1873 Subject: DFW RAILTRAN SYSTEM - REQUEST FOR
TXDOT WAIVER OF REIMBURSEMENT OF
PROCEEDS FROM THE SALE OF SURPLUS PROPERTY
In 1984,when the DFW RAILTRAN Corridor was acquired,certain areas were acquired that
have now been identified as surplus. These properties will be sold at no less than fair market
value to the highest bidder.
Under City Secretary Contract No. 13291 between the State of Texas and the Cities of Fort
Worth and Dallas which conveyed approximately $4,420,000 to the Cities from the State
Department of Highways and Public Transportation for the purchase of the RAILTRAN
Corridor, any portion of the Corridor no longer used for transportation must be sold and a
proportional amount of the purchase price remitted to the State, that is 13%.
The RAILTRAN Policy Committee requests that the Texas Department of Transportation
(TxDOT) waive their right to this reimbursement and allow any proceeds due them to be
applied back into the RAILTRAN project. The use of State funds would strengthen
TxDOT's commitment to intermodalism in this support of rail transportation.

In order for the State of Texas to waive its right to reimbursement,the Texas Transportation
Commission would have to approve the waiver. Since the original contract was signed by
both District 2 (Fort Worth) and District 18 (Dallas) District Engineers and both the Fort
Worth and Dallas City Managers and if Council has no objection, a letter will be sent under
Mr. Terrell's and John Ware's signatures requesting their assistance in bringing this issue
before the Transportation Commission.
