Police Department (FWPD) is the Awarded Grantee and serves as the fiscal agent for the two
allocated Subrecipients, including the city of Arlington Police Department (APD), and Tarrant County (TC).
FWPD is allocated a total of $265,199.00 for community policing that is divided among 3 Units: the Community
Emergency Response Team (CERT) will use $98,699.00 for training ($33,845) and operational supplies ($64,854),
Narcotics will use $91,500.00 for body armor supplies, and SWAT will use the remaining $75,000.00 for aiming
lasers supplies. These operational supplies and emergency training will be used to enhance our community policing
efforts to be well-equipped and well -trained when responding to the public safety needs of the community.
APD is allocated $116,945.00 for approved police equipment and accessories for their red dot training program. TC is
allocated $137,402.00 for contractual mental health services on police calls in partnership with the My Health My
Resources of Tarrant County to deter jail.

Grant Award, and the FY24 JAG Group MOU Legal Approval Memo, authorizing the execution of the Group
MOU.
